In fact, a prosecutor who brought such a charge would be acting unethically and would likely be disbarred by their state bar. No lawyer is going to risk their law license by bringing such a case. Lawyers are officers of the court and legally bound to all such rulings. They are barred from just acting on their own opinion. If they violate that, the court can revoke their right to appear.

The courts have ruled the pardon power applies before prosecution, but just not for “future” crimes. Trump also used the same power last week, since some of the insurrectionists from J6 had not yet been prosecuted.

In fact, a prosecutor who brought such a charge would be acting unethically and would likely be disbarred by their state bar. No lawyer is going to risk their law license by bringing such a case. Lawyers are officers of the court and legally bound to all such rulings. They are barred from just acting on their own opinion. If they violate that, the court can revoke their right to appear.

@@enforcerridley158 Actually, none of the defendants awaiting trial was inside a jail. They had all made bail and were at home. Now their cases were simply dismissed due to the pardon. They were not “captive.” Most of them spent their pre-trial time sitting at home watching television.
