You can have up to a .08 alcohol limit in your system driving legally. So at the end of the day no one is saying it's the smartest choice, but it's only that many make throughout their life. Doesn't make anyone irresponsible or bad. It can end bad, sure. But so can many other things. People freak out over it when nothing happened. But yet when a person abuses someone and assaults them actually causing injury no one is in uproar that they don't give that person jail time or probation or throw the book at them. The system needs to focus on the real criminals not the everyday people that make a not so smart choice here and there that didn't bother anyone. If it ends up hurting someone we'll then that is different.
