    “Legal Anthropology and Human rights”
    About the initiative:
    The way UPSC is evolving in terms of questions being asked in the examination. It reveals a harsh but true fact that NO SINGLE BOOK/LECTURE/CLASSES is available that is sufficient enough to sail through the entire paper.
    So, what can be done??!
    You need to deep dive, you need to evolve and involve in the process of learning to not only clear the UPSC CSE but to also come out as a better person from this journey.

    To this, I am planning an initiative called “BE THE CONTRIBUTOR”
    What is it?
    -From Topic-4 onwards I will give a ‘topic’/'question' in every video, related to the syllabus but not directly mentioned in the syllabus but can be inferred.
    -You can take the help of books, materials, free resources, etc., and frame a brief explanation to help others understand it better.
    What after this?
    -Those explanations which will get maximum likes will be pinned and this will keep on updating every 2-3 days depending on the new responses. So learning will not stop!
    - Eventually, will include some best explanation in the notes along with the name of the contributor.
    Benefits
    -This will ensure a participative approach and there can be no better way to learn than sharing your knowledge.
    -Most importantly, There's an old saying, usually attributed to Confucius, that goes something like "Give a man a fish, and you'll feed him for a day. Teach a man to fish, and you've fed him for a lifetime." There's an important life lesson in that simple statement.

      legal anthropology is the cross cultural study of social ordering. Different societies,states and tribes have different legal systems to enforce social order , often getting sanctions from religion , customs or traditions of that particular group. the central aim of social legal control of society is to ensure prevalence of stability and law and order ,but this comes at the cost of individual's human rights. Ashanti tribe believe in eye for eye,murder for murder, but with no codified laws and concrete verification of proof it robs one of right to life. in Neur , the leopard skin chief acts a mediator but in grave caes like murder, the convict instabtly chops his arm or finger. Though unoversal declaration of human rights were seen as cultural imperialism in todays world it finds acceptance. hammurabi code of mesopotamia advocated killing of the accused's son if he has killed someone else's son ,it meant no punishmnet to the accused but to his innocent son. So to curb other such laws human right is important care is to be taken to accomodate the indigeneuos legal systems of tribes/societies within it.

      Legal Anthropology :
      Legal anthropology, also known as the anthropology of laws, is a sub-discipline of anthropology which specializes in "the cross-cultural study of social ordering"
      Origin:
      • The English lawyer Sir Henry Maine is often credited with founding the study of Legal Anthropology through his book Ancient Law (1861)
      • the 1926 publication of Crime and Custom in Savage Society by Malinowski based upon his time with the Trobriand Islanders, further helped establish the discipline of legal anthropology.
      Human Rights:
      Human rights are moral principles or norms for certain standards of human behaviour and are regularly protected in municipal and international law such as The Universal Declaration of Human Rights (UDHR), is a milestone document in the history of human rights.
      Relationship between Legal Anthropology and Human Rights:
      • Political anthropologists have had much to say about the UDHR(Universal Declaration of Human Rights). Original critiques, most notably by the AAA(American Anthropological Association), argued that cultural ideas of rights and entitlement differ between societies. They warned that any attempt to endorse one set of values above all others amounted to a new western imperialism, and would be counter to ideas of cultural relativism.
      • Its about Universalism vs Cultural Relativism.
      • Most anthropologists now agree that universal human rights have a useful place in today's world. Zechenter (1997) argues there are practices, such as Indian 'sati' (the burning of a widow on her husband's funeral pyre) that can be said to be wrong, despite justifications of tradition. This is because such practices are about much more than a culturally established world view, and frequently develop or revive as a result of socio-economic conditions and the balance of power within a community. As culture is not bounded and unchanging, there are multiple discourses and moral viewpoints within any community and among the various actors in such events.
