    I misspoke on this video. Due to much of my time in law enforcement actually being in the state of Georgia. Under Implied Consent all drivers agree to recognize upon earning their driver's license agree to O.C.G.A. § 40-5-55 and § 40-5-67.1When we asked a driver to take filed sobriety test we always incorporated the breath test and or chemical test as well. If they refused the FSTs they would still need to take the breath or chemical test. If they refused then they faced their license being suspended. So even if they did not take the field sobriety test they were required to take a breath or chemical test.

      I do not quite follow you. Are you saying one has to always take the field breath test but not the physical "stand on one leg test", etc?

      I don't know where you get your information or how long it was since you were a LEO, how much experience, or what state you come from. You might want to clearly preference that in your videos. NHTSA sets the standards for field sobriety. A person indicates a failure by showing a specific number of clues per test. A person passes if they don't show the required amount of clues. It might be your verbage I have a slight issue with. You might want to also advise people that laws differ state by state. They change and might have after your change in employment. Your statement that field sobriety tests are not pass or fail is completely wrong. The tests are exactly pass or fail. You can say "indicates a pass or fail". However, you are now splitting hairs. People can pass field sobriety tests. I've had many pass. I'm sure that every police officer has. If you haven't, you were not in this career long. Then, I'm wondering why you commenting from this platform (We The People University). SFST's can also be used also for evidence gathering. The last time I looked at a Indiana probable cause affidavit (yesterday) they have a list of standardized field sobriety tests. Next to it are the words pass or fail with a box to check them accordingly. I think you also insinuated that without doing SFST'S there isn't any evidence of intoxication (maybe in this video). Overall, this isn't accurate either. You can establish probable cause without any field sobriety tests. I'll give you an example. The driver may have had poor driving behaviors, a strong odor of an alcoholic beverage coming from their breath, open container in plain view, slurred speech, glassy eyes, disorderly clothing (urinated on themselves) poor manual dexterity, they may be confused. Upon exiting a vehicle a LEO might observe unsteady balance, ect. Individually, you have next to nothing, you put all or some in a combination you can have probable cause. That's all that is required. You are correct that anyone can refuse SFST's. It is not a requirement that someone complete them at least in Indiana. Sometimes it would benift people to do them sometimes not. Refusal to perform the tests does not establish probable cause. You could say that some or all of those observations could be signs of a medical condition. You are correct. That's where a search warrant for their blood comes in. Which in my area requires a trip to the E.R. This is a great opportunity for medical professionals to take a look at the individual. When the blood draw results come back with anything at or above .08 or illegal drugs you most likely will be at least a per se violation. For those extremely unfortunate yet rare incidents that a person has a medical condition are arrested that person may consider a civil lawsuit. You are also correct that a person doesn't have to assist in a LEO investigation. I'll agree this police officer didn't say or do things perfectly, nor does anyone.They weren't completely awful or even close. I find you commenting on his errors then making your own shows how difficult this job can be. The officer telling him it is a lawful offer that he has to remove his sunglasses isn't accurate. That is not a lawful order. Maybe he misspoke like you. We all error it is part of life. This police officer isn't perfect and he isn't training someone completely wrong. At least with me, I never want to arrest anyone. I want to be the last resort. I hate the feeling of taking someone's freedom from them. Sometimes, it has to be done. The more information I have, the better decisions I can make. I work for the people. Not to sound rude but, saying you are a former police officer and former deputy sheriff doesn't really qualify you as an educated officer. There are just as many current uneducated officers as former ones. I really wouldn't take advice from anyone less that 10 years experience. That is about when an officer is grounded and decently educated. No matter the experience level or years of service, officers will make mistakes.I'm sure you did. Do you have any other education? Maybe a bachelor's or master's degree? Just something more than I did this job so I'm qualified. It might also help if you pointed out what the officer did well. That would cut down on the deviciveness. Unless that is the goal then you are doing well. There are a lot of aweful police officers out there. I do believe there are more good ones than bad. I do believe the system is broken and needs reformed. I do believe officers need to be held accountable. If that means being written up or even jail time. Even as a police officer I am not a back the blue guy, a thin blue line guy or any of that nonsense. I'm a pro common sense guy. I'm guy a that got into a career to help people. I will not dispute that I've been mortified of the actions of some law enforcement just as I've been mortified of the actions of the public. I truly believe that besides victims and family members of victims created by LEO's there is no one more angry at bad officers than good officers. Good officers pay the price for bad officers every day. Those that say good to that or they earned that are a part of the problem. It seems that it is not acceptable if law enforcement is treated poorly by one that we take it out on everyone. So I would challenge everyone to treat everyone how they want to be treated respect goes a long way for everyone.

FST'S (feild sobriety tests) include tests like the "walk and turn", "nystagmus eye tests", "ABC's and counting".. chemical tests are breath, blood and urine tests, a breathalyzer is the most common chemical test used during DUI investigations. It's important to understand the difference between "FST'S (eye test) and Chemical Tests (breathalyzer)". A breathalyzer is NOT an FST, it is a chemical test. No state requires you to preform FST'S, there is no punishment for refusing FST'S in any state... BUT there are punishments for refusing Chemical tests (aka a breathalyzer). When you get a license you are agreeing to provide a BAC (blood alcohol count) upon request of law enforcement. An officer can order you to provide your BAC (usually in the form of a breathalyzer) during a DUI investigation, if you refuse to provide your BAC or refuse the breathalyzer your license will automatically be suspended for 6 months to 1 year depending on your state.
      The police will always ask you to preform FST'S before asking you to take a breathalyzer because their goal is to gather as much evidence as possible. FST'S strengthen their case.. if you refuse the FST'S (which is your right! And you cannot be penalized) the officer will then ask you to provide a BAC (blood alcohol count) using a breathalyzer. You CAN legally refuse a breathalyzer, in fact most lawyers recommend that you do (especially if you've actually been drinking) BUT your license will be suspended automatically.
      It's also important to know that if you decide to refuse the breathalyzer and your license does get suspended for 6 months, a judge can over turn that suspension. Many times courts will look at a DUI suspension and decide that the officer did not have enough suspicion of intoxication to initiate a DUI investigation in the first place and the judge overturns the suspension. So, don't let the fact that your license will be suspended scare you into taking the breathalyzer. If you refuse the FST'S and the chemical tests, they have VERY LITTLE evidence that you were driving while intoxicated, as a result those cases are usually dismissed and your license reinstated. They may have other evidence like the officer saying "he smelt alcohol on your person" or they may have dash cam of you swerving BUT in a courtroom that evidence alone without FST'S makes a much weaker case. You are always better off refusing FST'S.
      It's also important to understand that if you decide to refuse the chemical test (breathalyzer) and accept your license being suspended, an officer MIGHT still be able to arrest you on "suspicion of DUI" based solely on his observations. Observations such as " your speech is slurred, the odor of intoxicants, swerving, you appear unsteady on your feet"..Once you've been arrested he can apply for a search warrant for your blood and FORCE you to provide a BAC through blood sample.
      Also, if you decide to take the breathalyzer and you blow a 0.00, the officer might still arrest you on "suspicion of driving under the influence" based solely on his observations!! An officer can use his observations such as " red glossy eyes, he smells weed on you or in the vehicle, or you were driving erratically" to help establish the probable cause he needs to arrest you. So, it's important to understand that even if you pass the breathalyzer you may still be arrested. Most lawyers recommend that you ALWAYS refuse FST'S and only submit to a breathalyzer if you haven't had anything to drink. If you have been drinking refuse both FST'S and chemical tests, let them arrest you and try to apply for a search warrant for your blood, it might be denied (strengthening your case).
      So, to summarize you CAN refuse FST'S (walk and turn, eye tests, ABC's) without any penalty.. You CAN refuse chemical tests (breath, blood, urine) BUT you will be penalized and your license will automatically be suspended. Hope this helps!

      As a former deputy I hated what I witnessed and is also why I no longer do it. My colonel didn't like me.
      I'm currently taking Brandon Joe Williams contract killing course.
      Also using other sources etc as I learn how we all were duped into slavery.
      Disclaimer on language etc but this is worth learning to become truly free.
      You'll learn how "law" enforcement and "peace" officers etc get away with this.

      Im a recovering alcoholic and have avoided a dui on numerous occasions before I got sober by not refusing field sobriety tests. I could pass 1 with ease regardless of my blood alcohol level and since I never refused 1 I was never forced to take a breathalyzer. Thankfully I don't have to live like that anymore.

      @@rogermoreno1152 I was never asked to take a breathalyzer because I never refused a field sobriety test. I was a professional drinker so it was always easy to pass. I warned them ahead of time that I was missing a ligaments in my dominant foot (wich I am) to explain any slight wobble

      @@1badombre82 ok, but as I said the field sobriety tests are designed to be failed, even by completely sober people. I’ve seen several cases of sober people failing them, many because of poor balance. Having to do the stand on one leg thing for so many seconds is almost impossible for anybody, even sober people. A lot of people just have shit balance and coordination. You must be a one in a million to have passed any of them

      You think it's the responsibility of the police to educate people about the law?
      Add that to the list of things we expect cops to do at all times - always be perfect, never make mistakes, know everything about every situation the second they show up, respond to calls within 5 seconds of being called, shoot guns out of people's hands so you don't have to kill them, disarm people with knives or blunt weapons without hurting them, know every single law and every applicable exception, and educate people about all of those laws.
      And do all of that while people are demanding to defund the police, stringing up good cops for enforcing the laws on people with the wrong skin tone, convincing good cops to quit, demanding more training while demanding less money go towards training, etc.
      Might just be easier to not break laws, like driving drunk.

On the subject of expecting gold out of men and women in blue, you're damn right I expect a certain level of professionalism and higher standards than a civilian! They accepted the job, and not just any job but one that holds the line between life and death when interacting with people.

      I was taught for about a month that mitochondria are the powerhouse of the cell. The government decides what we learn. We went through the entire constitution in about 3 days... That should tell you all that you need to know. Step outside of party lines, and vote for who you think best is the most intelligent and assertive. Intelligence takes top priority though.
      My opinion, it isn't Biden or Trump. Please, stop going for the people who grab your attention, and start going for the people who represent your views. #ThirdPartyorNothing

    Cop's on a power trip. Was pulled over recently for a DUI checkpoint. Told me I had to do a roadside sobriety test. I told them that they were harassing an at-risk senior. I'm legally disabled and couldn't pass such a test. I told them to charge me or release me. One or the other. Stuck to that statement and after 15 minutes of "ordering," me to do this or that, they finally told me to leave.

      Best outcome. possible. Best to say NOTHING beyond the proverbial "Name, Rank, Serial Number." You need never justify yourself to any LEO; a cop must establish Reasonable Suspicion to detain in order to investigate for a crime(s), and Probable Cause to arrest. Hold the police to those standards, and don't give them ANYTHING. They are NOT your friends and don't have YOUR interests in mind.

    When a cop says "because I said so" basically translates to, "I don't what the hell I am doing" If a cop can't tell you exactly the reason for his order, he should not be a cop.

The cop threatened to arrest him for not taking his sunglasses off and for not telling him if his drivers license displayed his current address!       I have a real narcissist here in my county. I am over 70 now and several years ago two county deputy's cars actually slid into my driveway, ordered me to stand about fifty feet away and they would talk to me in a minute. I have never in my long life did anything wrong. Never committed a crime. Heck, i haven't had a speeding ticket in over forty years. The two cops just stood at their cars joking and talking, so after about ten minutes i walked over to find out what was going on. In a flash the one crazy cop jumped on my back and started punching me, and then the other came over. I thought he was going to pull the cop off of me, but then he also started beating me. They threw me to the ground and my head hit a big rock knocking me out. As i was coming to, they began kicking me from head to toe. I was bruised from my head , down my body and even my feet were bleeding and bruised from them stepping on them. Then i was charged with assault on a cop! The judge, the cops and my public defender worked together and my public defender told me to take a plea deal. I was shocked. Then my public defender said i should take a plea deal or i would go to prison for five years. I am old and on a small fixed income so i couldn't afford a real lawyer. I ended up taking a deal which i had to attend several different programs. One was Alcoholics anonymous (i never have drank alcohol).. a drug addiction class (have never used drugs) and a psychiatric class. (which i actually led the class when the Doctor had to leave and go somewhere (which she did every day) She actually put me in charge of teaching the class! lol There are a lot of nutcase cops out there and one of the cops who attacked and beat me has killed people since, but they always say he was justified. One was an old man in his back yard and the cop was alone. He said he thought the man had a gun. He was very old and was holding a beer can. I am wary now and always have my Kahr 40 at my side. I'm too damn old to put up with it anymore. Sorry for writing a novel. Your post just hit the nail on the head and it reminded me of my incident.

      @@dlmullins9054 I too have been involved in a tag team match and I didn't get the notice,, been beat on by multiple cops and was INNOCENT,, I am disabled as well,, the mayor of my town even got drag'd in to the corruption,, and of course,, the courts protected them and the federal court wouldn't take my lawsuit,,,, I was goin after them without a lawyer and had all the evidence to prove my case,, they all satanists and do as they want,,

      Not showing ID is a CRIME? How does showing an ID absolve someone of a crime? Cops show up, ask people for ID, and that's about all they seem to do. I've watched hundreds of hours of police interactions and I've never seen them actually investigate nothing... Less one Crime!

    I used to back the blue. But over the years I don’t so much anymore. I don’t understand why cops don’t at least have to have a bachelors degree before ENFORCING THE LAW.       I used to aswell. Unfortunately it took 30+ years for me to change my view. After being pulled over 17 times in a 34 day period. All because someone living in my neighborhood just wasn't a fan of me but had a friend and happened to be a Sheriff Deputy. Person living in my neighborhood told his friend I was a big-time drug dealer and I supplied everyone in the area. You would think in order for Sheriff's Office to pull you over that many times in such a short period they would need some kind of proof or something. Those 17 different occasions they pulled me over I never got a ticket a citation anything because I wasn't doing anything illegal. But they kept pushing and I made a call down to the Sheriff's Office to ask why the fuck is going on and all sudden it just stopped. I'm about to go in all of the details because it's a lot but probably 25% of those stops they did some bullshit in like making me sit in mud as I'm in handcuffs. Dumping my Mountain Dew can out inside of my vehicle all over the inside and other childish and probably illegal Acts. Kind of odd no body Cam's wherever on no - cams wherever on so they claim.

      One of my relatives is a good, honest man with even temperament and fastidious attention to the law. He was a sheriff's deputy for 20 years, then worked with the FBI task force as a liaison tracking, arresting, prosecuting, and convicting child pornographers and human traffickers. He was one of the few people in law enforcement I ever met that I would trust with my family's life, including my own. And when the conversation came up about abuse of police power, he said something that mortified me.
      People tend to gravitate to becoming police officers from two sources:
      (1) those that are humble, self-sacrificing, and are born of a character that wants to uphold, secure, *and* protect the rights and privileges of their encompassing community and its members. It could almost be considered a "calling", but one born from humility. They want to protect their neighbors, their children, and keep their community safe in a legal, moral, and ethical way, in accordance with the laws of their land.
      (2) those of personality temperament that are engrossed in wielding power via a position of authority where they can tell people what to do or not do, how to act or not act, where to go or not go, how to stand or not stand, what to say or not say, etc. And they feed that mantra via the auspices of sporting the means to exact lethal force as a threat to accomplish it.
      In short, they come from the pools of (1) servants, and (2) bullies that stroke their egos and get their rocks off by ordering people around.
      What shocked me was my relative, a life-long public servant, telling me flat-out a non-trivial *majority* of officers he's known (thousands of them) fall into the latter category, not the former. This man had seen a LOT during his career, and I found it mortifying that, in his experience, most officers wear the uniform because they "dig it", not because they want to truly serve the public at-large. We always knew there were some; but it was a real eye opener to hear how even the "good" officers know just how bad it really is.

    I'm so glad to hear you say the tests are not pass/fail and just for collecting evidence, failure almost a certainty- because I failed one stone cold sober. It was dismissed in court after I blew 000's at the station twice. These "visual drug impairment experts" cops are becoming are alarming now too.

      Same thing happened to me. They kept escalating the test saying i failed until we finally used the breathalyzer that read o.oo. The cop didn't want to even tell me what it said just angrily then told me to leave now and be on my way. He was mad that I was sober 🤦‍♂️

      I use this argument all the time at work when I'm told by management to just do what I'm told. Then, because it's usually some violation of policy, or a law even, I just agree to do it .... AFTER they make the demand in writing and put their name to it. That usually puts an end to the demand 😄

Many videos show people saying they do not answer questions but this guy does the best job I have seen. He knows he does not need to get out of the car to take any tests (only for the officer's safety which is not the case here) and he knows he does not have to lift his glasses to allow the officer to check his eyes. What his more is the officers states he needs him to lift his glasses so he can determine if he is impaired. In other words the office admits he cannot tell at present he is impaired. If the officer chooses to arrest him, he also just handed this guy a "get out of jail free" card.

After my rights read police tried to interrogate me , i said lawyer, police said are you not goiing to answer my questions , i said lawyer again, police said why dont you want to answer , i said lawyer . . they gave up . . ..then they were trying to fingerprint me and cite me . .i prayed and Holy Spirit jammed their field finger print component AND the computer. . . i was released . . . just keep saying "lawyer" over n over cuz these blank blank will TRY to trick you !     The police can only detain you as long as it takes to issue the citation. After that, it becomes an unlawful stop. These cops were on a fishing expedition, searching for ways to escalate by intimidation and lies. This extended the stop past what was reasonable for issuing the citation.

    My dad has always been the one to remind me that, when dealing with any police officer, state trooper, etc. always wait 5 seconds before responding in order to dissect everything they just said and asked you about or to do and consider if it's a favor or the law. Cops are trained and coached in literal extortion tactics in order to squeeze as much money out of citizens they "protect and serve" in order to expand their budget for the following fiscal year and in turn, increase their own wages and the quality of their equipment as well. It's a filthy racketeering practice that is slowly becoming less possible with the advancement of technology i.e. body cams and camera phones in 4K. I grew up at the tale end of an era where the outcome of every situation was the cops word against your own which gave them a Supreme advantage over the public. My dad mentioned a friend of his who got drunk camping and was too hammered to set up his tent so he slept in the backseat of his car and was woke up by a park ranger and a state trooper tapping on his window. They questioned him, smelled booze and prepared to give him a D.U.I. evaluation through a sobriety test even though it was clear he hadn't drove since the night before. They were both super friendly with him and had a pleasant conversation about nature and camping etc. Towards the end of the chat and before the test they had him pull his car into a parking spot that wasn't in the way of boat trailers coming into the lot and he was so hungover/still tipsy and feeling great due to the wholesome conversation they provided he did it without a second thought. BOOM. D.U.I. car towed, license suspended, fines and court costs, drug/alcohol counseling classes and he lost his job without having transportation to make it to work everyday. They couldn't prove he drove that drunk and used a dirty tactic like instructing/asking him to move the car and he did it not realizing the set-up until they pulled in behind him in the parking spot with their lights on. Yeeeesh...I still remember that even at 10 years old it stuck with me. Protect yourselves people.

      Cops are not trained or coached in extortion tactics that is an out and out lie. Cops are trained in how to gather evidence and present that evidence in court, but extortion, this is not the 1930 doesn't happen. I would therefore find it hard to believe that a park ranger and state trooper would allow someone to move a cart if they thought he/she were intoxicated, asking someone to break the law to get an arrest, that woiuld be entrapment.

    I work at a cannabis grow facility and have cptsd/severe anxiety, especially with people i don’t know and people of “authority”. My fear is being pulled over and being fucked with and police taking advantage of me in a simple situation of me driving home from work despite me following all laws. I’m also a medical cannabis card holder, I don’t smoke and drive for obvious reasons I don’t even like to drive at night. I feel like a bad interaction is inevitable, however I’m so grateful for channels like this that help me be more confident in expressing my rights. ❤️

      You're wrong, these types of channels show only the bad... I love watching them but you gotta realize not every cop is bad, and also that if you are not in the wrong then cooperating with the police is almost always the best move unless they want to harm you or frame you. Usually they do not, so if you have not done anything wrong it doesn't hurt to comply with every single thing they say even if it's uncomfortable, better than going to court or getting shot.

      And obviously every officer is different but in my limited experiences, even in cuffs being taken to the station, when I showed nothing but "good behavior" they were able to use that to uncuff me where as if I made a big deal about what rights I had I would've remained in the tight uncomfortable cuffs - it's not fair, but I'd rather pay a traffic ticket or get detained than be shot or go to court, regardless of if I broke any laws or not.

      Assuming someone might read this - I have found that the best technique IF YOU ARE NOT GUILTY OF ANY SERIOUS CRIME with getting pulled over is to convey a demeanor of compliance, confidence, and respect... if a cop walks up to my car after pulling me over I have both hands on the wheel clearly visible and I look forward, making no sudden movements. I am aware that I do not have to answer questions but if they ask where I am going, where I live, or anything like that I am happy to answer. If you have nothing to hide do not flex your rights because at best you will piss off whoever you're dealing with and I think we all know what the worst case is

      I'm pretty sure you have to take a breathalyzer. But if you pass that, and they want to go further with a field sobriety test, absolutely, say NO.

They are doing it to gain evidence, so when you inevitably fail the sobriety test, even if you blow a 0.0, they can have some "evidence" that assumes your under some other substance. Then they get to make the arrest, search your stuff, jail you, and subject you to further testing.
      They choose to hold off on the breathalyzer until after they've tricked you into the sobriety test because that's the order that allows them to get to arrest and search more people. Also, thanks to civil asset forfeiture, if any of these civilians they get to search has a large amount of money, they just get to take it, so that's another incentive for them.

      First, the Con Edison has failed to prove that Butler’s non-criminal consumption of a legal substance rose to the level of abuse or that Butler’s consumption of alcohol adversely affected his job performance or the public’s trust (whatever that is). Moreover, the only consequence of off-duty chemical substance abuse is that the employee will be sent for a JFE. Here, Butler was sent for a JFE on December 16, 2014 tested negative for drugs and alcohol.
      On December 13, 2014, Butler was purported observed by Officer Brito moving from the driver’s seat to the passenger seat a couple of hundred yards from the DWI checkpoint. Officer Brito did not testify that Butler was driving erratically or displayed other indicia of someone that was driving while impaired. The Union concedes that Officer Brito’s assumption that Butler’s actions were to avoid being identified as either a driver who had been drinking or a driver who might not have had a valid license is reasonable. It is also reasonable for Officer Brito to assume that if he could see Butler then Butler could see him. That assumption is not reasonable.
      Officer Brito also demonstrated his expertise and training in many facets of alcohol and drug testing but the only verified test result was the breathalyzer results. This is important because clearly Brito had an animus against Butler. Brito testified that Butler was quietly being difficult and when Brito was asked why he issued Butler a summons for refusing to test AFTER he submitted to a breathalyzer test Brito testified that Butler was walking out of the police station with a summons regardless. Butler was issued a summons that was so patently meritless that the Westchester District Attorney’s office did not even submit opposition to Butler’s motion to dismiss. (Union Exhibit “2“)
      The Union submits that Brito’s testimony is troubling. A police officer charged with upholding the law and who described himself as an expert in the observation of behavior under the influence of drugs and alcohol and who is also charged with knowledge of the NYS Vehicle and Traffic Law issued a summons that (based on his expertise) he had to know was invalid Brito practically admitted that since Butler gave him a hard time and wasted his time that night (because he did not engage in criminal conduct), he was going to give Butler a hard time. That hard time translated into the issuance of an invalid summons that forced Butler to retain counsel and utterly wasted the time of the Court that dismissed the summons that the Westchester County determined unworthy of opposition.

      You do not have to submit to a field sobriety test and you never should. In most states, the field sobriety test is statistically flawed and not admissible in court. However, if you do refuse it, you will be subject to a trip to headquarters for a blood alcohol test.

      Totally agree. Barking commands is not lawful orders. Cops that refuse to tell you immediately why you’re getting pulled over but expect you to exit the vehicle are full blown corrupt. That should be your clue to shut up and keep that camera rolling.

    The greatest danger is being pulled over on a highway like that and being exposed to that high speed traffic. A vehicle code violation is a civil tort and not a crime. Too many cops ignorant and unsafe. 33+ years in the fire service and experience as a citizen has taught me that.

    Retired LEO here. I unknowingly took advantage of people that did not know their rights. I drank the cop koolaid. After receiving my bachelors degree in criminal justice, the Constitutional law class taught me the real deal and I feel ashamed for not upholding the oath. No one I ever encountered though, knew their rights. Please people, know and exercise your rights to put cops in check. You may actually be educating them.

      Cops get pissed when those they encounter are well-versed in their rights. I recall a DUI checkpoint "refusal", where some buzz-cut "Good ole' boy" pushes some kid around, and conducts an unlawful search of his ride, AFTER having the drug dog scratch it up with his claws. All through the search, the cop mocks the kid to his partner, who sees the kid's cell phone left videotaping, and deliberately shines his flashlight into it to blind away any footage, as "he KNOWS his 'rights' " with an almost-comical drawl.

      Minor traffic violations are civil matters - usually with no tangible loss to anyone or anything.
      It is a victimless crime so to speak.

    I am so uneducated on the law and got pulled over for DUI in California the day before Thanksgiving. I answered every question honestly because I thought honesty is the best policy and it got me arrested overnight. Now I have to go to court in a month to find out my fate. I did a blood test, and will show positive for legal substances, only. I got pulled over for a burnt out tail light which I didn't know I had, otherwise I was driving just fine.

      There's a distinction between being "honest" versus ratting yourself out. You owed the officer NO recount of what you ate, drank, smoked, snorted, sniffed, applied dermally, or suppositoried "up your shaft". Nor did you need "splain" your itinerary. If asked questions, all you had to do was verbally assert your 5A right to remain silent and demand the presence of counsel before the police asked any more questions, then STFU. Yes, cops habitually go into "jerk" mode when a subject won't talk nor furnished them with evidence against him that he doesn't have to give up, or simply doesn't consent to any searches of his person, effects, vehicle, or home. To them, asserting your rights means you're "hiding something" or "know you're guilty". And, BTW, having only "legal" substances in any blood test for DUI most certainly WON'T get your off the hook, as a "drugged DUI" can be substantiated quite well by OTCs and/or Rx. May be hard to actually prove they impaired you, but likewise, it'll be difficult and expensive to assert in court that they DIDN'T.

    I was with a coworker when he got pulled over and asked to do a field sobriety test. He refused saying "let's go straight to the breathalyzer". The cop looked totally dumbfounded then said "I can't do that until after a field sobriety test". My friend said well I'm not taking one. The cop went back to his car, came back a minute or two later and let him off.

      The understanding I know of is if they suspect a dui all one has to do is take a breathylizer to satisfy the requirement of making sure ur not impaired. The field sobriety test should always be turned down as it is a sure fire way to be arrested. Sad part is the officers hate it if U know your rights so they try to get you on something. Be smart and don’t fall for tricks

      Perhaps California law is different than the law in Georgia. In California there is never, before or after arrest, a legal requirement to perform an FST. In California, only AFTER ACTUAL ARREST, a refusal to submit to a test, breath or blood, is a violation of your driver license implied consent and will likely result in suspension of your drivers license. Never take a FST and never submit to blood /breath tests until you have actually been arrested‼️

    This is absolutely a legitimate fear of mine. I rarely drink and if I do, it’s one or two and then I’m done. I recently had reconstructive knee surgery and I would ultimately fail the test due to the weakness and instability in my knee from the surgery. Trying to explain that cop would be utterly futile and they would happily take me to jail.

      Several years ago, I was stopped for speeding. The state trooper claimed he smelled alcohol on me, which was funny since I hadn't been drinking that night. Now, I have a long history of knee problems, very well documented. During the FST, the state trooper asked me several times to do things that I'm physically incapable of doing. However, knowing that I would fail the BAC test for opioids (medication I was on at the time, seems to come up positive as an opioid for some reason), an FST was the safer bet since I could easily have my doctor testify in court to my knee problems. The last "test" the state trooper asked me to do that night, was recite the alphabet backwards from Z to A.... It really upset him when I informed him that the majority of the population couldn't do that whether sober or intoxicated, so I wasn't even going to attempt it. I passed the FST, but was ticketed for 72mph in a 55mph zone (even though the speed limit was actually 60mph).
      If you know you haven't been drinking or taking drugs that result in impairment, go for the BAC test.....or inform the officer of your physical impairments and hope for the best.....but keep a business card for a damn good lawyer in your wallet and a dashcam recording.

    What could we do if the cop just reached out and took the sun glasses off our face? I've seen countless videos of aggressive cops that have done far worse. And when you get to court, if you live that long, the judge almost always protects the cops.

    I got a .05 DUI which took my career from me. There was nothing wrong with my driving. My tabs were 6 days into the new month. However, he made up 3 visual evidence and I was convicted. Cops are not our friends and if one tries to talk to you simply remain silent. You can’t defend yourself from them.

      You do have the right to remain silent but you do have to tell them your wish to remain silent or do not want to answer questions. It's best to ask for an attorney to before any questions

    I still cannot believe I once got through a field sobriety test without getting arrested. I told the cops I'd had 2 shots and a beer or something, took the sobriety test and they let me go. Every time I remember that, it feels like a fever dream that I got away.

      Simple answer to a complicated question. You do not have to take a field test but if you do not take it you will be placed in cuffs and taken to either the jail for a breath test or the hospital for a blood test. If you refuse either of them you will lose your license for at least a year.

I think he is picking on the guy because he doesn't speak English the same as him, it's obvious that trooper is overcompensating from being bullied as a kid , and insecure for his shortcomings as a man!

    That cop was just being a jerk. The driver knew his rights and the cop didn't like it.
    Write the guy his tickets and be done with it. Instead the cop stands there, keeps asking questions, keep giving commands.. all for what? The citations are for tailgating. Give him his tickets and leave him alone.
    Remember this video if you're ever dealing with a cop. When you refuse to answer ALL questions.. including "Is this your current address?" it makes them crazy. They have to get you to comply with something to make their egos feel better. "Take off your glasses" "Get your hands out of your pockets" are just him trying to exert control over a situation he doesn't really have control over.

    A buddy of mine pass this field sobriety test by standing on one leg for damn near 10 minutes. He still got the citation and had to go to court, where the case was finally dismissed. There is no such thing as passing a sobriety test. It truly is just a one-man circus to entertain the officer during his mostly boring day on the job. Do not perform these tests. Allow the officer to take you to jail, speak with the judge with this few words as possible, then talk to your lawyer.

      You are correct. I worked in a power plant one night the state troopers set up a sting at our front entrance to the plant and the main road In front of the main gate. They made this girl do the exact thing we watched on our plant security camera . This poor girl kept her leg solid for like 2 minutes then he made her do the other leg again she nailed the stupid test . I was so pissed I wanted to go down there and take our coal dozer and run them all over. friggin tyrants. She passed

      Even better, insist on your right to a lawyer as soon as they say to take the test. “I need a lawyer present before answering your questions or doing any tests. I have a right to legal counsel. I want a lawyer now.” If you do this, I believe they cannot use any verbal evidence collected in response to their questions after you insist on having a lawyer present. Then say you will not answer questions or converse with them until you have a lawyer present. Repeat “lawyer” in response to any stupid questions, as needed.

      @@j10001 I took criminal law as a minor in college and the class was taught by the judge in that city/county. The one major concept he taught me was that if I was ever a suspect in an officers investigation, stay silent and ask for a lawyer, but remain respectful. Luckily, I don't break the law, but I am a huge 2A and stand your ground advocate. Hopefully, it never happens again, but I know what to do if I ever have to employ lethal force. The first time, I talked way too much because of the adrenaline dump, but fortunately I was lucky because there were several police reports against the guy(harassing my family, including attempted arson) and I live in Texas, so it's a much easier defense here.

    I've been in this situation many times. If you don't take the test and refuse to blow. You will still be charged with DWI and have you license taken in Louisiana. Refuse to blow you automatically lose your license.

    I took one and "completed to satisfaction" . They brought out 5 additional officers to try to convince me to do the breathalyzer. I refused as they had no evidence of impairment. They pulled me over for faulty tail light. I jumped out and asked them which light was out. I told them it was an unlawful stop without probable cause. They then switched the story to impaired driving and smell of alcohol. I said you said you smelled alcohol from 2 blocks away? I asked how I demonstrated impairment? No answers. They asked me to call a ride because they said they would pull me over again if I drove my truck. It was February and cold, i put my hand in my pocket and called a friend as I paced around the front of my truck. When i circled back from the front of my truck an officer had drawn his gun and was screaming at me to take my hand out of my pocket. They then patted me down checking for weapons. Now it was my license plate came back to a different vehicle and they thought my truck was stolen. I produced my current registration and squashed that. 2.5 hours of my time wasted and no charges or tickets.

      @Boi Chaoz the Supervisor was one of the 5 cops there. It's a very small town with a college. I think most of the cops on duty were entertaining me. Yes I left the bar after drinking and drove so I was wrong but they were such miserable cops they couldn't prove it. They asked me if I was an attorney 🤣. I said no just a citizen that knows his rights.

      Are you saying you were impaired and shouldn't have driven?
      As someone who has known friends who drove home after watching the game and were in an accident or had a moving violation and were found to be over the legal limit, you will eventually get caught.
      Me, I don't drink, I stopped at the bar to eat dinner and watch the game, Iced Tea doesn't get you in trouble. And yes, I have been stopped and the cop has asked me to breathe out, that's when I tell them I don't drink, and they chuckle and say have a nice evening.
