I heard of a business owner had someone used their name for their products. Then the business owner went and trademark the other business name and got a logo and is basically destroying the other person's business. If I come across the story I will place it here. It made me realize to protect my business and future businesses. We can not be out here not protecting our ideas, services/products because people like to steal and cause harm for no reason.

Generally speaking, a name/word mark provides greater levels of flexibility because the words are protected in any stylized form, whereas the logo is usually limited to the way it's visually laid out. The other thing to consider is that the USPTO makes decisions on a first-come, first-served basis. So whoever got the trademark in first would likely have stronger rights to exclusivity and could stop others from using the words. It just depends.

This helped! I am considering filing a trademark for a new preworkout flavor (I work in sports nutrition). After that, I want to pitch my idea to a bigger preworkout company for them to produce it, so that they’d then need to pay me royalties, rather than just using my idea for free. I don’t have a huge budget but would still love to do it. Would really appreciate advice!

It depends on the company. Ideally, you should have a law firm help you because they can actually advise you. The online d-i-y tools can make it quick and easy but not necessarily correct because they can't engage with you in a way to understand your unique needs.

I'm a candle maker and recently heard about a large candle company filing trademarks on very common names (examples: Thanks; Thank You Mom; Friday Night Football; New Home; all zodiac signs; all 50 States; some countries; many others). The list on USPTO is nearly 200 names. My question is ... what is the likelihood of these being successfully registered, and what can I do to protect myself?
Great question! It varies from attorney to attorney. It is included in my trademark application package which starts at around $3-4K. But again it varies depending on the firm and the level of experience.
It is definitely possible. You'll have to sit down with an attorney who will evaluate the best categories for you to file in. Sometimes there's overlap and two products are in the same boat; other times, you are not so lucky. Hope this helps!

Here's the thing people may try to but you'll have a priority date so if you have to litigate (after your registered of course), you'll have the documentation to show that you were using the name first. Also, if they try to submit an application after you submit yours, but before yours has been finalized, their application for trademark registration will be suspend until a decision concerning yours is made because you were in line first. As a musician, you are going to need more specialized and specific advice that I can't provide on a platform like this due to 1) rules that lawyers are bound by to keep their bar licenses, and 2) limitations on how much we can give to non-clients. What I can say is that you need a sophisticated mix of quite a few different protections including trademark and copyright.
If I have found out that my chosen brand name was already applied for and then objected 2 yrs ago, does this mean that the name isn't trademarkable or it is but the applicant slacked on appealing the objection? If it's not trademarkable, I could save a lot of money and time wasted.

I think she meant $350 is the base fee for the standard process, but it can go up from there if there are any bumps on the road.
