It is definitely not a kestrel. Kestrels have orange backs. I admit it might not be a peregrin but I believe it is.
Yeah, it's not a Kestrel. I've just had a look on the RSPB website, and I think it might be a female Sparrowhawk. I'd doubt that Peregrines would live near Tom, because they prefer places with tall buildings or cliffs to make it easier to get above the birds they're hunting.
If it was a peregrine it would have more of a black face and the beak would have more colour.... this bird is a Sparrow Hawk :) - shame about it's demise! :(
