WTF is that? Homosexuality and lesbianism are grounds for legal separation and annulment? I can't enter same-sex marriage with a person I love yet if I marry someone of the opposite sex, I'm still vulnerable to legal attacks because of my sexual orientation. As I noticed, the grounds for legal separation and annulment are 1) somehow related to crimes stated in the Revised Penal Code and special laws; and 2) the respondent has reasonable control over voluntary acts related to the grounds. The homosexual act is not even criminalized in the Philippines and the respondent has no control over his/her sexual orientation so why the Family Code is treating LGBT like it's their fault to become like that? The Supreme Court should declare the inclusion of "homosexuality and lesbianism" as grounds for legal separation and annulment as UNCONSTITUTIONAL.

John O after the resolution of the prosecutor, an information will automatically be filed sa court. Now it’s up to the complainant if he is going to have the case dismissed or push through with the case.

I am a battered bf before the marriage and became worst after the marriage so subsequently a battered husband. I've been physically and morally abused by my wife for 15 years. I was never physically and sexually attracted to my wife neither but was forced to marry her coz shes threatening me that she'll ruin my life if I didn't or attempt to escape and not show up during the wedding. In between these years I had someone (3rd party for 5 years) whom i loved and treated like a real wife but it was on LDR. Just recently 2018 I got ill for the whole year and a half partially physical disabled due to depression, I suffered from spinal injury on my neck after being kicked smashed by my wife on my forehead pressing down my head hitting the floor while my neck gets wedged on my pillow when I was asleep. From there it started, I called the police while whining on the phone. I gradually lose my balance and mobility in months I never got any moral support nor received any favor from my wife even in taking me to the hospital for my treatment but drove myself instead even having the excruciating pain. I paid my own hospital bills, wife never visited. The police just ignored me. I consulted to a parish priest and psychologist and got support and encouraged by them in filing an annulment. We have our only child who is still 3yo at present that was conceived thru diy invitro fertilization process. Every time we get into commotion or misunderstanding after that event that leads to harsh verbal exchange of opinions and insult, I can no longer steer the thought of killing my wife. Its now becoming my desire of killing her. If anyone would still insist not to grant the annulment in favor to me and if happened that I subsequently killed my wife intentionally, will I go to jail after my report and filing of case? I am now fascinated in making plans how to murder my wife including those who will attempt to stop me and protect or defend my wicked wife that not any prosecutor or judge could prove it that I did.

May mga grounds po ang legal separation at pwedeng mag-file ng petition yung lalaki or babae within 5 years na mangyari itong mga grounds na ito. Depende po.
Pero sa tono po ng message niyo, baka po annulment po or declaration of nullity ang tinutukoy ninyo. Kahit na sino po, yung babae man or lalaki. Ang inportante po ay walang collusio o yung tipong “pinag-usapan” na maghihiwalay dahil kpag nakita ng korte yun, tiyak hindi aprubado ang petition.

Pwede siya magfile pero hindi ibig sabihin ma-ga-grant ito. In fact, one of the grounds na pwedeng ma dismiss ang petition ay kung both parties have given ground for legal separation.
As to support, it will depend on the need and the capacity of the person supporting.
Para mas maliwanagan, maaari lamang na sumangguni ng personal sa pinakamalapit na abogado. 🙏

Once the respondent and complainant both receive the resolution from the fiscals office that the case of unjust vexation can be elevated to the court, is there a grace period under our legal process given to the complainant to file the case within that duration, if so, what will happen to the case if the complainant fails to file it within that period?
John O after the resolution of the prosecutor, an information will automatically be filed sa court. Now it’s up to the complainant if he is going to have the case dismissed or push through with the case.

I am a battered bf before the marriage and became worst after the marriage so subsequently a battered husband. I've been physically and morally abused by my wife for 15 years. I was never physically and sexually attracted to my wife neither but was forced to marry her coz shes threatening me that she'll ruin my life if I didn't or attempt to escape and not show up during the wedding. In between these years I had someone (3rd party for 5 years) whom i loved and treated like a real wife but it was on LDR. Just recently 2018 I got ill for the whole year and a half partially physical disabled due to depression, I suffered from spinal injury on my neck after being kicked smashed by my wife on my forehead pressing down my head hitting the floor while my neck gets wedged on my pillow when I was asleep. From there it started, I called the police while whining on the phone. I gradually lose my balance and mobility in months I never got any moral support nor received any favor from my wife even in taking me to the hospital for my treatment but drove myself instead even having the excruciating pain. I paid my own hospital bills, wife never visited. The police just ignored me. I consulted to a parish priest and psychologist and got support and encouraged by them in filing an annulment. We have our only child who is still 3yo at present that was conceived thru diy invitro fertilization process. Every time we get into commotion or misunderstanding after that event that leads to harsh verbal exchange of opinions and insult, I can no longer steer the thought of killing my wife. Its now becoming my desire of killing her. If anyone would still insist not to grant the annulment in favor to me and if happened that I subsequently killed my wife intentionally, will I go to jail after my report and filing of case? I am now fascinated in making plans how to murder my wife including those who will attempt to stop me and protect or defend my wicked wife that not any prosecutor or judge could prove it that I did.
