Well, it's true, Indian law system needs a lot of amendments 1. Against the passing time of rapists and terrorists in custody. 2. Against those who openly create, make, endorse, promote and telecast slogans and banners spreading hate and terror, screaming pak Zindabad and being a threat to the soveignity of the country. 3. Firstly as a lawyer I'd like to point out that defamation is not only a criminal offences but also a civil wrong in India. It attracts both civil and criminal liabilities in India. Secondly removing S.499 r/w 500 of IPC is not viable as it acts as a deterrent for people publishing defamatory statements. What happens when a person who has no money to compensate the Plaintiff for defamation? Civil courts cannot jail someone for more than 6 months. That's where S.400 r/w 500 of IPC comes in. Lastly I'd also like to point out that filing a suit in civil courts is very expensive... With all the court fees and lawyer's fees. Criminal action only takes FIR and the State prosecutes the offender.
Are there ways to lower those filing costs, because threatening to throw someone in jail for publishing something false(wittingly or unwittingly) sounds borderline undemocratic
The Sham Sharma Show Not really court fees depends on state to state. U need to check the court fee act of that particular state for exact court fee. Plus advocate's fee which depends on the advocate u hire. There's also a possibility of never getting the compensation or the cost if the defendant does not have any assets. If the defendant has assets then the court can force an auction to compensate the plaintif if not maximum of 6 months jail. I understand ur concern about the jail term but how else can u deter them from defaming anyone. In civil case u can also get away with it by just apologising... We have seen this happen with Rahul Gandhi and his chokidar chor hai slogan and he had to apologise to the SC for wrongly quoting them... But did he stop? The good thing is the defences in both civil and criminal case are the same... The truth or criticism apart form other things. So what Arnab did was criticism of sonia gandhi and as such he won't get any jail time. Not saying I agree with the way he criticised her. One reason why the SC gave him relief on stay of prosecution for 3 weeks. Plus if they fail in the prosecution Arnab can take the state to court for wrongful prosecution and ask for compensation. So in conclusion u need to chose the battleground carefully.

Firstly as a lawyer I'd like to point out that defamation is not only a criminal offences but also a civil wrong in India. It attracts both civil and criminal liabilities in India. Secondly removing S.499 r/w 500 of IPC is not viable as it acts as a deterrent for people publishing defamatory statements. What happens when a person who has no money to compensate the Plaintiff for defamation? Civil courts cannot jail someone for more than 6 months. That's where S.400 r/w 500 of IPC comes in. Lastly I'd also like to point out that filing a suit in civil courts is very expensive... With all the court fees and lawyer's fees. Criminal action only takes FIR and the State prosecutes the offender.
Are there ways to lower those filing costs, because threatening to throw someone in jail for publishing something false(wittingly or unwittingly) sounds borderline undemocratic
The Sham Sharma Show Not really court fees depends on state to state. U need to check the court fee act of that particular state for exact court fee. Plus advocate's fee which depends on the advocate u hire. There's also a possibility of never getting the compensation or the cost if the defendant does not have any assets. If the defendant has assets then the court can force an auction to compensate the plaintif if not maximum of 6 months jail. I understand ur concern about the jail term but how else can u deter them from defaming anyone. In civil case u can also get away with it by just apologising... We have seen this happen with Rahul Gandhi and his chokidar chor hai slogan and he had to apologise to the SC for wrongly quoting them... But did he stop? The good thing is the defences in both civil and criminal case are the same... The truth or criticism apart form other things. So what Arnab did was criticism of sonia gandhi and as such he won't get any jail time. Not saying I agree with the way he criticised her. One reason why the SC gave him relief on stay of prosecution for 3 weeks. Plus if they fail in the prosecution Arnab can take the state to court for wrongful prosecution and ask for compensation. So in conclusion u need to chose the battleground carefully.
