Plea Bargaining
An agreement as a result of negotiation between the prosecution and defense (at time, also the judge) which settles a criminal case, usually in exchange for a more lenient punishment. Typically the defendant will plead guilty to a lesser crime or for a more fewer charges than originally charged, in exchange for a more lenient punishment than the defendant would get if convicted at trial. It is seen as a win-win for all the parties as the prosecution has a certain conviction on the record, the defendant is provided a more lenient sentence than the risk of a higher one at trial and the judge is freed to move to other cases and dispute to resolve.3
Plea Bargaining can conclude a criminal case without a trial. When it is successful, Plea Bargaining results in a plea agreement between the prosecutor and defendant. In this agreement, the defendant agrees to plead guilty without a trial, and, in return the prosecutor agrees to dismiss certain charges or make favorable sentence recommendation to the court. Plea Bargaining is expressly authorized in statutes and in court rules.

Video is totally based on example. And I must say this is absolutely Wrong example(Murder). No Plea Bargaining in cases where punishment exceeds 7 yrs of imprisonment.
You re totally right.. this chapter is not enforced on death & life imprisonment or on juvenile cases... example of murder case is wrong 💯

Plea Bargaining is not for crimes exceeding imprisonment of 7yrs, and those offences against women and children.
Madam I have one doubt in previous vedio parties to crime ..the pp will be fight towards the victim ..in this vedio you are saying pp will go to jail and ask the accused to accept his offence... Public prosecutor will act for whom victim side or defendant side..i am always confused mam.. please clear my doubt .
Public Prosecutor is basically appointed to defend State.

The accused don't get plea bargaining for muder,it is only for petty cases.
Clause (3) of Article 20 declares that no person accused of an offence shall be compelled to be a witness against himself.
But it is only in police custody

Ma'am recently 3 cases of pocso In maharashtra is disposed through plea bargaining how it is possible?
It is Not true coz crpc 265 sub section clearly define ,plea bargaining only in cases which sentences less than 7years, and it is not applicable in offence against child or woman.
My bad sir they had opted for "plead guilty" not plea bargain
Your explanation is good but example is wrong. Plea bargaining g is possible On Cases those whose sentence is 7 or more years of imprisonment. Murder can not be example. This type if explanation misleads new students. Please go through the provisions of 265A to I and redo the video.

Yes ur right PB isnt applicable on cases above 7 yrs…but i guess u havent watched the full video…in later part i said dat it isnt applicable on all the cases (full provisions will be taught in later videos).
This video was made to make people understand the concept of PB…rater than actual law presiding in India. So took this example.
Currently M not teaching actual laws of India rather m focusing on the concepts
