  • The case of a Christian mailman who didn’t want to work Sundays was used by the Supreme Court to solidify protections for workers who ask for religious accommodations.
    A unanimous decision announced Thursday made clear that workers who ask for accommodations, like taking the Sabbath off, should get them unless their employers show doing so would result in “substantial increased costs” to business.
    Andrew Lieb, a legal expert with Lieb at Law, joined LiveNOW from FOX's Josh Breslow to discuss the case and the effect it could have.

    I lost my job because I would not go to work during the Sabbath hours. The mine I worked at did accommodate me for a while. They had to bend backwards to assist me. Productivity never drop an inch. They eventually sent me packing. Worry not God opened a door for me to get into ministry. This was over Forty years ago. Never missed a meal or need. God takes care of his own.

    Sunset Friday until sunset Saturday is the sabbath according to the Bible.
    Sunday is the first working day of the week. Sunday is the day the Bible says Jesus rose on, the first day of the week.
    Jesus rested in the grave on sabbath, aka Saturday, and rose on Sunday, aka the first day of the week.

      If it is a religious accomodation there are others who can accomodate this exclusion. As a christian I had always wanted Sundays off when I worked but was denied that. A schedule is a 5 day work week, so this can be “scheduled” in as needed. And it is hard to believe that Conservatives are against this. It is definitely a win for the true Christian Conservative, to be asking for an accomodation on a Sunday to practise his religious obligations.

      A lot of kids in my town won't work sunday mornings. As long as they can at least work 28 hours total they are fine.

      in "right to work" states you can be fired any 0 reason so if the company doesn't want to work with you on that they can just fire you and cite no reason for doing so.

      The reason behind that is because the powers that be are fully aware that religion is man made , and from what I understand , thats the main reason why NASA don't send astronauts into space that believe in a GOD

      "Congress shall make no law prohibiting the free exercise of religion. "
      Congress shall not promote one religion over another, nor interfere with the personal religious freedoms of the its citizens.
      That includes Christians freedoms to practice their faith.

    I’ve been fighting back and forth for a year now with my employer because when I started the job we were trained from home and were unable to worship in person. I submitted two letters from my pastor to excuse me and they kept scheduling me 2 Sundays out of the month because they claimed this is all they could accommodate. Well my last request and letter written (by me) regarding it was submitted to them, just by chance on the morning of this ruling 😮. I was granted the month of July but no word on August. I’ll leave them be for now because I imagine they are digesting the news but Praise God I’ve been praying on this and here we are!

      So people getting the day off from work in saying they are keeping the sabbath holy.
      Are doing a worse evil by creating an economic strain out of hypocrisy continuing/increasing their consumer side of the economy.
      But maybe we can do ya'll some favors to help save your souls .
      And refuse you service on the sabbath once it has been established that you need a religious accommodation ?

    My question is, why did this person apply to be an employee at a company where he knew he had to work Sundays? I see more at will employees and independent contractors in the near future. Its not about religion, its about the government butting in their nose at everything you do now adays... If your employment requires sunday work, then work somewhere else, don't ask daddy to come in and breastfeed you..

      Sundays aren’t part of the job description I didn’t think. They have asked my husband a couple times to work Sunday’s and he politely declined. Some workers don’t get that option.

      Your employer will not tell you how many days and what hours you work until they hire you. Some give you the weekend off as company culture others make the end end be like any other day of the week. When you get into hourly employees your work hours might change from week to week so you will not know when you work until the week the schedule is posted for everyone to see when they work.

    This will cause problems when newly hired religious employees get Sundays off but long time non-religious workers who have more seniority still have to work Sundays.
    Can anyone who wants Sundays off just say they are religious even if they are not? Is verification needed?

      @@Woofwoof1929 It's everyone's problem if there are not enough firefighters, paramedics, emergency room and hospital doctors and nurses who can work on Sundays. When manufacturing companies must cut back production to accommodate religious workers, it will cause shortages and supply chain issues, hurting the economy, it affects everyone.

The clear intent of the founding fathers and the framers of the Constitution was to create a secular democracy governed by the rule of law where God and religion were left to individual conscience.
      Even the devout, church-going Congregationalist John Adams, who had signed the Declaration of Independence, also signed the 1796 Treaty of Tripoli affirming to Americans and the world that “the United States is not, in any sense, a Christian nation.” The U.S. Senate ratified the document.

    To anyone taking issue with this, federal law has been clear about this matter for quite some time.
    Per the Equal Employment Opportunity Commission:
    Religious Discrimination & Reasonable Accommodation
    “The law requires an employer or other covered entity to reasonably accommodate an employee's religious beliefs or practices, unless doing so would cause more than a minimal burden on the operations of the employer's business. This means an employer may be required to make reasonable adjustments to the work environment that will allow an employee to practice his or her religion.
    Examples of some common religious accommodations include flexible scheduling, voluntary shift substitutions or swaps, job reassignments, and modifications to workplace policies or practices.”

    Very good, this preserves the right to practice one's faith. This is a fair decision, in my opinion. I can see how this could be abused by dishonest people, but that number should be low and if the worker makes unrealistic demands as being for religious accommodations the employer still has the right to let go of an employee if the accommodations affect their business 's productivity. But since they are not forced to pay someone for not being there, there is no hardship there anyway. This will, however, change how people might get hired, so it's not a simple thing to allow. An employer may preferably hire people for the days they need them and will need to make that clear when hiring. Regardless, for honest people practicing their faith, it is an important decision to allow.

      Question… so a Catholic surgeon can refuse a Baptist heart patient, since surgery is an artistic skill.?? Can a nurse in the ER refuse to assist in emergency blood transfusion based on her religious beliefs on it? Can a chef refuse a to create a dinner to an interracial couple ?

      @jeannestapleton7514 This decision does not allow for discrimination against another simply because of differences in one's faith over another. An individuals rights are still protected by the US Constitution. But if your talking about focing someone to do something against their will, that is far from being compared to allowing a person to have a day of religious worship over being forced to work on a day of worship.

    I recalled when this issue was placed before me. I decided to keep all of the Ten Commandments as God wrote them down with His own figure. Of course The mine i was working at had to bend over backwards to accommodate my religious conviction. And they did so because of one of the captains knew about Sabbath keepers. They never missed a beat for having accommodating me. Now that was in the year 1977. And productivity never stop climbing. I never missed keeping all of the Ten Commandments since then of course. And they did not loose one cent for having accommodating me.

The seventh day of the creation week was set up by God with the purpose of having us rest and reflect upon creation and the creator who set it up. In Exodus 20, you could find the reason why God set it up. It amazes me that the only one of the ten Commandment most church refuse to keep or insist on changing or forgetting, is the only one that starts with the word, ( Remember).The Bible says” that if we keep all of the commandments and yet rejects one, he is guilty of braking them all. Isaiah 66 : 22, 23 tell us how long the Sabbath Commandment is going to last.

Jesus said, “ many are called, few are chosen. If the Bible says that sin is the transgression of the law. And that Jesus came to save us from our sins, (the transgression of God’s law), so be it. Revelation 12 : 17. Tells us that this will be the last bone of contention at the end of the world. But we should all accept Jesus mission for us all. Matthew 1 : 21. Those who refuse Jesus job discrimination, are refusing what He came to do for us. Revelation 12 : 17. This verse tells us that this will be the last contention that will play out. God Bless

      Well part of that was making the post office earn more money instead of needing federal funding to still exist. So they made a contract with Amazon for package delivery which then extends their need for employees working on sunday.

      The company has the right to fire them if they do not finish whatever project they are assigned to on time to many times. It has been used to keep ppl working over time in salary jobs to meet deadlines. So in jobs with deadlines i see either 1 it happening but the deadline is longer or 2 the deadline is the same and they go from hours worked to salary then made to work for longer per day to make up for lost time by having a day off every week.

      Focusing on the clause... unless doing so would cause more than a minimal burden on the operations of the employer's business.
      You would think an employer would inform an applicant during an interview that the business operates on Sunday and be able to ask if there's any reason why you cannot work on Sundays without detail. If the applicant says yes and signs off on that, then the employer should be able to refuse to hire that applicant. If the applicant says no and signs off on that, then gets hired but later claims he or she can't work Sundays because of religious beliefs, then the employer should be able to terminate the employment on grounds that the employee lied on the application for hire.
      If an employee has seniority and tenure that has earned him or her the privilege to have Sundays off in a business that operates on that day, how is it fair that a new hire be able to bump the veteran employee to working on Sundays while the new hire now enjoys that day off on account of religious beliefs. Could be talking about more than one senior employee affected in the same business. That'll sure be great for moral.
      And how does an employer know if an applicant or employee is serious about the religious beliefs or just using it as an excuse to have Sundays off. After all, how many might really be NFL fans and watching Sunday football games is something they can't live without.
      Certainly many problem angles with this law. That's why seniority is the best way to operate deciding an employee's privilege over others in having Sundays off.

    AT&T in New Jersey had it's employees to work on SUNDAYS for years. Dallas, TX AT&T didn't have such nonsense for workers in TX ! For years, AT&T made it mandatory for workers to report on their Sabbath days. The infamous CWA labor union took the side of AT&T. AT&T wouldn't dare make Orthodox Jewish and Moslems to work on their Sabbaths and holy days.

Uncontacted tribes know this. You will never see accomodations made for pagan, Muslim native American religions or really anyone else. Just wait. This BS religious slanted SCOTUS has already started to rule in favor of the christian right. Taking cases that are not real. And that have not worked their way through the court system. Overturning Roe v Wade was the start. 6 week heartbeat laws are BS. There is no heartbeat at 6 weeks. There is no heart, valves or anything resembling a fetus.     Well that's one thing I always put up front for my employer the day of my first interview. And if they say no then I look for another place to work. So far I do not recall any company that said no, all places had honored my request.😊

    The judges have Sunday off. So does congress and many banks did as well till recently.
    Amazon signed a contract for the USPS to deliver packages. That guy was there before that deal and there was a substitute for him but they , the post office, told him he had to work. Mail isn’t delivered on Sunday but packages in contracts are?
