She does have a right to live there it comes under case law from 1973. Her putting money into the place and them not being married or her having her name on the deeds is a legal loophole that's screwed people over for years and is extremely unfair. There was a case in London a few years back, young unmarried couple,she bought a fixer upper with family money. He was q builder, did all the work on it and added tens or hundreds of thousands in value. Then she left him and he got nothing. It's an extremely cruel system for cohabitees.
I was on Fiz's side throughout the Alina storyline which came out of nowhere, but she's having a laugh here, asking Tyrone to sell his house which long predates their relationship, just to help a new boyfriend who has his own mansion.

He broke up their family with his actions, she has found someone else and wants to move on and be happy and at 38 there aren't many good men around! But he should feel a moral obligation cause of his actions even if there isn't a legal one.

Also...it isn't that Phil doesn't want her to move in, if you listened to the conversation he can't afford the repairs on the house, a new roof probably costs a fair bit. He suggested waiting for another house to come along but Fiz saw the house and wants to live there. But they need more money to do so. What I don't understand is why Fiz can't just be put on the mortgage, that way they could borrow more and could use whats remaining from phil's deposit to make the repairs, Tyrone could then move into the house, rent out the flat he owns and use the rental income to gradually pay Fiz back what she put into the house. But obviously the writers wanted to explore this cohabitee situation re the house.
