Yeah, always a shame when the ol' scummy "It's just business" type of move is done by someone who generally doesn't seem liable to do such a thing. More than anything, I hope it makes models such as her more prone to getting these promises on paper. Think a lot of people outside of the industry would look at Donald Glover as "one of the good ones" but this just proves that even that type of person is still fully capable of making false promises and playing the paper game with those who are maybe less experienced with being screwed over like this. It's just a shame she didn't learn to get it on paper sooner, from a prior experience, as it's probably not every day you get offers to be a part of one of the most iconic album covers of a generation.
If it';s not on paper then it don't matter what they promised. I'm assuming instead of having a lawyer review the contract before signing, she blindly signed.
Why does she even deserve residual. All she did was show up, the designer/ make up artist/ photographers are the ones who did the work. Not to mention that if her claims of a "promise" were true, there would be a contract....no contract it didn't happen. Plus she agreed to the rate she got paid. She could've easily said no. It's been 8 years and this is just now coming up.....she's clout chasing

Most definitely is. No one’s gonna look out for you better than yourself though. It’s a lesson! So it’s always on the person to make sure they get what they want.
Agree and if I had to speculate, I’d guess she had an option to either take pay on the front end for her work she did at the time of the shoot, OR take less on that day and receive money or residuals on the back end at a later date. She probably didn’t expect him to or the album to blow up like it did, and is regretting taking that front end deal, which I’m assuming she signed in writing…
I'm a photographer and its rare for us to get residuals from an album cover shoot. If you have a massive name, then yea you can demand whatever you want. But most people cant. For her to make it a race thing is kinda disingenuous in my opinion.
Are you American?!?? I’m just asking because if you aren’t that’s the only thing that would make sense because racism is our religion in the USA it literally is a factor in everything in everyday life. Our nation was founded on it
I am an entertainment lawyer. 1) I have never, I repeat never, negotiated or worked on any project where the model got residuals from appearing on a album cover or in any art associated with a project. 2) the model would have received a written agreement (ie something to sign) that outlined exactly the terms and what she was getting paid and if she didn't herself or have someone to review it before signing it, 7 years afterwards is pretty ridiculous. 3) her mentioning race is weak sauce, I'm black and I just rolled my eyes at that one. Race has nothing to do with anything here.
U know minimal about the situation but you know there was no racism? You know nothing about the damn situation but want to assert what is and what is not... foolish imo

I think another important part to mention is how we naively trust our ppl in the business. I've seen Puffy, Jay-Z, and other celebrities bring up doing it for "Black Excellence " yet do their own Black artists dirty. I'm sure Gambino gave a similar "spiel" to those Black professionals. We have to be professional in all arenas regardless of race. Its business 🤷🏾♀️
@@KarbonStar Its all good I just thought it might have been another coloured "pill" I'd have to learn about!😂 That's the only reason I asked..your point is 100% valid.
I've never heard of someone receiving royalty payments for appearing in an album cover. Also the label is the one who deals with the finance side of things for releases, and I can never imagine any label agreeing to something like this.
people will believe anything. people like to be on the victim’s side to be on the right side of history rather than being objective. tbh im sorta neutral on it, id need to see a contract or gambino’s statement with proof to really believe her, but i empathize with her cause the album would’ve been way different without her
@k00_ma The model herself said Glover wasn't at the photo shoot. So whomever she heard it from, it wasn't him. While I agree that covers set a mood, I don't think they ultimately define the album.
I feel for her but if she agreed to the terms she has to hold the L. No one is going to care about you more than yourself so you have to ensure you get what you want out the deal.
Side note feel like we haven’t gotten a proper music release from gambino in a minute. I remember redbone going absolutely crazy just a couple years ago but he’s been quiet recently and it’s a bummer bcus he’s so creative compared to these other artists. Hope this issue with the cover gets rectified and he becomes active again at some point
Last I heard he quit music to work on Atlanta then after Atlanta wrapped he wanted to go back to acting but not as much so he can spend time with his family, he just does w/e he feels like doing at this point
Man i feel this, the higher ups are always making empty promises. This literally happened to me, i was promised i would get my 40 hours when transferred to a different store in my company by the supervisor, but when the gm asked him about this he denied it, so i didn't get my hours and got screwed over...
I doubt she was promised residuals. If an artist pays residuals to literally everyone who's involved in making the cover, there would be no money left over for themself
As a record label owner, we 100% give residuals to models or artists that help create art work especially when the project is expected to do major numbers. Research the lawsuit Michael Jackson faced from the model/lead actress after the Thriller video was released. Many artists, labels provide residual agreements especially if the budget doesn't allow a major upfront payment.
I feel like an actress in a music video is a completely different case compared to a model and makeup artists that worked on a fotoshoot for an album cover lmao.
This video is very informative ngl and I feel like a lot of people in the industry get promised something yet nothing pops up in their head saying “ I need to have something in writing saying I’m getting this amount of money” a lot of people who go into the industry NEED to have this mindset u always gotta have a contract
Yeah agreed. I think artists (of any kind from music to painting) can have a very idealistic expectation of working with other people, which screws them over in the long run. At the end of the day, it is someone’s business and there are only a handful (as in maybe up to 5 people) in your music or artist career that don’t care about money you bring and just enjoy the craft for craft’s sake. Nav is a great example, his features are free, they don’t ask him to pay because they’re friends or whatever. So valuing your craft is also valuing your money because as the old saying goes, time is money.
I believe her contribution to the album is notable, perhaps equal to that of the headpiece designer. There honestly aren't many album covers that I remember as vividly as 'Awaken, My Love.' That being said, I feel the backlash on Glover is undeserved. An artist should be allowed to focus solely on their art without having to go through every single contract of all contributors to ensure everyone is fairly compensated. As far as Gambino is concerned, he possibly didn't even know what her contract looked like. Even if he were to personally check if the label delivered on her promised payment, he might not have been privy to the exact details of the deal, only that they paid her what she signed up for. One possible scenario where she is right for calling him out is if he told her himself that she'd get residuals, which indeed would be scummy to promise if he didn't plan on doing so.
Gambino really creates art and he’s not dropping 20 projects a year to overload this already declining genre with crap music. He should be appreciated and cherished. The album came out in like 2016 or something, why are you speaking after 7 years. It’s a shame if she did not get the money but ask for more money from the start, sign something so people can respect the payment deadlines. And yes, people are not usually getting residuals after appearing on the cover. Anyway, this industry is a monster for the most people if you are in it. Respect for this videos, Blacky! Can’t wait for your song!
All your lawyers statements were ignored because Gambinos lawyers are already on the case and clearly know what’s on contract and what’s not. Not only do I highly doubt she was paid a “low fee” I believe she’s exaggerating as many “models” do. I guarantee you she won’t put out the number they paid her because she knows it’ll make her look bad. Not to mention why drag any race into this - not only did she try to make this a race thing but she tried to make Gambino look like an Uncle Tom with that “white woman” statement.
Also what residuals would she get for being a model for something? I don’t understand what she owns in this situation that she would get residuals for. It would be like a video vixen asking for residuals on a music video they were in.
@@deadbutworking lol music is a very lucrative and contract associated business. Everything revolving music has been implement through hundreds of years of artist making art, from copy right laws, to public 808’s and samples everything is very straight fowards and almost every project involved contracts, she just fumbled her own bag.
@@deadbutworkingin the video, he even says that models usually dont get residuals for album cover work, unless its a famous photo or painting (rage against the machine, led zeppelin 1, the stroke’s new abnormal). it would have to have been in a contractual agreement on if she was gonna get residuals
In my opinion, people are seeing the legal side of this as objective which removes a lot of context. While yes, she should've asked for residuals in paper, it's also a breach of trust to say youll do something then contradict. If we're basing this on who is in the right morally, then it would be the lady, but on legality, it would be the people who didnt pay her. At the end of the day, we don't know if she's telling the truth, but we need to stop this "perfect victim" mentality.
I like your analysis of things. You see things in ways I wouldn’t but in a way I totally understand. It’s not often I change my mind but you’re always able to give me perspective
As a musician myself I make it a point to ensure that for photos of album and song cover art, I definitely do it all myself. But the lesson of ‘can you put that on paper’ is even beyond art. It’s a day to day business thing that I learned the hard way. I implore you take this as a lesson and fight for yourself
You can get whatever want. If it's agreed upon prior and in writing. Usually, models or design artist are Work for Hire. Do the job and you're done. Paid for the work and able to say you modeled for Donald Glover within your portfolio, which should carry enough weight to get you more work.
I’m tryna understand in what way would residuals be applied here. The album is made. The album cover is put on the album. The album is released. In what way would an album cover be continuously getting revenue from, especially many years later?!?!? Wouldn’t it be the album itself getting the money?!?!? It’s not like the cover is being used in other ways. Like shirts, posters, in museums, etc? Someone make it make some sense for me please.
If I can take a educated guess it would be almost like royalties. Since the album is going so well with streams they probably wanted to do a percent of the income since the stream shows the cover art (kinda like an exhibit of her photo) that’s what they implied
@@upscaleriotsofficial2166 exactly this. I've offered a model this for a book cover (once, and one time only). It's extremely rare for anyone to do this, because the value is usually the content/body of work, and not necessarily the art cover. Models usually end up getting a huge recognition boost when being on covers, and a one time fee. The boost in recognition is the added benefit, hence the reason people don't offer residuals.
So the claim is that Gambino's team/production finessed a model and 2 other artists who didn't do their own due diligence before agreeing to work together and who now refuse to accept accountability for their own mistake. This is barely a head line because this type of thing takes place on a daily basis in most artistic domains.
@smoothduck7151 She is the performer of the shoot, so she should get paid. Should she be more savvy with her business...yes. But regardless she worked and she should get paid.
Sure that doesn’t make it okay lol if he did promise that then he should have done it. Period. How is gambino gonna critique capitalism and critique America, when clearly he’s part of the issue?
Not even, if you're not aware in the arts it is very common to not get paid for work in exchange for exposure/build your portfolio/reputation. The industry is flooded with models and artists. It's highly competitive and everyone working in the arts is trying to stand out so it's not unheard of to be compensated in other means besides cash. If you're at the point where you are able to make a living and provide for yourself solely off your artistic outlet then you've essentially made it because the majority of those in the arts work 1-3 other jobs to financially support themselves. @@peripheralhandshaker
My mom always told me about getting confirmation in writing, I hope she gets what she deserves and needs for her iconic role in one of the defining albums of this century
I don't think we can entirely disregard race as part of the issue here - yes negotiating skills are the best way to protect yourself but I've experienced it numerous times (along with friends having similar experiences) that when I negotiate for my worth, request everything is in writing before we begin, stipulate what's expected from me and what they are paying me for it etc, people still don't take me seriously. i.e. I and other black women have to fight for that constantly compared to my friends and cohorts who are white, other POC, or men. You can have all of your ducks in a row but employers will still take forever to sign off contracts, gaslight you, pretend your 'dealbreakers' are irrelevant or keep changing the priority in ways that show you they aren't threatened by whatever legal action you enforce. So I can believe the white woman who made the headdress was a stronger negotiator, BUT I also believe there is a racial bias that could have helped her be taken more seriously by the production team, but that's just my opinion.
Bruh why your videos now just repeating the same info points 3-5 times then adding an opinion and maybe a little extra new info point? Normally I can watch your content on and on and on but this intense repeating in the more recent videos is hard to sit through. I think the success of the album was mostly due to redbone, the album was very weird and different from his past work. As a long time gambino fan it’s probably my least favorite of his projects and most people who are familiar with the project probably listened because redbone was an inescapable smash hit. So to say she was the reason for the albums success is a bit of a reach plus I’ve seen many projects with great covers have terrible music (especially in the underground) and they’re not catapulted to success by an album cover much less the person in the image on it. I still think she should get payed if that’s what she was promised but you’re framing it like she made the album and did the marketing/promo for it
IDK... My ex is a singer and got into a bad deal with a label. She had a couple of viral songs that she made nothing off of... Now she is stuck in a bad lease for a home that she was allegedly told was going to be 1 price, but turned out to be double... After all of her mishaps, I just now realize that she signs contracts without reading them and after reading her record contract and her lease, I realize that its all her fault. When I tried to tell her that she messed herself up by signing all of this stuff without reading it, her only excuse was "well they told me the contract said other stuff"--that didnt vibe for me. Nevertheless, there is a reason she is my ex... Everything is everyone else's fault but her own and that same mentality trickled down into other aspects of the relationship that made her impossible to deal with. Zero accountability for anything.
I don't know what state they were operating out of but Depending on the state verbal contracts (aka agreeing to something through talking rather than signing) are actually considered binding in some
Promised and getting it in writing is 2 different things .bad business practice is nobody’s fault but your own. Further to the point that cover had 0 part in the album success. He got that on his own.
@@deejaycxreThat’s not strange at all. Models don’t get residuals because they get a flat fee for the photo. She’s made sure that she won’t get this type of work again
What bothers me is that she says she got paid a really low fee, but why would you not settle with a good flat fee before doing the work, unless thats why she accepted to be paid in residuals, but then that would be in the contract if that was the case otherwise she was incredibly naive to agree off of word of mouth from whoever in his team dealt with the payment, sucks but its kind of a live and learn moment I guess
The PHOTOGRAPHER is the one who owns the image, that is the main person who has a case if there are compensation issues or other issues, that's the person she needs to direct her concerns or problems to not Glover unless he is the photographer.
People really out here trying to paint themselves the victim. No one is watching your back…legally you got to make sure all the proper paperwork is signed and if you yourself is going to sign a contract read through it and understand it. Know the ins and outs of what you are doing. So many people want to through shade years after the fact. It’s your fault, your responsibility, & you’re accountable for it.
I’ve done hair for lots of different types of shoots. You negotiate your price you get pictures for your portfolio and that’s it. Models the same thing they get a flat fee. If the photographer is big enough, he might hold onto the rights, but that very rarely happens. I don’t know about the headpiece. Maybe there was something contingent within their contract. Residuals never heard of such a thing and if this girl are working model with legitimate companies or she’s just doing freelance, she would know this
I remember looking at the story when it first came out and my first question was what is a low fee to her because just a couple months ago we were also dealing with another person who said that 10k a month is not enough money to survive off of I’m just trying to put into perspectivewhat a low fee is to this specific person
after hearing your analysis i definitely agree. Like it’s sad but i never knew that’s how things worked. But i think someone on twitter mentioned that he’s always had a history with black woman. But great video, i want to be in the entertainment business and my go to phrase will be “can you put ir on paper “😂😂
She was a offered a job and accepted it. She is not entitled to any residuals unless she had a contract if not she can kick sand Gambino is right to just ignore her
Might be an unpopular opinion but I LOVE this album & the Funkadelic sound he paid homage to on it but I actually have never liked the cover. My opinion on that aside, I gotta agree with OP, even as someone whose worked on marketing & direction with recording artists, I’ve also NEVER heard of someone receiving residual payment for appearing on an album cover. That’s borderline being paid royalties for an album. As much as I love to side with my demographic when it comes to stuff like this (just being honest), I don’t see how this has anything do with race. This is a business issue. Not a race issue. Someone giving you a verbal “promise” to pay you indefinitely for something can literally just be argued away. If someone else (regardless of their race) actually did get paid residuals for something, I guarantee you there was a contract involved (regardless of their demographic). When it comes to the music industry, I’m well aware of how scary contracts can be. Signing the wrong contract could potentially ruin you financially if you can’t hold up your end of the deal in many cases. In this particular instances, a contract of obligation to make sure she got paid residuals for her appearance on the cover would have protected her. Plenty of people feel underpaid for their art & contribution to a work (Just ask most producers) but in this case it sounds like she was in fact paid up front for her services. If the payment wasn’t satisfactory to her, she should’ve negotiated that then or withheld her services. 7 years later, her claim might get people tweeting Donald & commenting on his ig but I doubt it’ll get her paid. Even with that, (not to sound harsh) but it absolutely wouldn’t have been difficult for Gambino’s production team to grab another girl with the same or a similar phenotype to pull off the same look for the cover had she turned down the opportunity. Sometimes you just gotta be happy with the exposure & the fact that you DID get paid for your contribution (being the face on the cover of a great album). It is what it is. Had a friend who literally created the logo for a clothing brand that ended up being quite profitable for the brand owner. We had friends who felt he was underpaid for his contribution but no contractual agreement was made for there to be anything other than the upfront payment. It isn’t something he dwells on because even if it upset him, there’s nothing to be done about it now. Be proud of your contribution.
Great insight bro. It’s a tough call and I think she probably was thinking of digging into that cookie jar. The opportunity was too good to risk. I think she still won though with the small cut and exposure!
this happens all the time in the entertainment business, morally wrong but legal okay, learn from this mistake, and now she’s is more popular so she will get more opportunities now from this “scandal”
Surprised we didn't get another one of these trendy assault allegations that's been going around lately tbh😂. People will do anything for a little bit of money and attention I swear 🤦🏽♂️
Whats really odd to me is that, yeah, iconic is an understatement for that album cover. It was reallt unique and stood out. I worked at a record store before, during, and years after the time of that albums release. Of all the album covers I saw and/or came across, most of them are a blur. That one stood out in my memory among the thousands of rap, rock, country, pop, kpop, jrock, christian, etc. Albums we sold
Honestly it sucks but I don't think this makes Gambino look bad. A verbal promise is as good as a wet piece of paper. If she had a solid case she would have sued years ago. Especially if she was already paid for the initial photo. With the white lady if she was paid residuals it could be that she negotiated properly as she said or even she could already been under contract with Gambino because usually make up artist and wardrobe and stuff like that is usually a constant with celebrities. Like if she was contracted to work for more things other than the album cover, like she worked on costumes in the video or even make it in the video.
My thing is why bring it up after 7 years??? If you were annoyed with this for so long should have said something sooner instead of waiting 7 years and then being like "I didn't get what I felt I deserved for that album cover" It just makes no sense...
So what it's still immoral to promise someone residuals and then not follow through. She may have made a mistake but that doesn't make Donald less of a bad guy in this situation
@@ulyssesharpe7487 And the problem with relying on "promises" is that you have no proof of nothing. We don't know if there was really a promise to give her residuals
@Captainobvious611 So what bruh not everything is about the law. If someone cheats on you will you just go "oh well its not illegal so they're not a bad person." ? I know legally she's not entitled to anything, but my point is that if shes saying the truth, Donald Glover is not a good guy because he promises people that worked on his albums residuals and then doesnt follow through.
It doesn't look good that no statement has been made by CG or the label and coincidentally he announced a new album coming soon a few days after this comes out, which means like 2 pages of news after searching his name is all about the new record. If she was lying they'd post a statement about how everyone was paid their agreed terms and move on.
It’s clear this person (the model) is farming engagement online. She’s a model not a creative director or artist. The artist uses a model to create art. It’s pretty we’ll understand in the industry
To be fair, if you're black you understand the stereotype that's usually portrayed because darkskin women for some reason love to unironically fit perfectly into the stereotypes. Also no one talks about how darkskin *men* are portrayed, because we all agree it's kinda accurate, every dark nigga in media you see is in prison, abusing some woman, in a gang or is bald and successful, there's never an in-between.
I got a question, I don't think an artist will directly pay someone who would work on whatever part of the album. Cause wouldn't be like the creator pays whoever their working with and then they'd pay the specific ppl who worked on it? So it wouldn't be glovers fault but who ever he was working with. Cause it wouldn't make sense he would pay her directly but the ppl Glover was working with would pay them directly. But idk how that stuff works so if someone could explain.
I boy who was a baby on Nirvana Nevermind cover..tried to sue to get paid from him being on the cover a couple of times…I think his Uncle or Grandfather submitted the picture but it’s weird because I think he did get something from it by doing anniversary pictures but he kept trying for more…i think Courtney ignored him after a while… but there have been other people who were on album covers for very popular rock bands and I don’t think they ever came back about getting anything from the album sold… I think in this case…word means nothing unless it’s in writing. If a promise was made, then it would have had to been in contract. No contract then it won’t hold up on word alone.

Now, if they promised her residuals, like if it came FROM Glover himself, then pay them out. But come on now, that's just not realistic.
None of us know what really happened but I've never heard of someone on an album cover getting residuals. That seems unusual. Also when people start using race as a point for not getting something or getting less than what they think is deserved I get skeptical.

No they don't in fact it's extremely rare
Super rare. Must be an independent label.
So rare means impossible or just that it’s not the norm… rare isn’t impossible
She's clout chasing. Smeared this man instead of smearing her management
All your lawyers statements were ignored because Gambinos lawyers are already on the case and clearly know what’s on contract and what’s not. I guarantee you she won’t put out the number they paid her because she knows it’ll make her look bad. Not to mention why drag any race into this - not only did she try to make this a race thing but she tried to make Gambino look like an Uncle Tom with that “white woman” statement.

They feel robbed cuz a cover photo? They gotta talk to the guy who was a baby on the nirvana cover.

Cause it wouldn't make sense he would pay her directly but the ppl Glover was working with would pay them directly. But idk how that stuff works so if someone could explain.

None of us know what really happened but I've never heard of someone on an album cover getting residuals. That seems unusual. Also when people start using race as a point for not getting something or getting less than what they think is deserved I get skeptical.
Simple everyone MAKE SURE YOU HAVE IT IN WRITING!! SIGNED AND NOTARIZED a promise means nothing in business!
How are they acting like its a race thing.
Who should be the proper recipient of this backlash? Gambino or the Machine behind Gambino?
Gotdamnit. Not my guy lol hope he makes this right some how before it really blows up. Hes not contractually obligated to do anything but maybe he should find some resolve to save himself the headache of having his image twisted. He already got a bad rap for how a darkskin black woman was portrayed in that Drake episode of Atlanta 🤦🏾♂️
He's not obligated to, but if this is true contracts be damned he has more than enough money to be a basic human being, especially since he's not only an artist but he's an actor too, a line of work known for pulling shady shit like this.
Go ask the kid that was on the Nirvana Nevermind cover.
