- Some residents at an apartment complex on Beach Boulevard are being forced to either move out or terminate their leases because of issues with the flooring.
I’d be concerned about the floors above collapsing.😬

You are very correct, but this circumstance is a failure of the manufacturer. LVP flooring is a scam product that is poorly designed.

Why are they holding the deposits with an INSPECTION when the apartments are raggedy? How are they gonna try to withhold a security deposit when the apartments were not ready to rent from the beginning??? Straight greed.
They will try to withhold the deposit to cover the poor construction.
The problem is only with the flooring. The rest of the brand new apt is covered by deposit

Plus move out within TWO weeks if they decide to terminate their lease? WTH! Then they say its NOT a safety issue... they just want folks to move fast to accommodate the remediation work.
If I am ever lucky enough to buy a house, it will be a house built before 1970.

I've owned my brick home built in 1955 for 45 years and have never had a problem with the home. You are making a wise choice about buying an older brick home, this new construction is junk.

Ours was built by the previous owner with his own two hands. I wish everyone had the opportunity to own, or at least live in, a quality home.
These are the same builders that complain about permits and inspections. They take inspectors to court instead of fixing issues. Never time to do it right but always time to do it over....smdh

China is the culprit. Everything has become cheap, contaminated and plastic.

That is crazy. Don't buy new builds, there are no longer any skilled craftsmen. They retired 15 years ago and no young people bothered to learn from them before they did. Neighbors bought a condo built in 2022 and the condo is falling away from the next door condo.

People don't want to pay for skilled works. So the ones that are skilled won't share or are retired.
The crews working these new buildings are neither skilled nor competent. Many are hauled from out of state by shady contractors who house them in área motels and lack the training and experience. No oversight, no safety concerns, no accountability. On top of that the crews are paid $15 an hour, charged for housing and transport which essentially makes them earn less than $15. All new buildings along US-1 between 295 and IGP will have these issues.

The lack of skilled workers is an issue. Other issues include cheaper materials (in the name of profit), a higher-pressure timeline, code loopholes, some greener materials that are unfortunately also less robust, and the global supply shortage we had after the pandemic.
I know these are apartments but I would NOT purchase a home built after 2020. After Covid, the race to meet buyer demand plus the limited availability of materials has resulted in shoddy construction.
The same goes for RVs, trailers, cars etc. They look great on the surface but the craftsmanship sucks. We paid close to $100k for a small 2020 RV. We made it from California to Utah before it broke down. My brother bought a huge 2008 RV in 2022. He has driven it cross country several times and it is still running great

Probably due to the "soundproofing" under the floor planks not being able to support of the weight of the furniture + the residents on it.
What is under the floor panels? WTF?
Sound proofing panels that were probably meant for walls but used for flooring instead so don't have the structural strength to support large loads on small areas like the feet of furniture.
I'm in a low income housing complex built by volunteers, el cheapo construction and renos... this video makes me feel damn lucky! I didn't think the standards could be any lower

this sounds so similar to the thing China does called "tofu dreg" construction, it's basically using cheap, sub-quality materials and shoddy building practices, to the point that some of the buildings collapse entirely. i guess that's just how businesses tend to operate anymore.
My friend is blessed. Her dad’s construction company built her home. It took over 3years as they meticulously hired contractors.

Class action lawsuit! Sue the apartment building and sue the construction company. The local government needs to not let them off the hook. Start holding people accountable with serious consequences.
Renters probably agreed to arbitration. If so, class action is out. No big payday. It's considered a contractual matter, so would be hard pressed to get pain and suffering or even lost income. Presumably limited to deposit, prepaid rent, and moving costs. Several thousand to maybe a tad more No attorney is taking that on contingency unless they're in a chartable mood. Still hiring an attorney could be worthwhile to get back some of their losses. Presuming many won't litigate and will take the apartment complex deal or just deal with it.
Time to call an attorney. Find out who constructed the building with the issues and who did the inspections.
Cheap, quick construction, probably uncertified contractors, near the water. Just a terrible upheaval for residents who just moved in. What KIND of INSPECTIONS were done? Sue the builder and the city. Cost money to have moved there, purchased items, inconvenience. Everyone needs to get a lawyer for a Class Action Law Suit. Just shameful.
Maybe they tried a soundproofing floor material? Why else would the floor have dimples in it from sofa legs?
What happens when laborers replace actual carpenters and craftsman. Builders gotta pocket as much as possible. Screw the buyer.

In theory, but in practice, enforcement and penalties are lax. Most all issues are considered civil. Criminal charges are rare and convictions even rarer yet. It's easy for contractors to close down and reopen under a new name. Generally, shell companies with little to no assets. Everything leased and financed. Might only own some tools and heavily worn vehicles. Nothing of value that would be worth suing for. There's really no one watching out for consumers. Other than maybe the bank if one gets a builder's loan to construct a new home.
First the building code enforcement should have never passed the construction. The builder should be fined the state who passed the construction as safe should be fined also. Just more designed obsolescence.

@@robertruge2916 regardless of thickness or hardness, the small pressure point of the furniture leg can cause indent damage. Solution, larger furniture pressure points.
I think the foam underlayment is not dense enough and goes flat easily, leaving the cheap vinyl flooring unsupported.
I've seen cheap vinyl flooring put down in a casino on concrete. Didn't last a year and it was all buckled and coming up. Should be removed from the market

Just looking at the pictures, this does not look like a structural issue. It looks like another failure of LVP flooring. They call it “luxury vinyl plank” but it’s honestly a garbage product. They are having issues and are likely getting the floors replaced under warranty.

It is not a structural issue. It is a sound proofing that was laid down and is causing the problem. Not the end of the world

Disgusting. Sinking floors in general and in a multilevel building clearly represents a safety hazard. The floor could collapse resulting in danger to the tenant below and tenant above. I’d think collapsing floors could negatively impact the building foundation or be the result of a poor foundation. Inside the home, once could trip and fall. If one is in a wheelchair or walking using crutches or a walker, then that person’s mobility would be compromised, too. That building is a safety hazard.

At the speed these appartment complexes are built, it’s not surprising issues like these develop with shoddy construction, yet, they want premium money for them.

Likely soundproofing material. The underlying structure is fine. If it wasn't, the building would have been condemned and residents forced out immediately. 1st floor residents have little to worry about other than construction going on, including noise and vibration.

I believe, the owner knew about the issue, but decided to make money off tenants; in order to repair at a bigger cost. Lets get them in, and kick them out, when we get enough money to fix the problem....then raise the rent for the new tenants. No way, they did not see floor issues.

Bring the builder to justice
Lawsuit against the apartment complex for moving costs and related expenses. Costs money to hire an attorney, but still likely worthwhile. Not going to be a windfall, but even getting a few thousand makes it worth it. Alternatively, taking the apartment complex deal. Not overly appealing, but worth another look. Easy to let emotions get in the way of a business decision.

That's a cheap click vinyl plank. If you lay a floating floor like that it needs to be self leveled first. And all furniture should have felt pads under their feet. Loose lay vinyl planks are the way to go. Glued down.
But there are laws to support the residents, and that got clearly skipped over. Not giving them their money back or other living accommodations means YOU failed too. We have no justice system, just a capitalism system

That's what happens when the building contractor speaks English and the workers speak Spanish.
Hispanic workers are responsible for a great deal of new construction in this country and they build with the materials and specs they’re given, though I suppose they’re an easy target to make scapegoats in this. How about blaming the BUILDERS who made the choices they did to use cheap materials and cheap design to save costs to maximize profit? I would never rent an apartment or buy a condo in a building with wooden frame construction. Not only is it weaker but I can imagine the noise. In metro Chicago they use a lot of Flexicore construction which are concrete panels between floors, and they’re much stronger and highly soundproof. The issue is cheap builders who bring this stuff up quickly with cheap materials, and they’re the ones who should be held accountable. Blaming workers for bad design and cost decisions is not fair.

Unfortunately the law does not hold them accountable for what should be a common law principle of an implied contract. Imagine people that cannot afford to move again, what do they do? But Company doesn’t care because it’s too difficult to fight them legally, and even if you can fight them legally by hiring a lawyer the lot most likely is not on their side.

Doubt any attorneys are chasing this one. It's a contractual dispute. Damages likely limited to deposit, prepaid rent, and moving costs. Not an injury case with pain and suffering, current and future loss of income, etc. Could be wrong, but just don't see it happening. The residents deserve more, but the legal system likely won't allow for it.
