  • In stark contrast to the medical witnesses heard from the prosecution, Dr. Fowler testified that the cause of George Floyd’s death was everything but Chauvin. But Joy says the entire testimony ‘imploded’ once the prosecution picked apart his findings during cross examination. Fowler conceded multiple points, including that a lack of bruising and other injuries do not prove that Floyd did not die of asphyxia and that the weight of Chauvin's gear was not factored into his calculation of the force applied to Floyd's neck. Aired on 04/14/2021.

Joe Perez, a former internal affairs police captain in Prince George’s County, Maryland, who is not involved in either the Chauvin case or the Black lawsuit, said, in his opinion, Fowler’s role as a defense witness in the Chauvin case constitutes a conflict of interest, given Fowler’s stance as a defendant in an ongoing lawsuit involving an officer-involved death investigation in Maryland.
Perez, a former shift commander on a special investigative response team that conducted criminal misconduct cases involving police-involved shootings, said Fowler was known to work closely with the police.
“It appears to me that they chose Mr. Fowler as an expert witness so that he can co-sign on their version of what they say happened,” Perez told WTOP.
He said in his years of experience in internal affairs, medical examiners and police officers would often become friends over time - and that had the potential to lead to false narratives.
      Other cases
Kenneth Ravenell, the lead counsel for the Black family, mentioned other in-custody death cases Fowler oversaw that he questions, suggesting there is a pattern of controversial rulings.
The Intercept article broke down the cases of four men who died while in police custody in Maryland under Fowler’s watch. None were classified as homicide.
But in the 2015 case of Freddie Gray, the high-profile death of a 25-year-old Black Baltimore man who died after suffering spinal injuries during a police van transport, Fowler did rule that death a homicide.
Fowler retired in 2019 after serving as chief medical examiner for 17 years. Before that he served as deputy chief medical examiner in Maryland from 1998 to 2002 and an assistant medical examiner from 1993 to 1998. He was the president of the National Association of Medical Examiners in 2015 and chairman of the board in 2016.
Fowler now works as a private, independent consultant in forensic pathology and medicine, according to his LinkedIn account

The prosecution is supposed to be proving HOW it happened--specifically, not a bunch of "oh, maybe this--well, maybe that!"
A bunch of morons that don't understand what reasonable doubt means.
The prosecution has bumbled through every day of trial so far. Every one of their witnesses but one have conceded the defense's case in cross-examination.
The fact that they changed their case after the first couple of days shows they've got nothing but their appeal to emotion.

The officer there also laid with his full body weight on a handcuffed 19 year old schizophrenic black child, who he’d put in the prone position. Also the prosecution made him walk back and clarify statements that were misleading yesterday. Earlier today the prosecution called Toobin the pulmonary expert to the stand and he refuted the carbon monoxide statements from David Fowler. He also dimantled the statements of Fowler as to use of force in the prone position not being dangerous. Toobin said that there was literature on the subject that Fowler said didn't exist. Fowler was also exposed yesterday as to a statement he made of an expert he cited as saying the prone position was dangerous and that the expert retracted that statement and believed it to be non threatening, The prosecution read a statement to Mr. Fowler of the expert in his own words stating that people had misinterpreted him So what did i miss? There is no real defense for what happened. They are trying the usual arguments, which usually succeed because of the social bias that cops are somehow more likely to tell the truth, have a hard job, should be excused for overreacting, etc. However in this case "business as usual" may not succeed. The prosecutor is not fooling around, unlike many of these situations. Plus, as many have noted, the fact that the top brass in the police department testified that this was not acceptable behavior on Chauvin's part is practically unheard of. So the Blue Line has failed in this case. We'll see, but the circumstances here are not typical.
