I want to rescind a presale contract and get my EM back - it it possible? The building is still under completion, I upgraded my unit to a more expensive one. And I didn’t receive public offering statement from the seller on the upgraded unit. I secured a unit in January and then in September I upgraded, then November discovered that a garbage room door was placed infront of my unit - I cried when I discovered this and decided to fight to rescind and get my earnest money back. How to win? Also before I signed the contract, the sellers agent assured me that my unit will be facing a wall which is not true
As a layman I do not understand the simplicity that comes with Seller doesn't have to disclose if they have not lived there in 3 years. It seems just way to simple. There has to be more to this than one line. Do you have video covering the 3 year issue? Bought a house from an LLC flipper who's undisclosed daughter was living in the home during flip which was also undisclosed. Said daughter was also the acting selling agent with her live in boyfriend as the official realtor though he did not participate more than 3 brief phone calls at the very end and even sent her to the closing. None of this came out until the house was falling apart to the point we got so sick we lost our business and had to live in the garage. SO!!!!!!!! I just can not bare the idea of 3 years and there is nothing more to that.

The seller is in jail and the realtor do not want to fill the blank of disclosure.....shall I proceed or leave this house deal ....pls answer me asap
