      The convicted decided their fate once they carried out the crime. As harsh as it sounds, you have to treat jury duty like a business with no emotion or hesitation involved.

      Jack R Jury’s are pre vetted to make sure no one who has a personal connection to the sort of crime being considered is a part of the jury as their past experiences can sway their vote, not saying I disagree with her

      DC 10o01 I get what you’re saying. They should’ve then clarified that he is schizophrenic but it is unknown at the time of the crime whether or not he was experiencing an episode or was lucid. For example, someone harming or killing another person because they are hallucinating and in a delusional state that the other person is trying to harm them needs to be treated differently than someone harming or killing another person because the perpetrator just wanted to cause harm to an innocent person. Unfortunately, they did not know and there were no witnesses that I remember. Just saying he was schizophrenic likely lead some of the jury members to think he was having an episode during the crime even though there was a chance he could’ve been lucid. Then you have other jurors likely forgetting that the hallucinations and delusions schizophrenia can cause can be so severe that the person has no clue what is real and not real. We’ll never know though because based on what you said, we can’t really ask dead people. Even if we could, there is no guarantee the victim will know whether or not the person who killed them did it because they were going through an episode.

    This is an interesting concept, but I would love to see an episode where you conduct a mock trial, so the "jury" can decide on guilt or innocence based on available evidence rather than whether or not to give someone the death penalty. Many people already have their minds made up regarding the death penalty, so it's not as interesting (i.e., the dialogue isn't as rich).

      Interesting concept, but perhaps to truly make a verdict in a trial situation would require A LOT of evidence and time spent explaining. It would become a bigger time commitment.

    "I want this person to get the help they need" That's why mental health services should be offered to people BEFORE it gets so out of hand that someone who is schizophrenic murders 2 strangers. I'm sure most people can agree on that.... :(

      I can give you an example. Let's say a certain Thomas is a soldier and on his first assignment in a war zone he is obliged to transport medical care to another allied base safely. Unfortunately, their car is being ambushed by enemies. The enemies start shooting to prevent Thomas and his unit from getting to the other base. Now it's sink or swim. So what has Thomas to so?...He takes his rifle and has to shoot the enemy troops in order to get the medical supplies to the other base but more importantly to protect his comrades and his own life in this case. Now, please tell me why Thomas acted with a wrong or bad state of mind at this moment?

      Exotic Cats when you are in the jury selection process, you would actually be asked questions. They might ask if anyone has a friend or family member that was a victim of gun violence. It would almost automatically disqualify you.

      yeah seemed like all young, liberal minorities that oppose the death penalty in general. Wanna make an omelette you've gotta crack some eggs. LIke the dude who killed and ate somebody on the bus in Canada. He's now FREE. 9 years later and with 0 living restrictions. I'm sorry but a guy that kills and eats someone should be put to death. I dont care how crazy he says he was. You should face the consequences. Eye for an eye. You take a life yours gets taken. We should be making a death penalty verdict MUCH more restrictive in terms of appeals. You get 1 appeal, if you lose that's it. A bullet costs 10 cents. Death penalty only costs so much because of the time the verdict is tied up in appeals court for decades. Make sitting in prison no longer an option. You get 1 year to appeal. All appeals go direct to a newly created court dealing specifically with death penalties, with the equivalent legal power of the supreme court in those trials. The court has 4 republicans, 4 democrats and 3 independents. If they rule you die you get a bus back to the jail and 24 hours later you're done. Lower judges in the initial court can only rule for a death penalty in cases where the act is filmed or multiple people of sound mind testify the person did something worthy of a death penalty ex murder/rape or exploitation of a child

    A lot of murderers have mental health issues to some extent or another. Whether it’s suicidal depression, ASPD, schizophrenia or just anger issues.
    What matters is if they understand the result of their actions and that it was a crime

      CeceLew Lou yup some people with schizophrenia genuinely don’t know what their actions will result in and so should (as most systems do) be sent to a mental facility as opposed to prison. However others are in control and killed with knowledge of their actions.
      Realistically it shouldn’t just be “schizophrenics are never guilty” and instead “this schizophrenic wasn’t aware of their actions”

    Critique: Too simplistic, there’s too little context to actually make a veredict or even a proper debate. If you continue down this path, all episodes will be the same, because all debates will end up presenting the same cons and pros.
    I’m enthused to see a 20 min episode where much more context is added into the mix.

      It doesn’t really make sense anyway. They’re being introduced to the situation with complete acceptation that he did commit the crime, and are only choosing a sentence. A jury is there for hearings, and has MUCH more information than two slides.
      So yeah, completely agree.

      Agree! 20 min episode with more "twists", something a bit more in-depth. Even maybe include ex-prisoners so it gives it an even more diverse perspective. Also include people from different ages too. Also maybe something less clear-cut. Cases where people aren't sure the person really killed someone, and evidence is brought up little by little

    You could obviously tell that they only reached a unanimous decision because the few people voting for death sentence just got peer pressured. Everyone wanted to go home and they didn’t want to anger anybody, so a few of them just voted life in the end. I hope that his is not how actual decisions are made in real jury duty.

      I was watching an episode of a crime show called Monk, which obviously isn't real life but still. At first, 19 of the 20 people voted him not guilty, but Monk voted him guilty. Some stuff happened and almost an entire day went by. Everybody kept getting mad at Monk because they all just wanted to get home. Well, while they were deciding his punishment, a second body was found inside a dumpster just outside of the courthouse and it was disposed of by the guy who everyone was trying to vote not guilty just so that they could go home. So...

      This exact situation but a man stands alone and uses Socratic philosophical processes to examine the situation. It's tremendous and I highly recommend it.

    do people not realize that being sentenced to death doesn't mean immediately? they argue that they want them to sit and think about what they've done but they can do that on death row like find another argument if that's the only thing stopping you from switching sides

      Kamisama Senpai once somebody gets sentenced, there’s already people on something named “death row” Commiting an execution takes a while, so if your sentenced it will take a while for you to actually be put on the chair, and sometimes while in jail you just never end up being put to death. That’s why the argument “he needs time to evaluate” works under the death penalty and isn’t a valid argument

    I'd like to mention that individuals with schizophrenia are *extremely unlikely* to hurt others. It's a terrible stigma associated with the illness.

      SkullCrusher117 That’s absolutely correct, but it is still possible. In fact, for some reason it seems that a lot of people who hurt others have no mental illnesses/disabilities. Which is quite strange to me, like why are people with mental illnesses and disorders like myself (Autism) stigmatized when the majority could technically be considered mentally stable?

      I would think that if it were unrecognized and untreated for so long that the chance would increase. But i think it’s dependent on every situation and the degree of the disorder, and what has been done to help treat it.

      @@elijahb.3036 actually the longer it goes untreated there is a higher risk of self harm and suicide rather than hurting others. Not saying that it's impossible, but out of all the mental disorders, schizophrenics have the largest rates of suicide. It may be possible that if an individual had severe paranoid schizophrenia or bipolar type schizoaffective disorder the risk of 'danger to others' may increase. But generally people with schizophrenia are decent folk and should be treated as such. There might be videos on TH-cam of interviews with patients with schizophrenia. We saw some in my lectures. You really feel for those people

    This is how people get sentenced wrong, people in a jury will just say “oh well most people say this, and I don’t wanna oppose so I’ll say what they say even though I don’t agree with it”

      That's not the full picture, it's actually a lot more nuanced than that. A verdict of "life sentence without parole" is a lifetime. And if the verdict does include the possibility of parole, the amount of years in prison before parole depends on the state where you live and can vary between 15 and 40 years for a single "life term".

      Banana Smoothie Death isn’t the easy way out, a study showed that initially someone who has went through a tragic event rated their happiness very low whereas someone who won in excess of a million rated it high, however after a year had passed they both rated their happiness roughly the same. That’s because humans adapt, if you go to prison you’ll get used to it and sure, you might want out but you’ll still enjoy your life whereas if they are sentenced to death they are wiped from the earth and can never commit another atrocity again.

    If this series continued, I would love to see a person represent the people who have been in jail or prison because their story could become very beneficial by changing their perspective of what is life like in prison or jail. I also want a range of other ages in this series.
    In the video, I don't think people realized the reality of jail or prison. When a person is sentenced to jail or prison, there is no fair treatment or doctor to help or represent any people that have a mental illness. There is no luxury in jail or prison. Also when a judge sentences a human that has a mental illness, they have to analyze and see if that human is fit for society.

    There is a murder attempt near my town, a women stabbed her friend, and left more than 50+ scar on her friend's body, she almost died, she was barely breathing when they took her to the hospital, and when they check her mental health, she have schizophrenia, i just don't understand why these people escapes jail sentences, they didn't even put her on prison

    If anyone was wondering about the missing information here, the person used as an example was Kelsey Patterson. This was not his first violent incident and shot another man who did survive prior to this incident. The judge responsible for the decision to give him the death penalty gave his very clear reasoning as the law in place in Texas could not guarantee this man would not be paroled eventually so for the safety of the community death was the only other option. This is an interesting premise for a video series, but please include all the relevant information available. Otherwise it definitely skews opinions. I don't believe that was the intent, given what seems like the channel's history of fair treatment but regardless these things should be included to get a better scope of the story.

    For the one woman who said her mother was murdered in front of her and that the murderers escaped prison, that should be a perfect reason to support the death penalty. Prisons are not perfect and although it's very uncommon, people have escaped and murdered people after their escape.
    (Edit) I am also only in support of execution if the evidence against that person is 100% irrefutable.

Not all evidence has to be presented at trial, and juries often have a hard time understanding the limitations and reliability of some forms of evidence (e.g., eyewitness or expert evidence) and can't think critically enough about it. This is the issue of having a lay jury instead of an expert jury - people might not have the necessary info/knowledge they need to correctly evaluate evidence

      - Women killing their abusive husband in a pre-meditated way.
      - Retribution killing of someone who recently murdered their family member.
      - Killing a monarch/president in order to inherit power.
      All of those can be done calmly and deliberately, and people often say years later they wouldn't change what they did.
      Compare that to someone who is having a psychotic episode and honestly thinks that aliens are trying to destroy the Earth and they are "saving" us by killing the "alien".
      Obviously there is a huge difference between someone being in their right mind and not.

    I don’t like how they say “ oh the death penalty is more humane” or “the death penalty is much quicker and easier”. The death penalty costs more than a life sentence. Also it’s not that much quicker there are people that have been on death row for over 40 years. This is so unrealistic because they were all about the emotions and not the facts but they didn’t even have the facts. I think this series could be really cool the just have to improve it a lot.

      Jordan Onofiol that is the minimum, like the US, there is a minimum in the UK too. Here, it’s 25, but I assure you, that it is 25-life for life sentence punishment and probably 20-life in the UK. Not that the highest you can get up to is 20.

      Some actions are so inhumane that once a person commits them they forfeit their right to life. It doesn't matter if he had a mental illness or not, he killed two innocent people for no reason and if he was kept alive in the prison system he would only be a life long threat to other prisoners.

      It cost allot to maintain those facility's and feed convicted murders along with all the other less dangerous offenders, and prisons here in America are very well known for their repeat offense rate (due to quite a few different factors) it's much simpler and cheaper just to remove murderers from the population, we should just do it how China does not that I particular agree with most of the shady stuff their country does but they do simple and cheap bullet point blank to the back of the head humane, quick and cheap can even reuse the bullet casing if you so desire we have to many people and to few resources to bother with feeding murderers

      Gavin Guzman It is actually more expensive for the state to execute someone than it does to keep someone in prison the rest of their life. This is because of the many levels of expensive litigation and review that has to be done before carrying out a death sentence.

    I’m honestly surprised how many people were so pro death penalty in the comments. I mean, I’m a bit mixed myself, like I’m in kind of a grey area, but with this case I genuinely would have said life sentence. It’s like what melody was saying about her mother being murdered, finding who the killers were had nothing to do with any sort of closure, she was able to move on and find that closure without those people getting killed in return, hell, they weren’t even caught. Is it still fucked up? Yes. But can people find that closure without wanting them dead as this sort of vengeance? Yes, that’s why a jury makes the decision and not that family bc they’re very emotional and can’t look at it in a remotely objective stance (which is already hard to do in the first place bc you’re choosing that fate of someone’s life).
    I would also like to make a point about the schizophrenia thing. When they were saying “but not in the right mindset “ yes, it’s obvious that no matter what no one is in their right mind when killing someone. But I think what they mean is prior to the murders. Was he already having a schizophrenic episode? Was he able to control/try to suppress himself? How bad was the episode if he was having one? I’m not saying that mental illness is an automatic pass for murder (I had a friend who was schizophrenic and he was lovely. But again he took medication and was very good at trying to suppress hallucinations by trying to ignore them), not everyone can do that. Mental illnesses are a very tricky thing and unless you have the condition or studied it for years you’ll never really understand their mindset at the time of or prior to it. It could’ve been voices in his head telling him to, making him overly paranoid and out of his ‘right mind’. Or it could’ve not. We’ll never know. But the reason some eventually converted is because they liked the sound of “if there is a *chance* for rehabilitation” the fact that there might be a way to get him the resources he needs to be more well rounded, although he’s likely have to be put under surveillance 24/7.
    Idk, that’s my personal opinion, you can think whatever you want I’m personally kinda gray on the area myself. I just wanted to give reasonings as to why the life sentence may seem fairly reasonable to others, as someone who’s met plenty of people struggling with mental health issues. Have a nice day :)

      Someone being a criminal doesn’t make their life less worthy than anyone else’s, idk death penalty is just so 1800ish to me

    I don’t believe in the death penalty. Whether someone has an “excuse” or not. I just think that’s taking the easy way out. So, I don’t think this particular thought experience would work on me. I think it would be a more interesting concept to present the facts as they would have in the trial and then choose whether you would convict them or deem them innocent.

    I'm not trying to be that person, but it's crazy how little people know about mental health. The idea of sentencing someone with schizophrenia to death or life in prison is so wrong. I worked with someone who had it, he was so lovely and friendly when he was baseline, but when he was off baseline it was scary, but he literally couldn't help it. He would always apologized after, and it was so sad that he just didn't have control over himself at times. Death or punishment are should absolutely not be an option. Rehabilitation and care is what is needed.

      Nobody is killing him for his schizophrenia, it's the combination of that and his violent actions. I wouldn't want a loose cannon like that walk free in my ciuntry. And how can I pity this man when he knows himself how dangerous he is yet owns a gun?

      @@amarmesic7170 I understand that people feel afraid but killing someone for possible further crimes shouldn't be an option. if given the right help and medication, many people with schizophrenia can be rehabilitated. Furthermore, once released, they live in supported housing, which means they have a case worker on site. It is up to us as a society to ensure this. If a state or country cannot ensure this then that is something that should be pursued. I'm strongly opposed to the death penalty anyway (I use to be pro), but killing someone with a mental health condition is a mark of lack of understanding and failure of a society. And, yes your right, how does someone like this get there hands on a gun? That is the bigger question that should be addressed, and it does not get solved by killing someone with schizophrenia.

    3:36 Melody is right tho, the facilities for convicts awaiting the death penalty are so much nicer than prisons, and you could live the rest of your life at that prison much more comfortably than the standard state prison

    As a woman who struggles with anxiety and depression, I believe you should be held responsible for your actions. A person committing murder should be held, this person had multiple opportunities to get help but chose not to. Mental illness is NOT an excuse to get away with crime. You commit the crime, you do the time.

      @Salsa Bila I never said anything about the person being released, I was saying a person with mental illness should be held accountable and not just run as an excuse, "Oh he/she was mentally insane, let's just put them in an mental hospital." If you actually look at the different crimes, most criminals with mental illness try to plead as they were mentally insane and had no idea what they were doing to try to avoid a lighter sentence and just sent to a mental hospital and then probation.
