  • The plaintiff’s late mother rented an apartment from the defendant for seven years. She claims the defendant is withholding her mother’s security deposit, so she’s suing. The defendant argues the plaintiff’s mother regularly fell behind on rent, so the defendant used the security deposit to cover the late payments. The defendant says damages in the apartment exceed the amount of the security deposit. She’s countersuing for excessive damages.

      Who Said? She Was Trying To Keep The Security Deposit Over So Called "Damage" To The Property. But She Was Found To Be Unscrupulous By Charging The Tenant For Things That She Had Nothing To Do With. Therefore, Not Legally Responsible.     The fact that she was well aware of the multiple areas of leakages while Martha was residing there, however ignored it all while knowing Martha was battling a cancer/sickness for many years is alone absolutely horrendous!! The fact that when Martha unfortunately passed away and the landlord became fully aware of the severity of her properties issues and the conditions Martha ultimately was living in yet never complained about, such as heating issues and plumbing issues caused by the improper installation of ALL pipes and such due to the negligence of inspector's, contractors, construction staff and the property owner for not ensuring proper installation and inspection before marketing the property, yet she still attempted to take advantage of the situation and withhold a 9 year old security deposit because she said, and I quote " I didn't think they were going to take me to court over it" is despicable and not to mention how she allowed the organization to make payments late multiple times yet never enforced late fee payments from Martha while she was actively renting her property however upon being sued is now requiring it should have been looked at differently and not granted to her!! Im happy the Judge awarded the plaintiff double however I feel she deserved alot more just based off the defendants vindictiveness and attempt to make a profit from a tragedy!! Smh that's just sad! Im happy Martha's daughter fought for her and her Madre!!!

    Defendant I think figures renter has passed on so she’s keeping deposit. She figures she didn’t fulfill her lease when she passed so she can keep everything. Defendant thinks that renters child will forget their mother has a deposit. Defendant is delusional that apartment was NOT clean! JM called this one right on.

      thats why i have been saying for years that requiring deposits to move into residential rentals should be totally illegal . the only money a landlord is entitled to is rent and rent only . if a tenant damages the property then the landlord has every right to sue and prove it in court , but the mandatory deposits are an unfair burden to put on renters who have not even started living there yet let alone damaging it .

      This comment made me actually just now add a note in my “FOR WHEN I’M GONE-documents” about my paid deposit, as a little reminder for my daughter, who has access to these files and knows how and where to find them after I pass away.
      I doubt that a thing like ‘rent deposit’ will be on top of her mind whenever she has to deal with these things…
      Thanks for reminding me to do this!!

      FYI: most states make the landlord put tenants deposit in an interest bearing account, and all money is returned even interest to tenants (unless damaged occurs) upon moving out. The landlord can get sued if they don’t do this. Massachusetts requires landlord to do this if they don’t, tenants can sue for triple the deposit, court costs and lawyer fees.

    That place was left empty and clean, a hell of a lot cleaner than what many tenants leave a place. They went above and beyond IMO. The only trash in that place is the landlord.
    She collected rent for 8 years on a place that was substandard at best and was aware of it and now wants her deceased tenants daughter to pay to put her place in the condition it should have been in all along.
    I have nothing but disdain for this landlord.

    Landlords are the worst. Mine is owned by a property management who helps them get away with taking peoples money and it’s ridiculous. I’m so glad I own my own place now. 😊

I do have to admit though that my landlord and property management that I'm going through now have been really great to me but I have rented a lot of places and I have been screwed by 90% of them

    Defendant initially seemed to be a rational woman, but when the judge started going through her receipts it began to look like she felt that anything that went wrong with the house while the tenant was living there the tenant should pay for. And a new sink because the line had to be snaked out? That's just a weak excuse to keep the security deposit in her own pocket.

    I once cleared an apartment, REPLACED the carpet, painted, to the tune of 3 goddamn grand. They CHARGED me $5500. You have no recourse. They’re crooks.

    I commend the daughter for taking the land lord to court. It is money owed to her mother's estate and the landlord was wrong with those trump up charges for things that were her fault due to improper installation. The plaintiff is very pretty by the way.

    That landlord flat out lied about the place being a pig sty. It was extremely clean. So, I'm glad she had to pay double.
    The law should be that the landlord has to pay double when they wrongfully withhold security deposits everywhere, because that encourages them to not do what this landlord did - flat out LIE, aka FRAUD.

      You mean aside from being an ignorant, greedy jerk. If you are going to be a landlord, you had better plan on budgeting for maintenance and setting those funds aside. Too many people just don't fight it, so landlords get away with keeping deposits. The one time it happened to me, I fought it, won easily, and put a lien on my ex landlord to get my deposit back. It took a year, but I got it.

    Some landlords don't seem to understand that the tenant isn't responsible for every little fix you have to do. You have to work it out to make your investment worth it. It's still going to cost YOU money to maintain the place.

      Then your stylist clearly doesn't know how to properly color at all because I specialized in color and could get even the worst, most unhealthy hair with multiple different types of box hair color on it to that color blonde in just one sitting!!!!

    As a landlord myself this landlord lady should be ashamed of herself. It’s ppl like her who make a bad name for the rest of us. Be a good human being and treat others how you wish to be treated. God will take care of you if you do and that is better then screwing ppl over for such things like a few thousand dollars. Goodness sake, some ppl are so selfish and ignorant.
