jim jordan and mark meadows were also found to be in contempt of congress and they were referred to the DOJ for prosecution, but the DOJ did not file charges. bannon was charged because he was willing to talk endlessly in public about the insurrection and his role in it, but he would not answer a subpoena and answer the same questions under oath.

that's not just me spouting off my political interpretation of bannon's case. it is a fact that jordan and meadows were referred to the DOJ for contempt of congress because the did not appear to testify when subpoenaed. it is a fact that the DOJ declined to prosecute them, presumably because there might be some question if meadows could claim executive privilege, but bannon could not claim executive privilege ( actually the president is the one who claims it, not bannon, meadows, or anyone else ) because he was not a member of the government at the time of the insurrection, which is what congress wanted him to testify about. that's just how the law works regarding executive privilege. navarro was prosecuted because trump never claimed executive privilege for him here is a quote from an article in politico, " Peter Navarro, a former senior White House adviser to former President Donald Trump, failed to prove that Trump asserted executive privilege to block him from testifying to the House Jan. 6 select committee, a federal judge ruled Wednesday.
The ruling by U.S. District Court Judge Amit Mehta keeps on track Navarro’s Sept. 5 contempt-of-Congress trial, where he will face jurors on two charges that he defied the committee’s subpoena for testimony and documents related to Navarro’s role in Trump’s bid to subvert the 2020 election. "
