As soon as I've started the meeting, the counselor right off the bat just told me that SE is very hard to get, almost impossible to obtain, but I just went through the evaluation process today and honestly, I thought I wasn't gonna pass but I did!!! They called me a few hrs after to give me the good news that they will accept me into the Self Employment program. Yayyy thanks for all the advice Nicthevet!

The beauty of the entire channel, is the program paid for her education, then bought her the equipment for self employment, making her fight for it every step of the way, and now she uses that education and equipment, and the knowledge she learned fighting for it, to make money on TH-cam teaching vets how to get the benefits the VA doesn’t want to give us.

I am currently working with a Counselor in Voc Rehab. I am trying to finish my degree and need one more semester to finish. This month I started my own IT company. While talking to my counselor I told her that I started my own company and told her what I was doing. She told me that her husband has ran his own IT company for the last 30 years, then went on to tell it that Voc Rehab can't help me with it because it is not sustainable. I’m a speech therapist in the school system and started an LLC last summer to start working with kids on the side. The long term plan was to quit the school job and start my own business while not knowing anything about the VRC SE benefit. I recently applied and my evaluation appt for SE is next week. I may have unknowingly created a huge barrier to the SE track because I started the LLC before applying for VRC SE. Wish me luck.
They may say you straight up cant get approved if you already started a business but thats not exactly true. If there are barriers whereby that SE role now affects your scd's negatively then you can still be approved and get those accommodations and equipment but the issue presented in your interview must be accommodations or equipment to lessen your scd exacerbation NOT lack of business or career growth.
Would the $35,000 limit still apply for an existing business if I was found entitled? The LLC has only been a side hustle that started less than 12 months ago and I saw something in the regs that said something about it having to be a sustainable business, which it is not currently. I currently work in the public schools full time and already resigned, effective end of May 2023 due to my SCD and nonSCDs. I don’t mind starting a new LLC if it would mean more access to funding. @@USA4Soldier please review the SE section of the m28c at M28C.IV.C.5, this is for YOU so you need to understand your rights and options. Maintaining an existing business is not considered self-employment, the limit is 25K for the VRC. If you need more than 25k, the higher ups have to approve it.

The self-employment track will not teach you how to be a filmmaker, they will only help you create the business entity and give you equipment to start the business. You need to know how to be a filmmaker on your own. You may want to consider long-term services and get the degree and then switch to self-employment like I did.

I found this after my initial meeting yesterday. Pros : I was found eligible for benefits. Cons: I kept mentioning se after her recommendations of jobs and using my degree she would say va won't help buy stuff for startup but check out SBA boots 2 business.. I will hit next meeting with extensive business plan. And not back down ptsd makes working and tolerating working for others unbearable. How do you handle a council who's been working for va less than a year and really doesn't know about se track?

Thank you thank you thank you. Your advice is invaluable! My initial appointment was today 3pm CT…I was entitled without any path. My situation is a little different than most that i have seen. Hopefully you can help me to move forward. I am T&P 100% not unemployable but I’m unemployed and not able to work. I am requesting SE track but right off the back was told that in over her 20yrs of working for the VA, she has never seen it approved. She wants me to get my Psychiatrist to revoke my 2016 rating so that I can work. She wants a letter saying that I can work. And she does not want a work therapy letter. I explained that I am unable to work and that would be harmful for me. I am a cottage baker. I bake out of my home for side money. She said they will not buy me any commercial equipment and that I have to apply for a loan somewhere. How do I past this? Next appointment is in October and was told I have homework to turn in to her before the appointment. She also said they only do accommodations. Could you please help!
You're P&T which means you are allowed to work - what do you mean when you say you can't work? And did you tell them you can't work? Because if you did and then you turned around and said you want them to help you start a business, that is why she's asking you for all that stuff. @@iamnicthevet I understand. How should I put it? Im not able to work outside of my home because of PTSD, MST, MDD, Migraines & Insomnia, so I work from my home. I have a SEH. I could not even finish college because my disabilities interfered with studying. I just received Vocational Explorational paperwork to find 3 careers to go after. Is this just a formality to get to the SE track or a detour? The counselor read my file to me and knows of my SEH so Im not sure how Vocational Exploration would help me? When I tried to ask my counselor a question about SE track I was advised to google it…
This was really useful thanks! I really like the reg references. I just went from 20% sc to 100% p&t in about a year by familiarizing myself with the regs related to my conditions and previous related bva decisions. I have years of experience and a plan but there are two specific coding boot camps I'd like to take that are specifically related to my business plan. Would it be better to ask for the boot camps and then try to switch to self employment or just start off with self employment and explain why they are needed?

I told my counselor since the first meeting online. She stated that I just need to do the employment track for now and to submit job postings just to start. I have been reminder her a few times through email and she stated that I should focus in on getting the degree done then we can move on from there. I am about to graduate, I have my business plan ready, a signed up for a business page on several different social media platforms, I have the equipment needed to go professional, and I have clients lined up. She told me that she can't put me on it due to me being Individual Unemployability which the VA stated I qualified for it and put me under it. I told her that I can work while under that as long as it is in a protected environment such as self-employment or family business, which I could do either one because my wife has a media business also. I told her about my Wifes' business that I can work there and still said that I need to go through Small Business Association. I told her no and explained that I told her what I wanted to do, that she pushed me into do the employment track, and she never informed me that I could try for the Self Employment Track. What do I do now?
It kind of sounds like they paid for your degree and now you wanna switch to self-employment and they told you no because you're IU, is that what you're saying?
@@iamnicthevet I originally wanted to have my own business because of my IU but my counselor never told me about the self employment track she just pushed me into employment track to "Get Started" then I had to do research and watched your videos a year later due to her not assisting me according to the guidelines. When I found out about the self employment track I brought it up and she said lets get through training first. I reminded her several times that I wanted to have my own business due to my IU and because it is something I love to do.
@@johnbriseno4286 they don't care about what you love, they ONLY care whether or not you currently have the education and training to find work that does not exacerbate your SCDs. If you do, they wont approve SE, if you don't, they will approve it IF you present it close to what I advised in video #34. If you're trying to get approved based on what you told her before you got your degree, forget it, that's over, and they're not gonna go back. Now you have to qualify for SE based on the criteria I advised of in video #34.

My counselor not only denied me, but submitted a VR-58 with reasoning that is nowhere to be found in M28C. He and his supervisor are now saying the only option I have is to go through the appeals process. Also, that speaking to the Assistant regional director won’t help because she can’t change anything after the form has been submitted. I’m at a loss, do I just stop dealing with them and prepare to appeal?
It's hard to say because I don't know what you communicated to them and you're just giving me the end result. I feel like there's a backstory here that would bring more clarity. However, to answer your specific question, per video #31, I don't support appeals. I find them to be a waste of time because if you meet the criteria at all, you meet it today and shouldn't have to wait a year or two to get what you want and if you don't meet the criteria today, then it doesn't matter if you appeal because you're not going to get it.
Do you bring up possible self-employment at the initial meeting if you need to start with Employment Through Long Term Services? I don't have any degrees except a cert from massage school. Looking to go to Chiropractor school and undergrad but eventually would like my own office and work for myself to make my own schedule after I become licensed.

It's no different from anything I've already put out there. First watch video #25. If you want a masters it's video #15 and #37, if you want self-employment it's video #34 and if you want ILP it's #33. I also suggest you watch the entire entitlement playlist, it will make your more prepared.
Great information here!! I’ve started taking a deeper dive into the regulations. Question: I currently work and have a degree, but my injuries are exacerbated by work. I’m looking to go the self employment route to open my own food truck. Former cook in the military so I have the training and experience and my degree is in business. Questions: Is the route achievable? Is subsistence allowance the only thing paid while in the program minus the equipment and things you can get through the program?
1. The fact that your job exacerbates your SCDs is not enough to get you approved for self-employment 2. You have to convince them that you can't work in the normal workforce because of your SCDs, so consequently self-employment is the ONLY feasible option that you have. 3. They cannot give you a vehicle of any sort but if you have the vehicle and you just need the stove & other equipment that goes inside, they can help you with that. 4. Whether or not it's achievable is based on your presentation and circumstance. The first thing they're gonna look at is the physicality of that job; standing on your feet all day, humped over a lot of times (depending on your height, weight & the size of your truck), being in that heat all day if your truck is old, etc. So if any of your SCDs will contradict those types of repetitive actions, you're gonna have pushback but if your SCDs are all mental health related (for example), then it probably could work if that's the type of work that soothes your SCD's. 5. They can give you EAA, subsistence allowance, RFL but not money to start or run your business.

No, I have the decision letter stating the denial because it was my caseworker's first time processing someone for the self-employment track she when to her supervisor and they both went over the paperwork before sending it to EDC. My caseworker told me that both she and her supervisor feel that I should appeal Washington's decision. I don't know if it is because of the amount they were trying to get me or what, however, neither of them said anything about needing a business plan before sending it to Washington DC. that said I would need one during the process before funds would be advocated. How should I proceed from this point?
I have no idea because none of this makes any sense. The VRC and the VREO do not send your entitlement application to DC. Sending it to DC is a higher level review or an appeal. The vrc would've had to have denied you in order to send it to DC and you would've had to agree to have it sent. For them to tell you that DC denied it and you need to appeal doesn't make any sense because that's not how it works. On top of that, they make your entitlement decision. So if you're saying they approved your entitlement but DC denied self-employment, that still doesn't make any sense because your VREO would be the one to approve it. If your VRC approved you for entitlement and approved you for self-employment but then DC denied the amount, that would make sense but the amount would have to be over $50,000. I think they lied to you or else you're missing part of the story...so I don't really know what to tell you.

@@jonbroadnaxsr.4743 I don't know anything about your history, your case, why it was closed, if you're even entitled, or if what you asked for is allowable or even feasible so I have no idea what you should do, plus, it does not take a year to figure out if you should get SE approved, the VREO can do it in ONE day. It's illogical that they've been “trying to get it approved” for a year, either they lied to you or you are leaving out a huge chunk of the story. This whole scenario makes no sense to me so I can't give you any advice. If you want to, you can email me directly or you can private message me on Facebook and fill in all the gaps. If you email me, the first thing I'm going to need to know is the following What track were you approved for? What have you been doing for a year? What did you request from them as far as SE? What have you gotten from them during the year that you were waiting? Were you in IEEP during that time? If so did you receive any BAH or a stipend? When were you denied? Did you request a copy of your file from your VRC? If you didn’t, do that ASAP so you can understand exactly what transpired. You can email your VRC, the VREO or the VR&E office for your region and they will mail it to you or you can request that they hold it and you can go pick it up.

If you looked at video #34 you know I did that exact thing and I'm telling you I know at least 10 other veterans who did it after me so, no, it's not "off", its a complete lie.

Hi, they did not give me $25,000 for equipment, they purchase $25,000 worth of equipment (they can't give you money). Video #40 tells you how to request it, you just tell him you need it in order to reach your goal, you justify why you need it, and then you argue that you can have it based on the guidelines.
if you take some training while going through SE then yes. But if you’re just getting help starting a business then no. but you do get the four months of EAA at the end Of your track.

@@computervisiondev In accordance with 38 CFR 21.260, VR&E requires the use of BAH national average rate for VR&E claimants pursing training in an institution with no assigned zip code, including foreign institutions. VR&E provides 50 percent of the BAH national average rate for claimants pursing training solely online based on their rate of training. For claimants pursing in-home training, including independent instructor, must receive 50 percent of the full-time BAH national average rate regardless of rate of pursuit. However, If you have at least one class at a brick and mortar but all other classes are on line, you'll get full BAH. If you're all online due to COVID, you will get full BAH.
I know this is an old video, but I just asked my counselor if I could switch to self employment track after graduation. He told me that isn't possible because in the beginning of school I decided to do the education track. It sounds like your counselor let you do that. If so, how did you ask? 1. Your VRC is lying. He can approve it IF it makes sense to him. He denied it because the way you presented it is illogical. You simply asking him for it before you even graduated is a guaranteed denial. 2. What I mentioned in video #34 is that you should not simply just ask for it because they're not going to give it to you. The way I did it, and the way that it would best be presented is if you wait until after you graduate. Once they try to put you in job ready status, that’s when you present issues that are keeping you from actually being job ready. And then, if you have a situation whereby it makes sense to allow you to switch then you present it, argue for it and they will approve it but you will never ever get it simply by asking for it. Also, my VRC did not “allow it” per say, I aggressively convinced them that it was the ONLY way that I would obtain suitable employment. Everyone will not fit that scenario whereby you can explain it that way. I gave you details regarding my situation and why it was doable but it had nothing to do with the VRC allowing it, they fought it big-time. But because it was feasible, and it made sense and my presentation was sound and I was persistent, they almost had to approved it. If you don't have a logical justification for needing to switch to self-employment after you finish your degree, they're not going to approve it. I can't simply be because you want to. The justification will need to be based around the fact that some unforeseen situation has arisen whereby the degree in and of itself is not enough in order for you to obtain suitable employment. I suggest you rewatch episode #34 in it's entirety and then, if you have any specific questions that were not addressed there, feel free to follow up with me.

You only get monthly compensation w/ SE if you're in an education program. You can get it during self-employment if they also approve you to take some type of reasonably long-term class. But that's pretty rare and I wouldn't count on it honestly
@@ameerskater no lump, no grant, you just get the supplies you need, licensing fees paid/reimbursed, equipment etc. I got about 30 things over a 2 year period. As the need arose, I requested what I needed.

I want to try Self-employed Track. I think I am qualified for ILP but I will like to give S.E.T. a chance. If I choose SE and fail can I switch to ILP? Thank you for explaining this for none bureaucrats like myself.
Yes, but don’t look at it as a simple switch, they will fight you all along the way so remember if you find yourself failing on the self-employment side because of you service connected disability, you have to present ILP per video #33 as an option. But generally, yes you can switch.
Hey Nic, I was recently found eligible and entitled and in the process of switching over from the gi bill but they are putting me on the long term employment track so i can finish school, although I my ultimate goal would be to be self employed and run my own production company could I switch over to the self employment track once I have graduated? I will still have about 39 months left of the benefits by the time I gradúate with my bachelors.
sure, thats what i did. make sure you thoroughly understand video # 34 so you see and understand the best way to execute that request. It’s not guaranteed that they will approve it but if you present it the way I suggested then you should be OK.
Well, my counselor basically said he’s going to deny me because I want to go the self employment track and gave me a reason that says in the regulations I need to have a Business already operational for at least a year to even be considered. I read it and thats just a step in the evaluation process not a requirement. Or am I wrong?
I’m sorry you’ve had so much trouble but I’m not sure how to help you because you have done and said a lot that contradicts what I suggest in the SE video. You don’t have to ever do what I suggest but if you execute half of it, and then wing it on the other half,I can’t really help you undo that. unfortunately I just don’t have the time to invest in situations like that. My suggestion would be to educate yourself and then start again. You can’t get SE simply because you can’t do your previous job. And you cant simply request to switch to SE after a degree. One of the biggest issues I saw was that you shared with your VRC that you wanted SE AND a degree which is a big no no. Per the video, you never tell them you want SE AND a degree, there’s strategy to all of this. As for the SE path being denied, your VRC lied to you, you don’t have to have a business in order to be approved. The guidelines are listed in the SE video

@@brandonmatthews4112 You said you were transferring your degree from G.I. Bill to Voc Rehab so that means you were going to do a degree. Listen, it really doesn’t matter at this point you’re gonna have to understand where you are and decide how you want to move forward. A lot of the stuff was convoluted and I was getting half of this and half of that. You’re gonna have to buckle down and figure out if this is something that you really want. You have to stop listening to what he says and instead you need to educate yourself and understand how the program works so you can tell him what you want and you can correct HIM when he tells you lies. I realize it’s frustrating complicated but I explained from the very beginning that this is not a joke. Nobody is standing in line waiting to give you $100,000 worth of education and equipment and BAH. Unfortunately they’re lined up to deny you so you have to equip yourself so you can get what you want.

My appointment is in 5 days and im still not sure how to word my SE. I was a diesel mechanic for 13yrs but want to start my own salon as a cosmetologist with specialities that are prominent in the AA hair community that arent included in school. Just take a deep breath, follow the plan and start at the beginning - video # 16 tells you whether not you're entitled, Video # 25 tells you what to do when you first speak to the VRC, video #34 tells you how to present your plan for self employment. I laid out a step-by-step list of what you should do in this very video. Which part of that is confusing to you?
I just got an MBA with a concentration in marketing. Took me 3 years to get it finally and I want to start my own lawn care company. My counselor stated this….”Yes due to you completing your training under the MBA program you can obtain suitable employment that doesn’t aggravate your service connected disabilities in the field”. I feel that she just doesn’t want to deal with it. She said she can’t change the track I’m on. I think it’s BS
Not BS at all. From their perspective it's not feasible that they'd help you start a lawn care business after they JUST paid for an MBA ...unless they initially agreed that the MBA was preparation for the lawn care endeavor.
I’m a student already in biology, I am hoping to get an associates in biology and hopefully get continue to get my bachelors in agriculture science.. my goal was to get my degree and start my own ranch, will they help me do both? If so will they pay for equipment, cattle, or land and structures?
So you’re asking for 2 degrees and self-employment…..of course it is possible but you’ll have to meet all the parameters that I mentioned in the video. Also the M28C limitation guidelines are listed in the same video
I'm 100% P&T and they tried to say I couldn't do self employment because I want to do a CBD nursery. I live in Michigan where dope is completely legal on every corner. I am prepare to fight this until the end. If they can approve chiropractic school, then can approve a simple nursery.
Unfortunately, your endeavor is fruitless 😕. They're not going to approve your desired goal. Chiropractic is perfectly legal in every capacity and has never been illegal, however, under M28C.iv.C.2, 2.0 3 g Prohibited Goods and Services, it clearly states "provision of goods and services as well as rehabilitation goals related to the medical marijuana or a legalized recreational substance industry is prohibited". They still should've evaluated you to see if you fit the self-employment criteria because if you do, you just would've had to come up with a different desired goal.
I wish I found her sooner so I could talk to her. 😕 I need to know if you can go from ILP to another track? I can’t get answers. My counselor is new and keeps telling me he’ll get back to me.
There is no rule that says you cannot go from ILP to a working track. You just have to use logic and common sense when attempting to argue your case. If you applied for SSDI or you applied for IU and you already told VA you cannot work or if you are 100% PTSD and you told someone you can’t work when you applied for the 100% then you have to take that into consideration. But if you never apply for anything within VA by stating that you cannot work and your VRC simply decided you cannot work then you can present evidence that you can work and request that they take you out of ILP and put you into a working track.
Nic, I messed up. I got on the phone with the person, I explained what was going on, they said "I'm ending the conversation and you'll receive my decision by the end of the day" and she just hung up. She asked for my resume and my transcripts, which I told her wasn't required by the law, and I still messed up by sending my resume. I'm disappointed. She asked if I would be able to find employment comparable to my current employment with a law degree I said yes. IDK if that was a shot in the foot. I'm an engineer and I told her I wanted to go to law school. I was given a rejection without rebuttal and just pretty much told no, for no reason.

Hello, Going over the 3 categories that you need to have. I’ll be starting barber school next month and want to open up a barber shop either during my training or after my completion. Would that be enough evidence for me to apply for self employment or should I give it some time as I get more experienced in the field?
I don't actually understand either of your questions. Video #34 tells you how to meet the criteria for self-employment. If you have watched the video and you have a question regarding something I stated or did not address, please clarify your question.

I’ve read online that vr&e wouldn’t help with funding a truck. I want to start a Hot-shot business. I was a truck driver in the army for 5 year’s and I meet all the requirements for vr&e self-employment. Is there anything I can do about this before I waste my time.

Once you are approved for VR&E AND approved for SE AND your vocational goal is approved AND your business plan is approved AND your equipment is approved, you'll get it. Whether that's before your training or after is between you and your VRC. It can go either way depending on when you need it in order to complete your vocational goal and how well you justify it. If you have hypotheticals, I suggest you read the M28C SE guides I reference in this video.

Can you get self employment if you know what business you want specifically? It’s a franchise program, it’s a business in a box so to speak. They do all of your marketing and back end administration for you. The services are providing loans and marketing for other businesses. You pay up front for a lifetime of services, full website management, and a staff of employees for life. But it’s not a “business plan” I would make up out of thin air, it’s an established franchise program.
This is the real deal guys!!! As soon as I've started the meeting, the counselor right off the bat just told me that SE is very hard to get, almost impossible to obtain, but I just went through the evaluation process today and honestly, I thought I wasn't gonna pass but I did!!! They called me a few hrs after to give me the good news that they will accept me into the Self Employment program. Yayyy thanks for all the advice Nicthevet!

I am currently working with a Counselor in Voc Rehab. I am trying to finish my degree and need one more semester to finish. This month I started my own IT company. While talking to my counselor I told her that I started my own company and told her what I was doing. She told me that her husband has ran his own IT company for the last 30 years, then went on to tell it that Voc Rehab can't help me with it because it is not sustainable. I’m a speech therapist in the school system and started an LLC last summer to start working with kids on the side. The long term plan was to quit the school job and start my own business while not knowing anything about the VRC SE benefit. I recently applied and my evaluation appt for SE is next week. I may have unknowingly created a huge barrier to the SE track because I started the LLC before applying for VRC SE. Wish me luck.
They may say you straight up cant get approved if you already started a business but thats not exactly true. If there are barriers whereby that SE role now affects your scd's negatively then you can still be approved and get those accommodations and equipment but the issue presented in your interview must be accommodations or equipment to lessen your scd exacerbation NOT lack of business or career growth.
Would the $35,000 limit still apply for an existing business if I was found entitled? The LLC has only been a side hustle that started less than 12 months ago and I saw something in the regs that said something about it having to be a sustainable business, which it is not currently. I currently work in the public schools full time and already resigned, effective end of May 2023 due to my SCD and nonSCDs. I don’t mind starting a new LLC if it would mean more access to funding. Thanks for your time.
@@USA4Soldier please review the SE section of the m28c at M28C.IV.C.5, this is for YOU so you need to understand your rights and options. Maintaining an existing business is not considered self-employment, the limit is 25K for the VRC. If you need more than 25k, the higher ups have to approve it.

The self-employment track will not teach you how to be a filmmaker, they will only help you create the business entity and give you equipment to start the business. You need to know how to be a filmmaker on your own. You may want to consider long-term services and get the degree and then switch to self-employment like I did.

I found this after my initial meeting yesterday. Pros : I was found eligible for benefits. Cons: I kept mentioning se after her recommendations of jobs and using my degree she would say va won't help buy stuff for startup but check out SBA boots 2 business.. I will hit next meeting with extensive business plan. And not back down ptsd makes working and tolerating working for others unbearable. How do you handle a council who's been working for va less than a year and really doesn't know about se track?

Thank you thank you thank you. Your advice is invaluable! My initial appointment was today 3pm CT…I was entitled without any path. My situation is a little different than most that i have seen. Hopefully you can help me to move forward. I am T&P 100% not unemployable but I’m unemployed and not able to work. I am requesting SE track but right off the back was told that in over her 20yrs of working for the VA, she has never seen it approved. She wants me to get my Psychiatrist to revoke my 2016 rating so that I can work. She wants a letter saying that I can work. And she does not want a work therapy letter. I explained that I am unable to work and that would be harmful for me. I am a cottage baker. I bake out of my home for side money. She said they will not buy me any commercial equipment and that I have to apply for a loan somewhere. How do I past this? Next appointment is in October and was told I have homework to turn in to her before the appointment. She also said they only do accommodations. Could you please help!
You're P&T which means you are allowed to work - what do you mean when you say you can't work? And did you tell them you can't work? Because if you did and then you turned around and said you want them to help you start a business, that is why she's asking you for all that stuff. I could not even finish college because my disabilities interfered with studying. I just received Vocational Explorational paperwork to find 3 careers to go after. Is this just a formality to get to the SE track or a detour? The counselor read my file to me and knows of my SEH so Im not sure how Vocational Exploration would help me? When I tried to ask my counselor a question about SE track I was advised to google it…

I have years of experience and a plan but there are two specific coding boot camps I'd like to take that are specifically related to my business plan. Would it be better to ask for the boot camps and then try to switch to self employment or just start off with self employment and explain why they are needed?

I told my counselor since the first meeting online. She stated that I just need to do the employment track for now and to submit job postings just to start. I have been reminder her a few times through email and she stated that I should focus in on getting the degree done then we can move on from there. I am about to graduate, I have my business plan ready, a signed up for a business page on several different social media platforms, I have the equipment needed to go professional, and I have clients lined up. She told me that she can't put me on it due to me being Individual Unemployability which the VA stated I qualified for it and put me under it. I told her that I can work while under that as long as it is in a protected environment such as self-employment or family business, which I could do either one because my wife has a media business also. I told her about my Wifes' business that I can work there and still said that I need to go through Small Business Association. I told her no and explained that I told her what I wanted to do, that she pushed me into do the employment track, and she never informed me that I could try for the Self Employment Track. What do I do now?
It kind of sounds like they paid for your degree and now you wanna switch to self-employment and they told you no because you're IU, is that what you're saying?
@@iamnicthevet I originally wanted to have my own business because of my IU but my counselor never told me about the self employment track she just pushed me into employment track to "Get Started" then I had to do research and watched your videos a year later due to her not assisting me according to the guidelines. When I found out about the self employment track I brought it up and she said lets get through training first. I reminded her several times that I wanted to have my own business due to my IU and because it is something I love to do.
@@johnbriseno4286 they don't care about what you love, they ONLY care whether or not you currently have the education and training to find work that does not exacerbate your SCDs. If you do, they wont approve SE, if you don't, they will approve it IF you present it close to what I advised in video #34. If you're trying to get approved based on what you told her before you got your degree, forget it, that's over, and they're not gonna go back. Now you have to qualify for SE based on the criteria I advised of in video #34.

My counselor not only denied me, but submitted a VR-58 with reasoning that is nowhere to be found in M28C. He and his supervisor are now saying the only option I have is to go through the appeals process. Also, that speaking to the Assistant regional director won’t help because she can’t change anything after the form has been submitted. I’m at a loss, do I just stop dealing with them and prepare to appeal?
It's hard to say because I don't know what you communicated to them and you're just giving me the end result. I feel like there's a backstory here that would bring more clarity. However, to answer your specific question, per video #31, I don't support appeals. I find them to be a waste of time because if you meet the criteria at all, you meet it today and shouldn't have to wait a year or two to get what you want and if you don't meet the criteria today, then it doesn't matter if you appeal because you're not going to get it.
Do you bring up possible self-employment at the initial meeting if you need to start with Employment Through Long Term Services? I don't have any degrees except a cert from massage school. Looking to go to Chiropractor school and undergrad but eventually would like my own office and work for myself to make my own schedule after I become licensed.

It's no different from anything I've already put out there. First watch video #25. If you want a masters it's video #15 and #37, if you want self-employment it's video #34 and if you want ILP it's #33. I also suggest you watch the entire entitlement playlist, it will make your more prepared.
Great information here!! I’ve started taking a deeper dive into the regulations. Question: I currently work and have a degree, but my injuries are exacerbated by work. I’m looking to go the self employment route to open my own food truck. Former cook in the military so I have the training and experience and my degree is in business.
Questions: Is the route achievable?
Is subsistence allowance the only thing paid while in the program minus the equipment and things you can get through the program?
1. The fact that your job exacerbates your SCDs is not enough to get you approved for self-employment
2. You have to convince them that you can't work in the normal workforce because of your SCDs, so consequently self-employment is the ONLY feasible option that you have.
3. They cannot give you a vehicle of any sort but if you have the vehicle and you just need the stove & other equipment that goes inside, they can help you with that.
4. Whether or not it's achievable is based on your presentation and circumstance. The first thing they're gonna look at is the physicality of that job; standing on your feet all day, humped over a lot of times (depending on your height, weight & the size of your truck), being in that heat all day if your truck is old, etc. So if any of your SCDs will contradict those types of repetitive actions, you're gonna have pushback but if your SCDs are all mental health related (for example), then it probably could work if that's the type of work that soothes your SCD's.
5. They can give you EAA, subsistence allowance, RFL but not money to start or run your business.

No, I have the decision letter stating the denial because it was my caseworker's first time processing someone for the self-employment track she when to her supervisor and they both went over the paperwork before sending it to EDC. My caseworker told me that both she and her supervisor feel that I should appeal Washington's decision. I don't know if it is because of the amount they were trying to get me or what, however, neither of them said anything about needing a business plan before sending it to Washington DC. that said I would need one during the process before funds would be advocated. How should I proceed from this point?
I have no idea because none of this makes any sense. The VRC and the VREO do not send your entitlement application to DC. Sending it to DC is a higher level review or an appeal. The vrc would've had to have denied you in order to send it to DC and you would've had to agree to have it sent. For them to tell you that DC denied it and you need to appeal doesn't make any sense because that's not how it works. On top of that, they make your entitlement decision. So if you're saying they approved your entitlement but DC denied self-employment, that still doesn't make any sense because your VREO would be the one to approve it. If your VRC approved you for entitlement and approved you for self-employment but then DC denied the amount, that would make sense but the amount would have to be over $50,000. I think they lied to you or else you're missing part of the story...so I don't really know what to tell you.

@@jonbroadnaxsr.4743 I don't know anything about your history, your case, why it was closed, if you're even entitled, or if what you asked for is allowable or even feasible so I have no idea what you should do, plus, it does not take a year to figure out if you should get SE approved, the VREO can do it in ONE day. It's illogical that they've been “trying to get it approved” for a year, either they lied to you or you are leaving out a huge chunk of the story.
This whole scenario makes no sense to me so I can't give you any advice.

Did you request a copy of your file from your VRC? If you didn’t, do that ASAP so you can understand exactly what transpired. You can email your VRC, the VREO or the VR&E office for your region and they will mail it to you or you can request that they hold it and you can go pick it up.

🔥 Great video. My counselor told me you have to complete the education track, move into job ready status, fail at finding a job, and start a brand new application with a new counselor. That it’s the only way to switch to the self employment track. Does that sound off?
If you looked at video #34 you know I did that exact thing and I'm telling you I know at least 10 other veterans who did it after me so, no, it's not "off", its a complete lie.

Hi, they did not give me $25,000 for equipment, they purchase $25,000 worth of equipment (they can't give you money). Video #40 tells you how to request it, you just tell him you need it in order to reach your goal, you justify why you need it, and then you argue that you can have it based on the guidelines.

if you take some training while going through SE then yes. But if you’re just getting help starting a business then no. but you do get the four months of EAA at the end Of your track.

@@computervisiondev In accordance with 38 CFR 21.260, VR&E requires the use of BAH national average rate for VR&E claimants pursing training in an institution with no assigned zip code, including foreign institutions.
VR&E provides 50 percent of the BAH national average rate for claimants pursing training solely online based on their rate of training. For claimants pursing in-home training, including independent instructor, must receive 50 percent of the full-time BAH national average rate regardless of rate of pursuit.
However, If you have at least one class at a brick and mortar but all other classes are on line, you'll get full BAH. If you're all online due to COVID, you will get full BAH.
I know this is an old video, but I just asked my counselor if I could switch to self employment track after graduation. He told me that isn't possible because in the beginning of school I decided to do the education track. It sounds like your counselor let you do that. If so, how did you ask? 1. Your VRC is lying. He can approve it IF it makes sense to him. He denied it because the way you presented it is illogical. You simply asking him for it before you even graduated is a guaranteed denial.
2. What I mentioned in video #34 is that you should not simply just ask for it because they're not going to give it to you. The way I did it, and the way that it would best be presented is if you wait until after you graduate. Once they try to put you in job ready status, that’s when you present issues that are keeping you from actually being job ready. And then, if you have a situation whereby it makes sense to allow you to switch then you present it, argue for it and they will approve it but you will never ever get it simply by asking for it.
Also, my VRC did not “allow it” per say, I aggressively convinced them that it was the ONLY way that I would obtain suitable employment. Everyone will not fit that scenario whereby you can explain it that way. I gave you details regarding my situation and why it was doable but it had nothing to do with the VRC allowing it, they fought it big-time. But because it was feasible, and it made sense and my presentation was sound and I was persistent, they almost had to approved it.
If you don't have a logical justification for needing to switch to self-employment after you finish your degree, they're not going to approve it. I can't simply be because you want to. The justification will need to be based around the fact that some unforeseen situation has arisen whereby the degree in and of itself is not enough in order for you to obtain suitable employment.
I suggest you rewatch episode #34 in it's entirety and then, if you have any specific questions that were not addressed there, feel free to follow up with me.

You only get monthly compensation w/ SE if you're in an education program. You can get it during self-employment if they also approve you to take some type of reasonably long-term class. But that's pretty rare and I wouldn't count on it honestly

Yes, but don’t look at it as a simple switch, they will fight you all along the way so remember if you find yourself failing on the self-employment side because of you service connected disability, you have to present ILP per video #33 as an option. But generally, yes you can switch.

sure, thats what i did. make sure you thoroughly understand video # 34 so you see and understand the best way to execute that request. It’s not guaranteed that they will approve it but if you present it the way I suggested then you should be OK.
Well, my counselor basically said he’s going to deny me because I want to go the self employment track and gave me a reason that says in the regulations I need to have a Business already operational for at least a year to even be considered. I read it and thats just a step in the evaluation process not a requirement. Or am I wrong?
I’m sorry you’ve had so much trouble but I’m not sure how to help you because you have done and said a lot that contradicts what I suggest in the SE video. You don’t have to ever do what I suggest but if you execute half of it, and then wing it on the other half,I can’t really help you undo that. unfortunately I just don’t have the time to invest in situations like that. My suggestion would be to educate yourself and then start again. You can’t get SE simply because you can’t do your previous job. And you cant simply request to switch to SE after a degree. One of the biggest issues I saw was that you shared with your VRC that you wanted SE AND a degree which is a big no no. Per the video, you never tell them you want SE AND a degree, there’s strategy to all of this. As for the SE path being denied, your VRC lied to you, you don’t have to have a business in order to be approved. The guidelines are listed in the SE video

Listen, it really doesn’t matter at this point you’re gonna have to understand where you are and decide how you want to move forward. A lot of the stuff was convoluted and I was getting half of this and half of that. You’re gonna have to buckle down and figure out if this is something that you really want. You have to stop listening to what he says and instead you need to educate yourself and understand how the program works so you can tell him what you want and you can correct HIM when he tells you lies. I realize it’s frustrating complicated but I explained from the very beginning that this is not a joke. Nobody is standing in line waiting to give you $100,000 worth of education and equipment and BAH. Unfortunately they’re lined up to deny you so you have to equip yourself so you can get what you want.

My appointment is in 5 days and im still not sure how to word my SE. I was a diesel mechanic for 13yrs but want to start my own salon as a cosmetologist with specialities that are prominent in the AA hair community that arent included in school. Im a licensed braider but need classes for lace wig making and locs. The stylists run legit businesses but are not qualified for govt funding. What do I do?
Just take a deep breath, follow the plan and start at the beginning - video # 16 tells you whether not you're entitled, Video # 25 tells you what to do when you first speak to the VRC, video #34 tells you how to present your plan for self employment. I laid out a step-by-step list of what you should do in this very video. Which part of that is confusing to you?
I just got an MBA with a concentration in marketing. Took me 3 years to get it finally and I want to start my own lawn care company. My counselor stated this….”Yes due to you completing your training under the MBA program you can obtain suitable employment that doesn’t aggravate your service connected disabilities in the field”. Not BS at all. From their perspective it's not feasible that they'd help you start a lawn care business after they JUST paid for an MBA ...unless they initially agreed that the MBA was preparation for the lawn care endeavor.

So you’re asking for 2 degrees and self-employment…..of course it is possible but you’ll have to meet all the parameters that I mentioned in the video. Also the M28C limitation guidelines are listed in the same video
I'm 100% P&T and they tried to say I couldn't do self employment because I want to do a CBD nursery. I live in Michigan where dope is completely legal on every corner. I am prepare to fight this until the end. If they can approve chiropractic school, then can approve a simple nursery.
Unfortunately, your endeavor is fruitless 😕. They're not going to approve your desired goal. Chiropractic is perfectly legal in every capacity and has never been illegal, however, under M28C.iv.C.2, 2.0 3 g Prohibited Goods and Services, it clearly states "provision of goods and services as well as rehabilitation goals related to the medical marijuana or a legalized recreational substance industry is prohibited". They still should've evaluated you to see if you fit the self-employment criteria because if you do, you just would've had to come up with a different desired goal.
It's a Federal law, which supercedes State law....

There is no rule that says you cannot go from ILP to a working track. You just have to use logic and common sense when attempting to argue your case. If you applied for SSDI or you applied for IU and you already told VA you cannot work or if you are 100% PTSD and you told someone you can’t work when you applied for the 100% then you have to take that into consideration. But if you never apply for anything within VA by stating that you cannot work and your VRC simply decided you cannot work then you can present evidence that you can work and request that they take you out of ILP and put you into a working track.
Nic, I messed up. I got on the phone with the person, I explained what was going on, they said "I'm ending the conversation and you'll receive my decision by the end of the day" and she just hung up.
She asked for my resume and my transcripts, which I told her wasn't required by the law, and I still messed up by sending my resume. I'm disappointed.
She asked if I would be able to find employment comparable to my current employment with a law degree I said yes. IDK if that was a shot in the foot.
I'm an engineer and I told her I wanted to go to law school. I was given a rejection without rebuttal and just pretty much told no, for no reason.
Seems like there's a lot of information missing so I'm not sure what your question is. Don't fret, if you messed up, get educated and reapply.

I have epilepsy and struggled a lot with maintaining set work hours because I am prone to seizures if I dont get enough sleep (and I have sleep problems). So waking up early for a job everyday puts me at high risk. Plus i have mental health issues

Once you are approved for VR&E AND approved for SE AND your vocational goal is approved AND your business plan is approved AND your equipment is approved, you'll get it. Whether that's before your training or after is between you and your VRC. It can go either way depending on when you need it in order to complete your vocational goal and how well you justify it. If you have hypotheticals, I suggest you read the M28C SE guides I reference in this video.

Can you get self employment if you know what business you want specifically? It’s a franchise program, it’s a business in a box so to speak. They do all of your marketing and back end administration for you. The services are providing loans and marketing for other businesses. You pay up front for a lifetime of services, full website management, and a staff of employees for life. But it’s not a “business plan” I would make up out of thin air, it’s an established franchise program.
You can't get a franchise, please review the parameters of SE per the guidelines listed in the video.
