    Both are the Most Prominent and Great Scholars, Ahlul Ilm, & 'Ulama of Ahlu As-Sunnah/Salafiyyah.
    Sheikh ibn Uthaymeen رحمه الله as stated is the issue of Ijtihaad...
    While Sheikh ibn Uthaymeen recommended Sheikh Saleh Al Fawzaan حفظه الله after him...
    May Allah عزّ و جلّ be pleased with all of them!

    It is very important to note that the sheikh sort of retracted his opinion on the permissiblility by the end of his life and changed his fatwa and said one should only take a photo for necessity and its haram to save or store for memories and so on

      “Making pictures for this purpose is haraam and is not permitted. That is because making pictures for memories is haraam, because the Prophet (ﷺ) said, “The angels do not enter any house in which there is an image,” [Sahīh al-Bukhārī], and whatever the angels do not enter had no goodness in it.”
      [Fatāwa Manār al-Islām, 3/759]
      Shaykh Ibn ‘Uthaymīn (may Allāh have mercy on him) also said,
      “It may be obligatory to make images sometimes, especially moving images. For example, if we see someone committing a crime that is a crime against a person’s rights, such as a murder attempt and the like, and it cannot be proven except by means of a picture, then in that case taking a picture is obligatory, especially in cases where pictures could tell the full story, because the means are subject to the same rulings as the ends. If we use this image-making to prove the identity of a person lest he be accused of a crime committed by someone else, there is nothing wrong with this either, rather it is essential. But if we take a picture in order to enjoy looking at it, this is undoubtedly haraam.”

      Even though he is of the opinion that instant imagery (the fourth category) is not prohibited, he explicitly stated making pictures for memories and fun - is prohibited. People take photos mostly for memories and fun.
      Going by his opinion of picture making:
      Pictures (of men and other creatures) for conveying a useful message (news, facts, biology textbooks - may be allowed, while making pictures for memories (with family, friends, classmates, colleagues, neighbours) and fun (jokes, memes) - is prohibited
      This is my reasoning based on his fatāwa

    May Allāh subhanahu wa ta’ala have mercy upon Shaykh Al-Uthaymeen and upon all his righteous servants ameen. But this Fatwaa is different than the one from Shaykh Saleh Al-Fawsan ( Hafidahu Allāh ) where he is totally against all kind of images ( Statues, Drawings or Photography ). May Allāh subhanahu wa ta’ala make all of us sahabas of the prophet Muhammad salallahu Alayhi Wasallam in Jannat and forgive our faults as we are only men far away from perfection ameen.

      The shaykh mentioned at the beginning that this issue is ijtihaadi, so it is expected that different scholars will hold different positions

    May Allāh have mercy on our Shaykh.
    The position of Shaykh Muqbil (rh) and Sh. Al-Albani (rh), Sh. Bin Baaz (rh) and Sh. Fawzan (hfd) seems to be closer to the evidence, and Allah knows best.
    That is, that it's not permissible and comes under image making (as prohibited in the hadith).
    For example, if we take a picture of a person from our iPhone, and then print it out and hang it up on the wall in our house, is this permissible?
    The answer would be that it's not permissible because we can't hang up images of living beings in our homes.
    So by capturing the image from the iPhone, this was the initial step taken to make the image. The second step would be printing it out and hanging it up on the wall.
    If it's haraam to print it out and hang it up on the wall, by necessity, it must also be haraam to capture the image in the first place, as it's still an image (tasweer) at the end of the day.
    Also, it's just a different type of image-making, but the ruling still applies according to the ulemaa' and what they bring of Evidences. Just like the alcohol we have today is different (it's not all made from grapes and pressed by feet manually as it was 1400 years ago) but it's still alcohol, even if it's made in a factory from a different fruit.

      I understand but I think that his is closer as he is making a good point which all scholars do however I think he means to take a picture and send but I don’t think he means to keep in memories.

      @@ibrahimahmed401 so if we print the picture we took on our phone would that be permissible to hang on the walls? If not, why is that on the paper impermissible but that on our devices is not. Doesn't make sense to me but الله المستعان

      Asalām-Alaykum. According to Sheikh Sālih Al-Fawzān, this is forbidden, so it is a matter of difference.

      @@user-yq2if6ld9h No, because that falls under a different category of having images in your house. "The Angels (of Mercy) do not enter a house wherein there is a picture" - Sahih al-Bukhari 3226. As for having the picture on your phone (which doesn't have the picture displayed at all times), there seems to be no issue. Allahu Alam

    For me, and I am a layman muslim and Allah knows best, is that a picture taken with an Iphone, or any other machine, is not reproducing the creation of Allah.
    Rather, an iphone is a device that allows anyone to capture time. When you take a picture of something with your Iphone, it freezes time and capture it and store it in your device storage.
    Then you could print out this capture on paper for example, but still, I see this as a capture of freezed time, and Allah knows best.

    what about medical books with detailed anatomy diagrams of insides of human body so learning doctors can benefit more and more and help heal and do surgeries better . how is a beneficiary step as that still prohibited, wouldnt this pull muslims behind the rest of the world if implemented

      That's permissible out of necessity. Even the Scholars who prohibit picture taking allowed it in certain circumstances like this, medical reasons. Passport, drivers licence.. Identitfying prisoners etc

      @@AbuMoosaa May Allâh bless you for this response. I heard that noble scholars like Bādiudīn as-Sindhī would use his fingerprint for passport, just to avoid the taswīr. May Allâh reward him for his efforts.

    tasweer is haram and the opinion of a scholar isn't daleel. the hadith is general. it isn't limited to drawing with the hand.

And be brought forth on the day of judgement. If Muslims started with this they would be scared to speak a word.

      So you reject his fatwa because you say an opinion of a scholar is no daleel. Thereafter you state your own opinion that the Hadith is general and not limited to drawing with the hand.
