I agree and to add, not just Mr. Roberson there is so many in Texas, and sure other states that aren't just on death roll, that is dealing with taking plea deals, from smaller crimes, they have been accused of from junk science or badly trained officers or other factors and the things these experts have talked about that can't even get looked at from this board, or the innocence project because they aren't big enough, but to those that are innocent it has taken their life away.

I admire this committee so much! This gives me more hope in our judicial system. I have never believed in the death penalty because just like every profession there are lazy lawyers especially on Pro Bono cases. This case proves that men doesn't always get it right. I loved what Dr. Phil said that you don't see rich men on death row and you very seldom see them in prison. Our jails and prisons are full of people wrongfully sentenced because they couldn't afford the best lawyer. They are also full of people with addiction problems that could be helped if the same amount of money used for incarceration was spent on rehabilitation. I believe we are raising kids who want high paying positions but don't want to work.

It’s both tragic and infuriating to me the grave injustices that have been perpetrated against this autistic, grieving father for over 20 years. Our judicial system is so highly flawed, due largely imho, due to the fact that most of the accused are impoverished and rely upon the overworked public defenders office; they just have time to make plea deals and that’s about it. There are thousands imprisoned that are innocent; their only crime is that they cannot afford effective legal counsel. And lack of education and training, both as well to, diagnosis’s of people with developmental and or cognitive disabilities. It causes me, a parent of multiple adult children with ASD diagnosis, paralyzing anxiety and fear of them living independently as adults in a world that doesn’t understand them and judges EVERYONE immediately.

I really appreciate and have new RESPECT for this committee right here! THANK YOU for stepping in and hearing this case. May you hear many more. I, however, must say, i would have SO MUCH MORE RESPECT for our judicial system, if those involved in courtrooms where people are "tried" and their life is determined for them... MEANING lawyers and judges, ARE HELD ACCOUNTABLE for miscarriages of justice. In Roberts case, do you not think the judge was aware of his INEFFECTIVE counsel? Of course they were. Public Pretenders should be FORCED to take their tax paying jobs extremely seriously. Every citizen here is aware that Public Pretenders tend to be newly graduate law students (getting practice) or just typical underachievers. ACCOUNTABILITY NEEDS to be enforced for these people, including prosecutors. The ability or inability to pay extremely high prices for legal assistance shouldn't take away someones constitutional rights just because they can't afford their "rights". It ALL starts with LE, coroners, pathologists (clinical, anatomical and forensic), then the prosecution and defense "attorneys" and finally the judge. Juries cannot be held accountable bc they only make decisions on WHAT IS PRESENTED to them, as instructed. THINGS MUST CHANGE IMMEDIATELY. TY.

Public Pretenders use their jobs mostly as "stepping" stones, getting from one place to another only awaiting for a paycheck. If and when, they move on, do they actually buckle down and WORK for their clients (and most of the public is well aware, finding an attorney that actually cares to fight for a client, is VERY far and FEW between). Alright, I understand this baby was, in general, not well. How though, if father didn't do anything, had the baby sustained those brain injuries? Edit: I wrote my first comment right at the beginning of the video. I'm a pediatric medical professional, and by knowing what medications the baby girl received, I absolutely changed my mind! I honestly think Robert is innocent and should walk as a free man. First of all, the baby had one single injury, and not multiple as earlier stated by the State. That injury she most likely sustained by the fall from her bed. Everything else was caused by the medication Phenergan, it is known to cause such side effects in young children. It is horrible to think that this poor man is sitting in jail innocent all this time!

Medical measures taken to save her life, releasing pressure from her brain, medical mechanics that kept her alive. She did not come to the hospital with those injuries. Dr. Phil explained, after thorough review of the trial transcript with his team and his CSi company, there was only a small injury to her head from the fall off the bed.

Yes, and I just heard today that other treatments caused the bleeding in the brain, (was used to increase blood flow), but that it wasn’t as widespread as the trial stated, but only in a certain area of the brain; consistent with a fall.

I am full of admiration for the work of this Committee on Jurisprudence under the calm, unbiased chairmanship of Mr Joe Moody, whose leadership sets the tone of fairness and open-mindedness for those who have been unfairly tried and convicted. The blatant ignoring of crucial evidence presented to the Jury in the Robert Roberson case leaves one doubting the Judicial System's honest quest to reveal the truth rather than seek justice at any cost. Thank heavens for men like Joe Moody and the members of his Committee.

This a real miscarriage of justice. I have worked with people with mental disabilities for many years and find that for a court try such individuals as 'normal' is grossly unfair to them. And even after Robert was diagnosed with autism and new evidence came to light, he was still denied a retrial. Why? Because after having personally witnessed with a motor vehicle accident I was involved in, how lawyers' egos come into play with cases, prosecusion was not going to admit that they got it wrong. When I attended the 1999 Special Olympics World Games in North Carolina as a coach, the week preceding the games I was a guest of the city of High Point. I witnessed first hand how American society embraced and integrated people with disabilities in placess of work and in city councils. Michael Jordon was the Games representative. Eunice Kenedy Shriver was the founder of Special Olympics. Many celebrities, musicians, actors and sportsmen and women are always involved in S.O and get behind charities for S.O. So there is a great awareness of people with disabilities in every state. How they got this one wrong to have a disabled man sent to death row simply leaves me gobsmacked and angry! What a shame!

There are very strict rules and precautions to allow an inmate housed on death row to be transported anyplace. These rules are in general rules and have very little to do with any given individual inmate's personality. However for medical appoints that are necessary to be carried out someplace other than the prison and their court appearances, even if extreme security precautions are needed, will be taken to those appointments. I suspect the reason Roberson isn't at this hearing of evidence is because breaches of justice are an embarrassment to judges and politicians whose well paid positions rely on the vote of the people.

What an ironic thing to say.
So, ... (presuming) this guy is innocent, and has already spent decades in prison, you'd rather see him spend the rest of his life in prison, (falsely accused) than to be set free? Heart of stone!
Why? For what? WHO ARE YOU???
      Did you know him personally?
Have some other issue with him?
Perhaps he's an ex boyfriend that dumped you 35 years ago?
Please do explain your (seemingly heartless) answer so that we may all understand.
