My father died about a month ago and I requested to expedite my AP so I can be there for my family. They denied it saying it's not urgent. I was gonna get upset, but then they approved my EAD expedite request instead so at least there's that! I waited 71 days for my EAD to be approved. Hope my AP will follow sooner. I applied April 22 and they received it April 25th..on May 6 I received notice for biometrics for June 3rd. So now it says my case is being actively reviewed so fingers crossed and waiting.

Definitely try to contact uscis and ask them what’s going on about your employment authorization and that you’ve been waiting. Nobody should have to wait to work. Everyone who is given a visa to be in the U.S. should automatically be given a work permit that valid for as long as they are authorized to be in the country!

Hello, you can certainly try to expedite but again it has to be an extreme circumstance. In addition, I am not aware of being able to file concurrently for somebody outside the U.S. I-485 is for inside applicants only. Unless they maybe already have a valid visa and were temporarily visiting overseas. 🤷🏻♀️ not sure

My sister just got I-130 approved and she is currently in the states. We are about to fill out I-485 but I also wanted to submit I-765 with it. I am confused as to what we should write on page 3 questions 27 - Eligibility Category. I went through a list of all categories and I did not see anything for Family-based sibling category. Would you please assist?
@@KseniyaInternational We got I-797 Notice saying that I-130 was approved but that USCIS retained the petition because we didn't indicate on the petition if she was intending to apply abroad or in the U.S. And typically, once I-130 gets approved, USCIS sends it to NVC for processing further. But they retained it...The next paragraph states: "If the beneficiary intends to apply for adjustment of status in the United States, they should submit a copy of this notice along with Form I-485." Are you saying that approval of I-130 doesn't mean she can apply for adjustment of status? Maybe I misunderstood the letter. I thought that sentence above indicated she could. I am confused :( Priority Date is 12/16/2011. But she is here in the states on B-2 visa for 6 months. I sent USCIS a hand written letter explaining her situation - she is from Ukraine and currently she can't go back there because of war. Could it be that they prioritize those I-130 cases for people from that region who are currently physically present in the US?
@@LeBelEsprit she must wait for her priority date to become “current” on the visa bulletin in order to be eligible to apply for a green card. Your sister falls in the F4 category. travel.state.gov/content/travel/en/legal/visa-law0/visa-bulletin.html
@@LeBelEsprit Even though the petition is approved, it does not grant her permission to apply for adjustment of status unless her category is "current" on the visa bulletin in the F4 category. And no, unfortunately they will not prioritize her case. If she is currently in the US and has nowhere to come back to, she can probably file for TPS.

Was it a mistake on their part? Also, what would happen if we still go ahead and submit I-485? Would it get rejected because of the priority date not being current? And if so, does that mean we will lose the filing fee of $1,225??? I don't want to hurt my sister's case if we still send I-485 in and it gets rejected and will negatively affect her but at the same time I don't want to lose a chance of having her status adjusted if USCIS told her to apply....I am beyond confused as to what to do at this point :(

If I may ask, what mistake did you make?
I send an I-864EZ form instead of the I-864, I had to correct it and they answer me right away after I send it with my approval notification.

In addition, I am not aware of being able to file concurrently for somebody outside the U.S. I-485 is for inside applicants only. Unless they maybe already have a valid visa and were temporarily visiting overseas. 🤷🏻♀️ not sure

My sister just got I-130 approved and she is currently in the states. We are about to fill out I-485 but I also wanted to submit I-765 with it. I am confused as to what we should write on page 3 questions 27 - Eligibility Category. I went through a list of all categories and I did not see anything for Family-based sibling category. Would you please assist?
Hello, are you sure she’s eligible to apply for adjustment of status? What is the priority date listed on the I-130 approval receipt?
@@KseniyaInternational We got I-797 Notice saying that I-130 was approved but that USCIS retained the petition because we didn't indicate on the petition if she was intending to apply abroad or in the U.S. And typically, once I-130 gets approved, USCIS sends it to NVC for processing further. But they retained it...The next paragraph states: "If the beneficiary intends to apply for adjustment of status in the United States, they should submit a copy of this notice along with Form I-485."
Are you saying that approval of I-130 doesn't mean she can apply for adjustment of status? Maybe I misunderstood the letter. I thought that sentence above indicated she could. I am confused :(
Priority Date is 12/16/2011. But she is here in the states on B-2 visa for 6 months. I sent USCIS a hand written letter explaining her situation - she is from Ukraine and currently she can't go back there because of war. Could it be that they prioritize those I-130 cases for people from that region who are currently physically present in the US?
@@LeBelEsprit she must wait for her priority date to become “current” on the visa bulletin in order to be eligible to apply for a green card. Your sister falls in the F4 category. travel.state.gov/content/travel/en/legal/visa-law0/visa-bulletin.html
@@LeBelEsprit Even though the petition is approved, it does not grant her permission to apply for adjustment of status unless her category is "current" on the visa bulletin in the F4 category. And no, unfortunately they will not prioritize her case. If she is currently in the US and has nowhere to come back to, she can probably file for TPS.
@@KseniyaInternational Hi Kseniya, thank you for your input. Why would USCIS send a letter stating she can submit I-485 if she wants to adjust her status while in the US? Was it a mistake on their part?
Also, what would happen if we still go ahead and submit I-485? Would it get rejected because of the priority date not being current? And if so, does that mean we will lose the filing fee of $1,225??? I don't want to hurt my sister's case if we still send I-485 in and it gets rejected and will negatively affect her but at the same time I don't want to lose a chance of having her status adjusted if USCIS told her to apply....I am beyond confused as to what to do at this point :(
