In my opinion, if you consider max. deviator stress as a failure criteria then you have to consider sigma3' corresponding to max. deviator stress and not max. value. If we take max. value then every time sigma3 = sigma3' as pore pressure is "0" at the initial stage and as pore pressure increases sigm3' decreases.
yes you are right if you want to find to find effective cohesion and effective friction angle then you need to take corresponding effective sigma3. But in my case i have computed total stress parameters

because sigma 1 max is equal to sigma 3 max + max deviatoric stress

Due to Inconsistent readings but actully cohesion cannot be negative. There is something wrong in readings.
