THRESHOLD AMOUNT: R241 110.59 per year (which equates to about R20 093.00 per month)
It should be noted that our legislation does not create an obligation on employers to issue contracts of employment when employees commence employment. In order for a person to be classified as an 'employee', that is not subject to the existence of a written contract of employment. However, our legislation, in particular the Basic Conditions of Employment Act, in particular section 29 thereof, does create an obligation for employers to provide an employee who commences work with 'written particulars of employment'.
In the labour market, a lot of employees, despite being issued with contracts of employment, do not read such contracts. It is important for an employee and an employer to understand and/or have a basic understanding of the general terms and conditions which should be included in a contract of employment. It should be noted that in this video I discuss some of the general terms and conditions of employment. The terms and conditions I discuss in this video are not the only terms and conditions which employers insert in contracts of employment, but they are the basic terms and conditions of most contracts of employment. Therefore, there can be additional terms and conditions than those I discuss in this video i.e. 'Interception of communication', 'Medical examination' etc.
One of the important clauses I forgot in this video is: "Commencement Date of Employment". Moreover, there are further requirements and/or additional clauses when dealing with Fixed-Term Contracts of Employment.

If it is in your contract then it does exist.

The employer can include other clauses in addition to those in this video. This video only deals with the basic clauses
