    3:52 I would add to this that using the "mildest deterrent possible" doesn't mean you have to take additional risk. If in you're in a situation where you have the choice between pepper spray and a milder but also less effective option you'd still be justified in using pepper spray. You don't have to put yourself at risk by using a milder deterrent. However: In the case of pepper spray it's usually not gonna be too problematic because there really aren't too many milder deterrents that have the same effectiveness.
    Also worth mentioning: If you chose the pepper spray even though there was a milder and equally as effective deterrent there's still section 33 of the criminal code under which you will not be held responsible for what you did if it happened out of fear or confusion.

      The "mildest deterrent possible" can also mean that you can use an Apache attack helicopter if it is the only thing available at that moment. However, you still end up in prison because you have an Apache attack helicopter.... wich is illegal for some stupid reason.
      Joking aside: No one can ask you to defend yourself with your bare hands. Especially when the attacker is bigger and stronger.
      Everything that is not classified as a weapon (umbrellas, tools, household items such as glass bottles) is very suitable for self-defence... from a legal point of view.
      In court you can argue: "It was the only thing within reach."
      With legal weapons (knives, pepper spray, etc.) it is more difficult to prove proportionality. But if the attacker has a knife or something, that's not a problem either. And here, too, you can argue: "It was the only thing within reach."
      (Pepper spray in the glove compartment or handbag, for example)
      With illegal weapons or illegally carried weapons, it can be perfectly legal to defend yourself with them. Provided it is proportionate (this would be the case, for example, if the attacker has a firearm).
      It is therefore possible that you can get out of the matter without being punished. BUT you will receive a different penalty for illegal possession of a weapon.
      So only recommended in an absolute emergency (life or death situation). Well actually, I don't recommend it!
      In the end, all I can say is: defend yourselves! After all, you are not the attackers, but the victims.
      With a little common sense, you should be able to recognise which means are "proportionate".

      @@espneindanke9172 The helicopter itself should be perfectly legal, it's the guns and missiles that usually come with it that aren't. OTOH if you can swing an Apache you can probably also tear your attacker apart with bare hands so you don't really need it.

      @@espneindanke9172 Yes, very true. That can especially be seen in the famous "Hell's-Angels" case (BGH NStZ 2012, 272).
      However, I still have to make a tiny correction:
      Dogmatically speaking the proportionality (as in "Verhältnismäßigkeit") isn't relevant in German self-defense law. Only the suitability ("Geeignetheit") and the necessity ("Erforderlichkeit") are relevant.
      Only the criterion of necessity (but this time meaning "Gebotenheit", not "Erforderlichkeit") indirectly includes proportionality, but only in cases of blatant and extreme disproportionality.

      Yes, I'll go along with that.
      But in the end, every situation has to be analysed individually.
      In everyday language, you can say: *"You don't kick people who are already lying on the ground."*
      It's not really much more complicated than that.

      @@espneindanke9172 Right, though what many often do not consider is just walking / running away. Unless the threat is following you, this usually gets you out of danger. However some tough guys see this as "coward behaviour". Anyways, in an emergency almost everything is allowed, especially when your or someone else's life is in immediate danger. The same is true for the usage of otherwise illegal equipment. My dad used to sail on the ocean and he bought an illegal military radio, just in case. He never used it, but when you're alone on a boat and you have a life threatening situation you are allowed to use any tool available to call for help.

    It should be added that some cities, like Frankfurt am Main, have areas that forbid carrying knives with a blade length of more than 4 cm, as well as CS/CN gas during the evening and night (during the hours of 20:00 to 5:00 in Frankfurt‘s Bahnhofsviertel). These zones are marked with signs, usually „Waffenverbotszone“ plus some pictograms. Some of those cities (like Frankfurt) do allow pepper spray to be carried even in those zones and during the times stated on the signs, with the justification that it is often used as a defensive weapon by women.

    • @sk.43821

      Correction on the last part of the translation.
      "Woraus" bezeichnet eher _aus etwas heraus kommen,_ z.B. einem Gefäß oder einem umfriedeten Gelände (Grundstück, Stadt).
      Woraus kam der Geist? Aus der Flasche oder Öllampe. (Engl.: Genie)
      Also das Fragewort _woraus_ wird eher im Zusammenhang mit Gefäßen benutzt, z.B.: Woraus trinkst du?
      "Woraus" wird auch im Sinne "aus was" verwendet, wenn man fragt: Woraus besteht ein Gegenstand/Material? - also die genaue Zusammensetzung betreffend.
      "mich" - ich -> mich; du -> dich; er/sie/es -> sich; wir -> uns; ihr -> euch; sie -> sich; allgemein: man/jemand -> sich
      "Etikette" würde man im Deutschen in diesem Satz wahrscheinlich eher nicht verwenden, da _Etikette_ ziemlich stark formalisiertes Verhalten beschreibt, während der Umgang (das Verhalten) in einem Waffengeschäft eher leger, ungezwungen ist.
      Man würde daher wohl eher formulieren: "Es gibt keine Waffenläden dort, wo ich herkomme/herstamme, deshalb weiß ich nicht, wie man sich in einem (Waffenladen) verhält."
      *Ich hoffe, meine Ausführungen sind einigermaßen verständlich. Ich bin kein Linguist/Germanist.

    Both CS and CN are tear gas. They are by definition a weapon. The two most commonly used tear gases are ω-chloroacetophenone, or CN, and o-chlorobenzylidenemalononitrile, or CS. CN is the principal component of the aerosol agent Mace and is widely used in riot control. It affects chiefly the eyes. CS is a stronger irritant that causes burning sensations in the respiratory tract and involuntary closing of the eyes, but its effects wear off more quickly, after only 5 to 10 minutes of breathing fresh air.

      As for your Bosworth Field cosplayer, I'm sure that if he wasn't breaking any laws by carrying an offensive weapon in public, he'd be allowed to use whatever he had to hand to stop a crime in progress, so long as his response is proportionate. It works better, especially on persons that are under the influence of drugs. And the irritants chloracetophenone (CN or tear gas) and 2-chlorobenzalmalononitrile (CS gas) are both suspected to cause cancer. @@Matt_The_HugenotIf anyone is interested why it's "offensive" its because historically and at Common Law, weapon was defined more broadly and included all arms including armour. An offensive weapon is what we typically call a weapon now and defensive weapons is what we now typically call armour. So whilst there is such a thing as a defensive weapon, it's not that it's used for self defence but that it's used to directly prevent harm (like a stab vest or ballistic shield).

      @@PCDelorian Yes, I do HEMA (Historical European Martial Arts) and we have to be very aware of what we're carrying where and how, blunt practice swords are still weapons and can get us in trouble if seen in public. There are times when I've considered carrying a plastic buckler (small round shield) but then thought better of it, someone might think it was offensive as well as defensive.

    • @PCDelorian
      @PCDelorian 10 หลายเดือนก่อน +1

      @@Matt_The_Hugenot Its a matter of intent, which is ultimately the issue the prosecution always have to prove, if you have with the intent to use it offensively its an offensive weapon, if you do not have that intent then its defensive. This is made more complicated because instaneous arming means that if you use it offensively whilst being attacked so long as it wasn't your intent prior to the attack to use it as a weapon you can still plead self-defence.
      Obviously its hard to say, these are questions of fact for a jury and so no lawyer would be able to say 100% and I am not a fully qualified lawyer at any rate, but generally speaking so long as the intent is to stop someone attacking you by preventing the attack (by having something in the way) as opposed to overpowering them or rendering them unable to attack, its okay. This is not a commonly fought area of the law though and how the courts would respond to any given situation is hard to say.

      Jörg Sprave is such a sad case. Started as a classic youtuber who got successful with creative and fun inventions he made with rubber with wood in his workshop.
      Now all he's doing is positing ads for the weapons his company buys from Chinese contractors that are specifically designed to use grey zones in the German law. And to push his sales, he has no problem to make panic videos in which he tells his viewers that Germany will be without gas in the winter and that they'll need to buy his weapons to fight off looters.

      Regarding man-eating feral animals - zero, as they were thoroughly eradicated more than a century ago. Pretty much zero. At the moment people are panicking about wolves, but they actually avoid humans as much as they can.
      The most dangerous animals you're likely to encounter are wild boar, but they'll leave you alone if you leave them alone. You're not likely to even see one, but if you do just stay calm, don't corner it or try to chase it, and never get between a female and her young.

    I am not a lawyer either, but I think the judges in the Netherlands might be a bit less lenient on self defence. It has to be proportional. A defence like "I could not help myself, I was in panic" is not sufficient as anybody can say he was panicking at the time. The result counts. So if you were in a short incident and unharmed whilst the attacker is in hospital, you will have a tough time.

      @@boghag Maybe he is a computer scientist and treated it like integer rounding. In this case, he is kind of correct because in most programming languages (actually every single one I have ever seen, but some weird people probably wrote one that is different), you usually just throw away the rest when you do integer division, so 5/2=2. If you now "round" to millions by just dividing by 1,000,000, you get: 82,646,321= 82 (million) 1,000,001 = 1 (million) and of course 833,870 = 0 (million)
      Ok, jokes aside, you actually just misunderstood what he wrote. What matters isn't the absolute number of licenses. What was being argued is, that millions of new licenses were obtained in recent years. Let's say "recent" means

    • @blahfasel2000
      @blahfasel2000 10 หลายเดือนก่อน +3

      @@boghag Sure. But the claim was "have obtained in recent years", so you have to subtract those licenses that are already older. At the end of 2017 there were 557,560 licenses on file, so the increase over the past 6 years was onlly about 326,000. And since that number is men and women combined the number for women alone is even smaller.
