This officer interviewing the victim/family is fantastic. He's obviously empathetic/sympathetic, recognizes the victim as, well, a victim, doesn't make any excuses for the guy that did it, is reassuring and compassionate the entire time, and gently encourages them to go further/press charges, while still emphasizing that it's entirely their choice. Seriously, 10/10 policing, and 12/10 just being a human to a fellow human that just went through something traumatic

Generally speaking it is ill advised to grant LE permission to access / search anything you possess; so many people "self snitch" in this way by handing over their phones or telling an officer they can look in their car - only to end up being charged with something completely unrelated. Cops are not your friend and they will lie and mislead you. She may have had concerns about spousal privilege, or there was something on his phone that may incriminate her in some other crime, or maybe she had sensitive photos of herself on his phone, or any number of other reasons but the point is only a fool willingly grants permission for LE to search their property, the 4th and 5th amendments are some of the most important. She preserved evidence to keep it from being destroyed and simply wanted to consult with a lawyer which is perfectly understandable especially considering how much of our lives exists on our phones. I’m 60. I have PTSD with anxiety and depression. I am in counseling, group therapy and I take medication. I’m also a recovering alcoholic. None of my family, my friends in AA, my vet buddies nor the VA will let me use my mental health issues as an excuse for committing any crime or bad behavior. When i was 16, I used to work at K-Mart. There was a 40 ish year old male, that would follow me around the store - and stare at me for hours. Security told him to stop. I *think* because of the video evidence etc, the state can take over, that they already had enough probable cause to get a search warrant for the phone etc - but for any crime, it's always easier when the victim is willing to press charges and testify in court. The police HAVE to ask, since so many cases get dropped or pled down to lesser charges too, the cops have to ask either way, since it all makes a different to the DA's office and the legal wranglings.

I tried finding the court records, but Hot Springs has a terrible Clerk of Courts website. I searched the registry and he is not listed so whatever the outcome, he avoided being marked as a P-word. Too bad.
He wouldn’t be on the registry because the case hasn’t gone to trial. This just happened so the trial will be many months away if there even is one, I bet he pleads out.
@@cruisinguy6024 It happened July 3rd, and it's not a complicated case. They have the evidence and he admitted it. 99% he pleaded out, but you're right. His attorney might have been able to drag it out 90 days and the case is still pending.
@@My_Crazy_Neighbor again, that was just the initial appearance and not anything to resolve the case. On July 24 he entered a plea of not guilty and the next hearing is set for October 4. Like I said, this will take months to resolve. It may be a “simple” case but it’s still a felony and it takes time to work its way through the courts. The process involves a number of steps as part of due process, unlike you see on TV people don’t go to trial just a few weeks after the crime occurred.

Over 20 years ago I went to a ladies room near a library. While in the stall doing what I had to do I looked up to see a middle aged Arabian looking man gazing down at a stall next to mine. He saw me and took off. When I to;d the young woman after she came out she shrugged her shoulders. I then went to the library to report what I saw. The man was arrested a few months after.

His court case was set for July 5, which was just a week after this incident and there's been no update on the case. That suggests to me that the charges were dropped. And this video likely didn't help...the cop was clearly new (even his partner was assisting in getting the cuffs on him) and said a lot of things on camera that a cop shouldn't say about the case (suggesting that he would be on a sexual offenders list to the wife, dad and to the victim and victim's mom). Cops aren't on the scene to interpret the law, they're there to take information and determine if a law was broken. As a cop, you can think whatever you want to about the culprit or accused but when EVERY suspect must be treated as innocent because they are until they've been proven guilty in the court of law. Even if you see someone commit the crime, even if the cop sees a suspect commit a crime, that suspect is still innocent at that point and suggesting otherwise (to witnesses or victims) will get a case dropped bigger than sh*t ASAP. Miranda Rights are of no use if the cop is openly saying he believes a suspect is guilty before he's had a day in court. In this case, the cop went way too far with what he was saying, some of it being very inaccurate from a legal standpoint and I assume a decent lawyer saw this video and the case was dropped. Even the part about him telling the victims' family that he had 3 daughters and that people need to be held accountable could be used by any decent lawyer to prove he convinced them to press charges when they might not have otherwise. That's just how the law works. If anyone can find any updates to determine whether or not it went to court or whether he was found guilty or innocent, I'm interested in seeing it. Because he's clearly guilty but pretty sure all charges were dropped before the trial due to what we all just saw here.
A court date a week after the event would be his initial appearance in front of a judge. There is no way on this planet his trial would happen so soon, in all likelihood he won’t go to trial until early next year depending on how backed up the courts are.

An arraignment would be a matter of public record where the charges are formally presented but it doesn't occur if charges are dropped. At the arraignment, he would have had to enter a plea of guilty or not guilty which, again, would be a matter of public record and reported on through local media and available through public records.

The corporal officer was very professional. He not only showed empathy for the victim and her family, but also for the perpetrator's family as well. He even read the last question of the Miranda rights, "Having these rights in mind, do you wish to speak to me now?" Oftentimes, that last question doesn't get read before the questioning starts.

This officer interviewing the victim/family is fantastic. He's obviously empathetic/sympathetic, recognizes the victim as, well, a victim, doesn't make any excuses for the guy that did it, is reassuring and compassionate the entire time, and gently encourages them to go further/press charges, while still emphasizing that it's entirely their choice.

Generally speaking it is ill advised to grant LE permission to access / search anything you possess; so many people "self snitch" in this way by handing over their phones or telling an officer they can look in their car - only to end up being charged with something completely unrelated. Cops are not your friend and they will lie and mislead you.
She may have had concerns about spousal privilege, or there was something on his phone that may incriminate her in some other crime, or maybe she had sensitive photos of herself on his phone, or any number of other reasons but the point is only a fool willingly grants permission for LE to search their property, the 4th and 5th amendments are some of the most important. She preserved evidence to keep it from being destroyed and simply wanted to consult with a lawyer which is perfectly understandable especially considering how much of our lives exists on our phones.

I *think* because of the video evidence etc, the state can take over, that they already had enough probable cause to get a search warrant for the phone etc - but for any crime, it's always easier when the victim is willing to press charges and testify in court. The police HAVE to ask, since so many cases get dropped or pled down to lesser charges too, the cops have to ask either way, since it all makes a different to the DA's office and the legal wranglings.

I tried finding the court records, but Hot Springs has a terrible Clerk of Courts website. I searched the registry and he is not listed so whatever the outcome, he avoided being marked as a P-word. Too bad.

He wouldn’t be on the registry because the case hasn’t gone to trial. This just happened so the trial will be many months away if there even is one, I bet he pleads out.

On July 24 he entered a plea of not guilty and the next hearing is set for October 4.
Like I said, this will take months to resolve. It may be a “simple” case but it’s still a felony and it takes time to work its way through the courts. The process involves a number of steps as part of due process, unlike you see on TV people don’t go to trial just a few weeks after the crime occurred.
Even the most obvious cases can take months to even start a trial. He can't be registered until the trial is finished.

The victims husband was pretty calm. He wasn’t even red faced. He looks so passive.
Over 20 years ago I went to a ladies room near a library. While in the stall doing what I had to do I looked up to see a middle aged Arabian looking man gazing down at a stall next to mine. He saw me and took off. When I to;d the young woman after she came out she shrugged her shoulders. I then went to the library to report what I saw. The man was arrested a few months after.

Update: Dude pled Not Guilty (he has no remorse) and trial should be starting 12/6/24 (if not pushed back again)
His court case was set for July 5, which was just a week after this incident and there's been no update on the case. That suggests to me that the charges were dropped. And this video likely didn't help...the cop was clearly new (even his partner was assisting in getting the cuffs on him) and said a lot of things on camera that a cop shouldn't say about the case (suggesting that he would be on a sexual offenders list to the wife, dad and to the victim and victim's mom). Cops aren't on the scene to interpret the law, they're there to take information and determine if a law was broken.
As a cop, you can think whatever you want to about the culprit or accused but when EVERY suspect must be treated as innocent because they are until they've been proven guilty in the court of law. Even if you see someone commit the crime, even if the cop sees a suspect commit a crime, that suspect is still innocent at that point and suggesting otherwise (to witnesses or victims) will get a case dropped bigger than sh*t ASAP. Miranda Rights are of no use if the cop is openly saying he believes a suspect is guilty before he's had a day in court.
In this case, the cop went way too far with what he was saying, some of it being very inaccurate from a legal standpoint and I assume a decent lawyer saw this video and the case was dropped. Even the part about him telling the victims' family that he had 3 daughters and that people need to be held accountable could be used by any decent lawyer to prove he convinced them to press charges when they might not have otherwise. That's just how the law works.
If anyone can find any updates to determine whether or not it went to court or whether he was found guilty or innocent, I'm interested in seeing it. Because he's clearly guilty but pretty sure all charges were dropped before the trial due to what we all just saw here.
A court date a week after the event would be his initial appearance in front of a judge. There is no way on this planet his trial would happen so soon, in all likelihood he won’t go to trial until early next year depending on how backed up the courts are.
@@cruisinguy6024 Right...that's called an arraignment and it's the first part of the trial procedure. An arraignment would be a matter of public record where the charges are formally presented but it doesn't occur if charges are dropped.
At the arraignment, he would have had to enter a plea of guilty or not guilty which, again, would be a matter of public record and reported on through local media and available through public records.

I doubt local media is going to follow every step of this trial - if they cover it any further at all. For all intents and purposes it’s a minor matter.

The corporal officer was very professional. He not only showed empathy for the victim and her family, but also for the perpetrator's family as well. He even read the last question of the Miranda rights, "Having these rights in mind, do you wish to speak to me now?" Oftentimes, that last question doesn't get read before the questioning starts.
Love the cop talking to the victim. "I can't tell you what to do, but I WOULD press charges"..
