    "The rise of auditing" and downfall of security company Mitie.
    Filming has always been an "everyday activity", just like the "everyday activities" of police and security who employ uneducated gormless egotistical plonkers.
    Apparently the pair of not so mighty half men at "Mitie" has learned the hard way about copyright, public access, public photography, citizen journalists / TH-camrs and the law, etc.
    Then the two suited up jobsworths who acted like backyard comedians with stage-fright realised they were up against a far superior opponent, a gentleman who was articulate, knowledgeable, and well versed in the law. Embarrassed, nonsensical and defeated, the pair of dimwits immediately began backpedalling off to do the walk of shame.
    AB, your "My Photograph" video is an absolutely brilliant piece of work.
    Sir Auditing Britain, your viewers and subscribers have awarded you a knighthood for your chivalry and outstanding community service.

    I worked for mitie for a few months, like all big companies they are full of deadwood pompous management. I would bet good money these two have completed this training and skimmed through without taking even the basic information on board. Well done AB

      Mitie basically supply different services and contractor personnel to corporate clients. Services such as security guarding, facilities management, catering, cleaning, CCTV control rooms, gardening, post rooms. I think I've covered most of them, might be a couple I've missed out. I worked for Mitie myself for a little while, well over 10 years ago now. They're nothing special. Sh*t*e Mitie was the nickname us frontline staff and contractors had for them.

      Yeah, I'm proud to get knocked back by Mitie due to a slight blemish on my application form for a maintenance/caretaker job looking after a government funded fish research project. They only seem to employ people without any such blemishes. I think I dodged a bullet.

      Police have no 1st hand knowledge of security services, I once had the job of training our police service in what
      security services were all about be it static guards, mobile patrols, armed payroll escort and crowd control.

    Pity that their head of security for Mitie skipped reading their own internal materials on auditing, since he fell for just about everything mentioned in the pamphlet. They should use your video to train the rest about how to NOT handle someone with a camera.

    The security manager doesn't understand implied rights of access!
    Shocking how these guy are trained.
    They are basically bouncers - 'what you doing here? Ya names not down, you ain't coming in' attitude.
    The guy said "turn your camera off, point it over there, take your mask down and tell me your name" ... Who the hell does he think he is ordering someone about like that when they aren't even standing on their property ?!
    All you gotta do is let them talk and within a couple of minutes they show themselves up to be low IQ people that have very little common sense.
    And these two were proper fannies.

      Someone is saying the security manager was once a copper.
      He gave that away when AB put his foot on the fence and the manager said "your foots on our fence that's our property" . You get well trained in the police to be that petty.
      Also said you are threatening and intimidating. They have to try and escalate it.
      These guys are an embarrassment.

    You need to bill them AB. And you are free to set whatever price you feel is reasonable at the top end of the market rate. They have already used it without permission so simply taking it down will not suffice. They need to pay you.

    I would have thought that after publicising a document for the world to see, about how to be aware of and how to handle auditors, they would have been prepared for a visit and not sent two childish, stupid clowns out to deal with you. They're right about auditors being a problem but only for the companies/people that keep breaking the law and abusing peoples rights, like they did with two pictures.

    I TUPE’d into them a few years ago, spent 5 years there on the Technical Facilities side I then was cast adrift when the contract ended. They had a terrible reputation within their staff, I had a non working supervisor in charge of 2 of us. We couldn’t get help on the contract to do any work, there’s no money in the contract we were told, but enough money to employ someone to lord it over us. When we fell at behind with breakdowns and service works they got another supervisor to try to gee us along, we were managed to death by useless ex-engineers promoted out of harms way.
    When I was there, they carried out an internal questionnaire about the staff perception of Mitie and had a big shock. They were slagged off over and over from engineers who hated being there. They were listed in the top ten worst companies in the UK, it was in a national newspaper ( the Sun I think ).
    This knob is typical of their petty ways, this is our land, our buildings, get your foot off our fence etc. When you point out they’ve “stolen” your image they couldn’t give a shit about “your” ownership of your property, it only works one way with them, “can you prove it” the cheeky bastard.

      Fair use also requires that the user acknowledge the source or comment on the reason for the image or footage used.
      While producing an article about Roman roads in Britain I used a copyrighted image of a Roman road, listed the source, and commented on the nature of the road.
      What comment did the "training" article make about either of the "auditors" or the way they carry out their "audits"? What lessons do the "trainers" draw from the images used, or are they using the images as part of a glossy brochure advertising their "training courses"?

    16:58 For a security guy who seems to have heard about s33, he gets it totally wrong. s33 doesn't apply anywhere as it only applies to groups in a uniform. It's pure gaslighting by auditors. He thinks it only applies to supermarkets etc. That means he's had crap legal advice. What an embarrassment for a security company.

      S33 is a description of public places for the wearing of paramilitary uniforms, you’re right about that bit. BUT it is STILL a description of a public place. It’s probably our only such description in law.

      @@MrAndrewFarrow Public place appears with its definition in a number of pieces of legislation, such as section 1(4) of the Prevention of Crime Act 1953. Enough that it's a common legal term. There is also case law that further defines it, Knox v Anderton where a corridor in a block of flats was defined as a public place as it was used regularly as a short cut and that meant a person arrested there with a knife got found guilty.

      Exactly. I'm surprised AB keeps quoting that Act given that it's nothing to do with public access. It just amended earlier legislation to make it an offense to wear political uniforms on privately owned land that is accessible to the public as well as publicly owned land.

    I have a mate who does a lot of sub contracting work supplying security guards for Mitie Security and they are a nightmare to get money out off. Just about put him out the game a few times.

    LOL their "Rise of Auditors" document ends by saying auditing is a legal activity and the focus should be to de escalate and disengage with them. the "head of security" of Mitie the people who published your copyrighted material ESCALATED and engaged with you by approaching you when you were not even on their property and without even checking with his own reception started telling you what to do and started making an issue of you calling to them to tell them about their breaking of the copyright law. then having offered to assist he moved to the "nothing to do with me" mode.

      Total bolx.. A.B was at a totally separate division of the company. I thought the dude with the tie was fairly helpful. He told him where to contact to have his issue looked at by those who construct the website and look after its legalities. I think A.B kept mishearing him... Not the best here from A.B.

      @@robotsonmars1989 people are free to walk into any publically accessible office. AB did that. He was asked to return. BEFORE he returned hevwas approached by someone who did not identify. That person gave him a makey uppy line about him trespassing but never trespassed him. He said the property was private and AB had been on it. It was explained that AB had indeed been on it and had been asked to return there. The hearsay about the person who ASKED HIM TO RETURN being frightned of him was just that... Hearsay. The man who later identified as "head of security" then offered to help. This was a copyright issue and nothing to do with him but he persisted. He was then shown tbe copyright issue oddly in a publication on security about which the head of security was ignorant! He then confirmed what he was already told... It was nothing to do with him and in spite of offering to help he fobbed it off. He could easily call head office and state they have a copyright complaint but all he really wanted to do it seems was get rid of someone from his workplace.

He's the head of security of a totally different division and told A.B where to direct his enquiry to get onto the correct course if he wants to pursue a copyright claim. Absolutely no point in adding another layer to it.. As far as the woman being distressed I'm guessing she contacted security after getting A.B out of the building. If she did feel that way the inviite back was just a rouse to get him out. He was never getting back in my opinion.

      @@johnnybird7593 Lol I don't work for Mitie but I do have many Years in the services and 30+ years in Security in various positions. Yes I do see a lot of poor interactions on these types of videos but in all honesty this one was ok. If they did indeed want AB out of the building they got him out of there quite easily and with little hassle. They still gave him all the info he required to pursue his copyright grievance via the appropriate avenue.. That particular site had no input or influence on the construction of Mities website. AB may have had a valid argument but he was having it with the wrong people.

    digital photos have meta data you can see in the "properties" tab when you mouse over, it will have the date it was taken, any modifications and it might even have your name if you do batches of photos, but if YOU took that photo YOU have copyright regardless, it would be incredibly difficult to fake the meta data on a photo - especially on your own computer and especially on a phone.
    you have an appointment though...

    What a terrible look for a company purporting to know how to deal with auditors. I don't believe the receptionist was upset by you, I think he got his knickers in a knot because the notorious AB came in, made an inquiry, sat calmly waiting for a response and then left and he missed it all and was now playing catch up. He probably realised too late that you had been there, came out and questioned the receptionist and made her feel like she had made a mistake. He really came across as someone thinking he had screwed up and needed to get back in front of things. He did not want to have to tell his boss Auditing Britain paid them a visit and no one, including the head of security, noticed. From now on his title will be the dickhead of security.

      @@AuditingBritain , Ian Carter stated at least twice that he was the head of security, and yet i did not see him actually prove that by lifting up his identity card which appeared to be attached to his belt. I could see the wheels turning and the smile disappear from his face when he suddenly realised that the video could end up being shown in a civil hearing to determine intellectual property or misuse of the photographs.

    That was hilarious. The "Head of Security" came up with more stories than the brothers Grimm! You legitimately have a good claim on their using your copyrighted material. I'd certainly chance it or, at least, talk to a legal expert about it. It would be hilarious to read about you getting compensation from them for using your picture in their anti-auditing training!

    Photographs are protected under the law of Copyright as it has been included as an artistic work. ... Ordinarily, the author is the first owner of the copyright in a work created by him. In case of a photograph, the photographer will be the first owner unless there is an agreement to the contrary
    Photographs are protected by copyright just like any other piece of creative work, and is protected in UK law by the Copyright, Designs and Patents Act 1988 and some EU directives that came into force in 1989, and under these acts they come under the classification 'Artistic Work'

      Like many things, they are exceptions. Fair use being one of them. The use of copywritten images in things like training and education can easily fall within fair use. If the image is used for illustrative purposes and not for commercial gain, it might come under fair use. They should have at least credited the image though.
