Most Lincoln policies call for the full amount of your SSD payment to be offset. That is the original Social Security amount as of the day you were first eligible (your Date of Entitlement), not any increased amounts due to cost of living adjustments.
What action can an LTD insurance carrier take against you if you are unable to pay them your SSDI back pay? Can they sue you in all states? And if they can sue you does the fact that you have no money to live and medical bills an acceptable defense that a judge would consider?
First, the insurer can stop your check until it recoups the overpayment. Second, yes, you can be sued...though that rarely happens unless your benefits are cut off. When these suits are filed, the insurer typically will sue you in federal court, because most LTD insurance that hS an offset for SSD is covered by ERISA, a federal law.
I have a situation were i accepted a buy out and the company said they would pay my insurance until i turned 65. Now they are trying to stop how can i get help. ?

Can you get a buy out if they haven't compensated the claim at all. We are appealing the std ltd claim.
While it is possible, it is extremely rare for administrators to buy out claims they have not previously approved.
