Thomas Jefferson said that it is not just the right of the people to keep and bare arms, but our duty. Our founding fathers warned us of the day that we would have to fight to keep our freedom. Tyrannical politicians will alway be trying to have total control over us. So fight on.

    The Police are routinely using the term "surrender" and then insisting upon threat of arrest that they invade your home and search for weapons and ammunition. This is to avoid the process of obtaining a Firearms Act Warrant at Magistrates Court and they are therefore routinely acting unlawfully and depending uponm the costs to prevent any court action against them. If they do not feel safe enough to request a legitimate surrender and allow you to fetch them and hand them over, then a warrant is the appropriate route where a magistrate can test their reasoning in advance. The Police have completely forgotten who they serve.

    I threatened legal action against D&C police firearms for a similar thing in 2018/19 and got £1,100 compensation as an out of court settlement, I did it myself without solicitors etc. Just a lot of emails and a promise this wasn't going away.... Michelle Moore was a waste of space then, I'm surprised she still has a job!!

      So how do you stop them taking your guns ?
      They come to your door Armed and aggressive.
      How are you going to react, if you refuse to cooperate they will use your refusal to consolidate their position.
      I think you are in a very scary place and they know it, they are trained to intimidate the public.
      BASC, is an organisation that purport to be supportive of it's members, I suppose they are, if you've got land and financial clout.

      @@LisaAnn777 I totally agree... I'm from UK and what we (lawful gun owners) have to put up with of late! can't go out and shoot pigeons after the beating season now. Four weeks we used to get. The plod have gone crazy. The UK have a very very small amount of gun crime, however, knifes are apparently everywhere killing everyone every day, I know..., lets ban all knives including kitchen knives!

      When BASC dropped the legal insurance ,shooters who did not look elsewhere for cover like gunplan now have there arses hanging in the breeze when things like this happen.its about £40 a year .total no brainer.

      @@julieannecharters6132 this is true although there is not an insurance company that would take this case in meaning you have wasted your £40. Insurance companies access each case before agreeing to challenge in court you have to have a higher than 51% chance of winning. Being aggressive in public on 2 occasions means your chances are literally 0 hence the advice that he received.

      This is my experience too.
      The police around here have never caught the men involved in three separate gang raped of young girls...
      But they've arrested people for posting memes or shouting out of their cars in road rage incidents.

      In the case of the New Zealand Police, you are correct. They never followed their own rules for issuing licenses. The mosque gunman got a license (when he shouldn't - had the Police complied with their own statutory obligations) and now they punish legitimate firearm users.

    BASC seem to be a waste of space in not supporting their members. These gentlemen have a right to make a FOI (freedom of information request) about the seizure of their firearms and therefore find out about the crime/incident number connected with the seizure. They can also check if correct procedure has been followed etc. Nick Corbett has made some pertinent points below.

      Red flag laws are doing the same thing here. We have states that have less freedoms than others but it just goes to show that freedoms will eventually die if they are not defended. Gun dealers have had their bank accounts frozen as a form of gun control by banks and financial institutions to force people to out. Our freedoms are constantly under attack by our own government and even the private sectors. Amazing how people are ready to sell out their own freedom for a pretense of security. Austin Tx is now democrat controlled and is starting to look like CA. Facts are democrats always flee what they vote in and ruin it everywhere else as they escape the disasters they create. There's no way to stop them moving in and wrecking TX the same CA, NY, Chicago, Detroit or anywhere else they overrun. They are like a plague of locusts that destroy everything in the area and move on.

    Fieldsports Britain should be bringing this to the attention of the general public. If Devon and Cornwall were targeting people solely on the basis that they were gypsies, or black this behaviour would be stamped out. Shooting is part of our culture "they wiped out one third of my life". They should not be able to do this on a whim with no proper investigation and should have no more than a week to put the issue before an independant adjudicator following confiscation and not be allowed to stonewall the licence holder. Surrendering a licence should only be regarded as the shooter approaching the police and anything else as a confiscation. Any allegation of wrongdoing by a licence holder should immdeiately involve an interview prior to confiscation and guns should automatically be placed with an RFD not the police unless they are forensic evidence.

Большинство знакомых и коллег из тех кто знает не понимает зачем я занимаюсь стрельбой. А меня это успокаивает и расслабляет. На стенде я сосредоточен и это отвлекает меня от стрессов в городе и на работе. Это удовольствие. Люди не имеющие оружия не понимают что стрелки это абсолютно законопослушные, думающие и очень ответственные люди. Это же очевидно. Но для большинства, человек с оружием кажется странным... А ведь это всего лишь инструмент для души) как скрипка или гитара.

    Police fabricating evidence is very common I had this experience in Adelaide about 25 years ago where in court a cop put forward signed statements supposedly by me which I had never made and when I challenged it in court the magistrate was disgusted by the cops action.

    Post Hungerford, 1987 both mine and my families f,a,c’s were revoked, and not a penny of compensation paid out for our guns. There are times I wish I lived in the u.s.a. God bless America, long live the republic.

    As a relative newcomer to the sport, this is quite a worrying story. Why are the official organisations not providing legal assistance in cases such as this, perhaps they are trying to make this a "rich mans" sport only. The official bodies need to get their finger out and offer shooters some legal support.

      @@johntozer8270 I'm in a wildfowling club and BASC are currently working hard at national level to protect our marsh shooting consents, spending many thousands of pounds in the process, our members are Joe Public. Without BASC fighting our corner we would be lost. They also helped me & my nephew when applying for a certificate otherwise the police would have ignored us. BASC also helped my shooting buddy with a renewal issue. Without BASC, shooting sports would be on a slippery slope to being banned. Now if you want the chance to win a Best English Shotgun the tickets won't be a quid each like at our club meetings where I won a box of cartridges last month...

    The same happened to someone that I know. They had had guns since 17 years old and at the time was 68.
    Police said he had allowed a person un licenced to take and use his firearms without him present.
    No evidence of any offence and was proven by witnesses that what they were accusing was false.
    4 years later police still won't return the weapons. The whole thing is costing thousands. Luckily there a member of basc and there costs are covered by them. And it's never been taken to court by the police because they know there's no case to answer.

      There really should be some sort of legal and enforced check on police for things like this. Like a forced case or something. Where i live the police are pretty decent country folk, but i know there are places where even whole departments can be bad. Police are humans, and humans can get full of themselves especially when they have power.

    Surely if there is an allegation there must be a crime number? This must then be investigated properly. Once the police can see you've done nothing wrong they should give your guns back. Or you'd like to think.

      As an ex police officer; there will definitely be a crime/incident reference number. Furthermore the two gentlemen are entitled to some sort of disclosure of the allegations being made against them. Unless the police who attempt to seize your firearms have a letter revoking your certificate, they have no power to enter or seize your property. Very worrying that the documentation they have been given by the police is proportioning to suggest that the firearms were surrendered when quite clearly they were seized. Sending 4 armed officers to seize firearms it completely disproportionate.

      This is a consistent ploy used in NZ. All it takes is an anonymous accusation and the police can use the mental health act to take good peoples guns. No evidence needed.

      Sorry to report, I am an organisation junkie. I'm a member of CA and GWCT since the 1980s, BASC since the 1990s, and more recently SCI and Angling Trust. I am not interested in what they can do, personally, for me - apparently, some of them offer insurance - and I wish they'd all stop sending me their tedious magazines - but I am keen to support them for what they do lobbying government. / Charlie

    Apparently you have to put those Apple trackers on your guns and equipment and wear a go pro from the second you take them out of the safe and to the range and back home recording every second otherwise the police will fabricate any evidence or alleged scenario to seize your firearms.

    I hope everyone realizes here, that if we let this happen it will be all of us next given time and not just Devon and Cornwall!! And unfortunately I feel this is the first domino and the beginning of the end of shooting and private gun ownership in the UK.

    I have not seen any enquiry into the pathetic way in which the Devon and Cornwall Police dealt with a person who was a know mental case. We still have not seen anyone in the police lose their jobs as a result of all those deaths. These chaps are being penalised..

    Typical of modern Britain. Honest, law-abiding gun owners who follow the rules are penalized....criminals do what they please with impunity.
    But there are also a lot of people out there who just don't like guns, who don't believe that anyone should be allowed to own them in the UK, and are prepared to make spurious complaints knowing that the police will act in this way.

    Reason i voluntarily gave up my FAC & Shotgun certificate 30 years ago, it broke my heart but i could see this BS coming. Coppers then had started wearing short sleeved shirts & flashing off their tattoo's, especially if they were only 5ft 7inches tall. Could see it going to rat shit & wanted to be as far away from "The Filth" as possible!. If plod had of ever turned up at my gaff with H&K MP5s to take away my legally licenced & held guns they wouldn't be getting in. Who do they think they are?, i know who they are, 99% the likes of Wayne Couzens. Look at serious crime going up + plod reclassifying crimes so it looks like they are doing a job!. Then the plod who turns up on your door is getting paid Tax payers money to "Bully" because that is what they are as well as parasites taking public money for doing FA. Then retired at 50 years old on a GOOD pension again paid for by the public. I despise the maggots!!

      Hello. You wouldn't believe how much this comment means to me. I was recently falsely arrested and sexually abused by 4 pigs. I've no criminal record to be clear.
      I can't stand them. They don't protect us, quite the opposite - the law essentially prevents us from defending ourselves and of course the police only show up after a crime, once the damage is done.
      I've also noticed that short and female cops are the most insufferable.

      Indeed....the last bullshite visit by police out of their jurisdiction to serve a search warrant on a Canadian gunsmith resulted in the 70 year old gunsmith (also the gunsmith used by Ontario Provincial Police) being gunned down, killed by an overeager cop. Latest news is that the cops cleared themselves of wrongdoing....

    They asked me to have a routine medical just before the lockdowns. The GPs closed down for around 8 months. A few weeks in, D&C revoked my licences for not having the medical! My only route was to go to crown court which I couldnt afford

      Great advice from someone who doesn't know the law Gary. The police don't always need a warrant. Check out Sec 18(1), 18(5) and 32 PACE plus some common law powers, all of which give Police a power of entry without a warrant. But we digress.........

However, they can enter without a warrant: when in close pursuit of someone the police believe has committed, or attempted to commit, a serious crime, or. to sort out a disturbance, or.

      yep. lock your downstairs doors. call your solicitor before you address them from an upstairs window. when you do address them - make sure it is only what your solicitor has told you to make known to everyone in earshot if anything.

    Do BASC not have a fighting fund to appeal these cases? Unless these alleged heavy handed tactics are proven to be at fault the Police will continue to persecute members of the shooting community with impunity. It is time the BASC stepped up to the plate to defend it's members, if that puts a cost on the membership fees it will still be cheaper than taking action themselves or having to submit to wrongful Police action.

    What financial recompense do you get from the police for the guns they have taken? Most people have guns worth a lot of money, thousands, surely this is theft unless you are refunded the full market value of the weapons and all associated equipment.

    Lawful citizens are always the first to pay the price for criminal's activities. These egregious laws do nothing to stop criminal activity; a determined criminal will always find a way to inflict violence onto someone. Take the guns away, they go for knifes, cars, axes, hatchets, baseball bats, scissors, and eventually cast-iron frying pans... when does the insanity of confiscations stop?

    101 number is an absolute joke I’ve phoned this number on various times to the point I’ve hung up because no one answers it. Totally pointless number. Gone are the days when we had a village Bobby who knew everyone on his beat and any problems you had you always knew he could be relied on. You phone up now and by the time they find your address or where the problem is it takes them so long the person or persons committing the crime have long gone as the call centre staff haven’t a clue of the area that they are covering.

    By being on your property without a warrant or your permission the police were committing armed trespass, the police new this and phoneyed up the accusations against the chap in order to cover their backsides. Should anyone else find themselves in a similar situation my advice would be to not open your door but to talk to the police from an upstairs window empty hands clearly on display, inform them they are being filmed and are appearing live on facebook that should cool their heels, ask to see their warrant to search your address if they have non ask politely for their names and numbers inform them that you will be on the phone to the chief constable in the morning to ask why they are committing armed trespass and then politely ask them to leave. remember that if they have a warrant any misspelling or incorrect address invalidates the warrant and you can refuse them entry.

    First of all. Do not allow them entry to take your guns. If they had a warrant then they can take them. He can get the body cam video. He needs to apply for it with a Subject Access Request from the force. You can sue them in county court for no money. Represent yourself. At the very least you can get compensation for the guns. The presenter is WRONG they do not go to “crown court”. They go to county court.

      I don't own a gun and would not want one - If I lived in a country where i felt unsafe in not having one, I'd emigrate. Not for everyone I know and its not just about protection - In the UK we are not allowed to have them for protection, really only for some sado's that get a kick out of killing stuff mostly. A few for pest control (but thats the justification for most of even those - they of course are sado's too). Target and Clay shooting is fine I think, but I suspect the right to bear arms is not concerned with such trivialities....

      ​@@markdowns9607 its more complicated than just generalizing it to America. It's the democrat run cities that have strict gun control or straight bans that are full of crime. If you removed those cities from the equation you would see an insane decrease in crime in America.
      A lot of people miss the logic that criminals are less likely to rob someone who can defend themselves with a gun. It's common sense really. Now you have a place like Philadelphia where its almost impossible to legally carry or own, and it becomes a field day for criminals making the cities crime spike.

    The people in the UK are really clueless. People will complain about this, that or some other injustice where they have complained to no effect. You say to them "have you taken this to your MP"? and the answer is inevitably no. You then ask them what their MP is being paid for - go see him/her. Usually they don't, they prefer just to complain to anyone who will listen and so they get what they deserve. In this case in the video the cops tricked them into surrendering their property and so they created a grey area. It the cops had confiscated the guns they would have to have shown good reason, if they couldn't then they would have been acting unlawfully. The Charter of Paris 1990 (the UK is Party to this) says that everone has the right to know and act on their rights - so the cops should have explained their rights to them but thy didn't so the cops are in breach of quite a few human rights agreements. The "rule of law" is a sick joke in the UK.

    Police need to be held accountable including fines for individual officers. In this particular case examples would be giving false information, with holding evidence and impedeing information. I would suggest a video on how to deal with such cases, such as keeping a diary of who you spoke to when and where plus and recording of all interactions.

    I lived in Devon near Exeter I have no trust in the police force there ive even worked in Cullompton police station and seen what goes on ...this is a miss carriage of justice I hope these and many others get there fire arms back

    After me refusal (after a grant) I didn't know whether it was worthwhile risking the money, but my wife reminded me I always teach our kids how important justice is, standing up to bullies, and tackling unfairness, so... I have the first appeal hearing this Thursday
