    Isang mapagpalang araw po sa inyo Bri. NOY. Naway nsa mabuti po kayong kalagayan at sana ay marami p po kaying mashare na knowledge regarding hoa affairs.
    Meron po akong itatanong regarding sa ELECOM at voting during GA. (General Assembly)
    1. Ano po ang mangyayari kapag ang ELECOM po ay hindi elected ng members during GA? Nkasaad sa hoa bylaws nmin n klangan ay elected ng members pero ang ginagawa po ng hoa ay nag aappoint ong po sila sa knilang mga bod at mga employee.
    2. Maituturing ba na valid ang lahat ng election kung ang ELECOM ay appointed lng?
    3.Sa pagboboto po during GA , kagaya po ng mga bayarin, consent ng members, tama po ba na basta nlng binibilang ang mga boto ng members ?
    Hindi po ba kelangan ay verity muna kung qualified or legit ang bumuboto pabor or hindi sa pinagbotohan?
    At dapat po ba nkaindicate sa minutes of meeting kung ano ang boto ng isang member or hindi na?
    4. Alin po ang masusunod pagdating sa distribution ng kopya ng bylaws? Yong nkasaad ba mismo sa bylaws or ang sabi ng President na kung sino lng ang may gusto?
    Mahigit 6 n taon na po ang hoa at mg officers nito pero wala pa po kopya ang karamihan sa mga members.
    Pasensya n po kayo Bro. Not sa marami kong katanungan.

    Good morning sir may tanong lang po ako.Paano po if yun mga dati elecom ay nagresig na or ayaw na gampanan ang kanila posisyon para sa darating na election ng bod s.Wala din po gusto tumakbo bila bago elecom.Kapag po ba ganun magkakaroon ng failure of election dahil wala elecom.Kung sakali nmn po may isang elecom na gusto gampanan ang tungkulin nya.Puede po ba sya lang magisa.Salamat po sir.Pasensya n po at urgent lang po.slaamat po.

      Hi po. Di po dapat magkaroon ng failure of election dahil sa kulang ang elecom. Gawan ng paraan hal mag appoint ng dalwa (2)na mag aasist sa hoa election ninyo. Yung isang Elecom na gusto gumanap ituloy lang niya. Thank you and God bless.

      Hi Sir ang quorum ng GA ay kinukuha sa kung ilan ang member in good standing maliban sa ibang pagtitipon gaya ng amendment ng Bylaws kung saan ang basehan ng quorum ay yung all members regardless of standing. Nasa HOA Bylaws po yan. Thank you and God bless.

    good day po. We have a failure of election during our first attempt of electing BOD. We are on the process of the election within the 30days grace period as stated on the RA 9904 revision 2021 po. Ask ko lang po, is the procedure on the 2nd election follows the same as the first po. Like mag notice sa members, filing of candidacy, campaign, casting of votes. We will indicate po kase sa aming IRR for Election of BOD's as reference sa 2nd election. Salamat po.

      Hi Mam. Hindi na po ganun. Mag popost na lang ang elecom ng notice of failure of election stating the reasons therewith. Then mag aanounce ng another date of election ang Elecom (within 30 days). Pero ang Elecom ay dapat magsubmit sa dhsud ng; 1) Notice of postponement at 2) Affidavit of non-holding of election stating the reasons why no election was held. Thank you and God bless.

    Ako po ay tiga subaybay nyu dahil isa po ako Hoa officers ng subdivision… may tanong lang po ako… election na po kc dito sa amin dahil nga po mainit at matindi ang gusto mkapasok ng iba sa pressure po cguro ng elecom ay nagsi-resigned po hindi po umabot sa proclamation ng candidates. Ngayun po wla ng gusto magvolunteer na mag elecom sa aming HOA. Ang tanong ko po pede po ba kami kumuha sa labas ng elecom na hindi po member ng aming HOA? Sana po masagot nyu…

      Hi po. Ang actual residente lang po ng isang subd na member in good standing ang qualified maging ELECOM ng hoa. Try nio lang maghanap ng pwedeng mag ELECOM diyan sa inyong hoa meron yan explain nio lang yung tungkulin. Kung wala pa rin patulong kayo sa hoa federation ninyo diyan thru a request.     Good day sir, ask ko lang po allowed po ba 3 days ang election? Wala po kasi sa bylaws namin pero yun po ang ginawa ng elecom. 3 days election via mobile ballot.. house to house po silang nagpapaboto.

    Who are eligible to vote in an HOA Election? Are non residents of the subdivision ( rather not living inside the subdivision ) allowed to vote/participate in the election?

Ibig sabihin kung anu ang nakasaad na qualifications sa inyong Bylaws/Election guidelines regarding BOD or committee membership yun po ang masusunod. Tingnan niyo po ang inyong Bylaws.       Meron na pong Court of Appeals decision diyan at nanalo po ang "one homeowner, one vote"; meaning po regardless of the number of lots the homeowner owns, isang vote lang po pwede niyang gawin..

      Ito din po ay nakasaad sa ating mga Bylaws na galing din ang template sa DHSUD:
      Section 6. Voting Rights. Each member shall be entitled to one (1) vote regardless of the
      number of properties owned. A member may exercise his/her/its voting right in person or by
      proxy.

    Bago lang po ako manood ng vlog nyo kc bagong elected lamang po ako....... Nasearch ko po kayo ang Pina nood ko sna mapag usapan nyo rin madiscuss regarding sa pagsahod NG isang officers...... Pwede po ba yun kuhain sa pinagkakakitaan ng hoa po ..or sa monthly dues pwede rin po ba?

      Hi Vanesa Ricacho. Thanks for your question and request. Ang mga BODs po ay wala po yan compensation ayon sa mga By-laws ng HOA. Meron din tayo mababasa under sec. 64, XII Framework for Governance of HOA: The directors and officers shall not receive
      any compensation except for reasonable per diems. Kaya po sila nag aspire as BOD is out of community service po yan. Ang HOA fund ay nauuwe sa basic services for the general welfare of HOA members. Ikalawa in my own uderstanding kasi po non-profit ang isang HOA not like other corporations na meron salary ang kanilang mga BODs. Thank you nawa'y nakatulong po ito sa inyong katanungan. God bless.

What if nagcirculate na Call For Nomination and Application for Candidacy Forms pero wala talagang gusto magfile ng candidacy or meron naman ninonominate ang mga homeowners pero ayaw tlaga tumakbo ng ninonominate nila. Ano po kayang dapat gawin ng mga BOD/Officers? Thank you po.

Kapag wala talagang na-nominate o nag file ng candidacy na iba, ang pwedeng gawen ay dapat mag file pa rin ang mga dating BOD kung nais pa nila tumakbo sa HOA election. Kailangan idaan pa rin sa proseso ng election as per your Bylaws. Nawa nakatulong po ito sa inyong katanungan.     Good Sir,
    Sir nag election po kasi kami para bumuto ng Interim para maglakad ng HOA License sa DHSUD po namin. Ang nangyare po nakuha po nila ang License ng hindi po namin nalaman at nagulat nalang po kami nag Oath taking na sila kay Mayor.
    Questions:
    1. Pede po ba yung nakuha nila ang License ng hindi man lang sila nag pa GA meeting para idiscussed ang by Laws?
    2. Pede po ba mag oath taking ang Interim? Or sila na agad ang HOA? Basihan kasi nila nakalagay sa DHSUD pede sila umupo hanggang 6month after makuha ang COR, Tama po ba?
    3. Kung oo ang sagot sa number 2, follow Questions pede ba kami magpatawag ng elecom as Member since mayron na kami License from DHSUD pede ba kami ang mag pa ELECOM?
    4. Last Question po, pede po ba gumawa ng mga activities ang Interim officers like basketball, trick or treat na may bayad, tumanggap ng donasyon/bigas kay LGU at iba bang activities na involve ang Pera since Interim palang sila di pa HOA officers.

      Hi RKWT3M TV. Thank you for your question. Summarize ko na lang po ang sagot ko. Ang interim BODs ang ibig sabihin niyan ay temporary lamang na tumatayo as officers habang wala pang official HOA election as per your Bylaws. Nangyayare yan during the HOA registration na meron interim BODs. Ok lang naman kung nag elect kayo ng interim BODs at nag oathtaking sa Mayor. Pero as interim pa rin ang status nila kasi di pa naman sila duly elected ng HOA members in a GA. Kung registered na kayo sa dhsud pwede na magpatawag ng regular hoa election at magbuo ng elecom. Sa GA iuulat dapat ng interim ang lahat na naganap sa registration at other compliance na kanilang ginawa. As interim BODs pwede naman sila mag operate as HOA kung rehistrado na sa dhsud (hal. At dun po sa Isang tanong ko po pede po ba magpa tawag ng Elecom ang Members? Since wala napong tiwala ang tao sa Interim lahat ng decision nila di nila pinapaalam sa karamihan at sila lang nakakalaam.. pati pag appoint ng Elecom gusto nila sila lang..

      @@rkwt3mtv Certificate of Registration/Incorporation ang nid na maipakita para mag operate ang HOA legally. Yung first election po na gagawen sa isang new registered HOA ay within six months from the approval of your HOA bylaws ng dhsud. Alamin niyo po sa dhsud kung may approved Bylaws na kayo. Kung meron na pwede kayo gumawa ng isang petition letter para mag request ng election address niyo sa interim BODs, kung ayaw nila magtawag ng election. Ang pagbubuo po ng Elecom ay nakasaad sa inyong Bylaws na maaring by appoinment ng BODs or by election ng members. Ang mag initiate po niyan ay ang BODs. Thank you and God bless.

      Hi Sir. Dapat po residente at H.O. ang ELECOM idagdag na ang pagiging MIGS. Yung Framework naman wala pa naman akong alam na na repeal na siya ng isang subsequent law. Thank you and God bless.

    Question lang po pag sinabi po bang proxy voting dapat po immediate family na with in the house hold lang po ang pwedeng maging proxy? Or pwede po anyone kahit kapitbahay? Meron po bang batas na ng dedefine ng proxy kung sino lang po ang pwedeng mag proxy?

      Hi JC EH. My apology for the late reply. Sa ngayon po under HOA By-laws and the 2021 Revised IRR of RA 9904 wala po tayong provision kung sino lang ang allowed to be delegated as proxy ng HOA member. Ang binabangit lang ay "Proxies shall be in writing, signed by the member and filed before the scheduled meeting with the association secretary." xxx Kaya to be safe dapat within household lang ang pwedeng maging proxy. Pero may batas po about proxy voting under the Revised Corporation Code of the Philippines which imposes no limitations as to the persons who may be appointed as proxy. it will also fall under the law on agency. Kaya para sa akin pwede cguro yan ilagay sa inyong By-laws amendment para isumite sa DHSUD at maging malinaw kung sino lang ang pwedeng maging proxy. Thank you.       Hi edi neys. Sorry for the late reply. Kung ang mga BODs ay nanunugkulan pa rin sila lang ang may karapatan magpatawag ng HOA election sa pamamagitan ng HOA Pres. or Vice-Pres ayon sa bagong IRR RA 9904 under sec. 89 Rule XIII na nagsasaad: Calling of an Election. Only the incumbent Board and/or through the president or vice president based on the records on file with the Regional Office are authorized to call the election in accordance with association's Bylaws. Kung ang Elecom ang siyang magpapatawag ng election with their own initiative mauwe po yan sa "unauthorized election" as per sec. 90 Rule XIII Revised IRR RA 9904. Kung ayaw kilalanin ng Elecom ang mga BODs meron naman proseso para sa removal of BODs/Trustees ayon sa inyong By-laws at yun ang sundin ng members upang hindi po magka problema ang inyong isasagawang HOA election. Regarding "hold-over" dapat iyan ay justified as per sec. 93 and 94 Rule XIII Revised IRR RA 9904. Otherwise meron po yan kaukulang sanctions o consequences sa mga gumawa niyan. Thank you.       Hi Sir. Dapat po ang mismong HOA Elecom ninyo ang dapat mag conduct ng Election at hindi ang Federation unless nag request po kayo sa kanila "to assist" sa inyong election. Regarding Sa HOA Pres ninyo na hindi homeowner resident paano po nakalusot siya sa qualifications ng tatakbong BOD. As per Section 72 (h) Qualifications of Trustees or Directors, and Officers. A trustee or director and/or officer of an association - Must be an actual resident of the subdivision/village, housing or relocation project as certified by the association secretary, or in default thereof, by a member of good standing having personal knowledge of his/her residency; xxx Thank you and God bless.

      Hi Charyl jarapan. Sorry for the late reply. Sa pagkalam ko at indicated naman po yan sa HOA Bylaws na ang isang ELECOM ay dapat isang member at in good standing. Hindi po siya dapat BOD o officer ng HOA. In other words a HOA member in good standing has all the rights to exercise with such as to seek an appointive or elective office subject to the qualifications of HOA bylaws. Regarding naman if qualified ang isang partner maging ELECOM not legally related, pakitingnan na lang po ang inyong Bylaws kung anu po ang nakasaad. Yun po ang inyong guide. Thanks and God bless.

    good day po sir, ask ko lang po.ngayon po kc ay nag sisimula na kaming mag buo ng hoa. so nag interim na kmi. nag na elect na kaming 10 BOD, so proceed na kmi sa pag pasa ng by laws ect...the question po is.may batas po ba nag nas sasaad na ang interim officers and bod po ba ay hanggang 2-3 months lang then after ma form ang HOA ay nag kakaroon na ng genaralelection,,na kung saan lahat ng interim officer and bod ay automatic mawawala na....or ma reretain sa position,,salamat po

      Hi alex molinyawe. Sori po for the late reply. Para po sa inyong katanungan sa aking pagkaalam ay wala naman pong batas regarding sa kung gaano katagal manunungkulan ang interim BOD's. Once na nagka election na po ang inyong HOA ayon sa inyong bylaws (asssuming rehistrado na sa dhsud ang hoa) at may na elect nang bagong BOD's exit na po ang interim BOD's unless kumandidato sila at napasama sa new elected BODs.     good day po sir, tama po ba na ito? ang pres. ng hoa without other BOD's ay basta na lang kumuha ng elecom na 2 during the meeting na walang simple majority members ang umattend para mangasiwa sa eleksiyon na gusto nilang isagawa. Tama po ba iyon o maling proseso? Puede rin po bang iutos ng elecom na ang pagbobotohan ay thru title like pres. vp etc. at hindi BOD,'s at kung di pagkakaisahan yun ng members ay magwiwidraw sya ay elecom chairman. Tama po ba na sundin namin ito? Tingin ko po kasi mali ang ganitong pamamaraan. Ano po kaya ang magandang gawin namin bilang miyembro? Salamat po and more power sir.🌹

      Hi umbao marivhel. Kapag meron appointed position na gagawen ang BODs dapat yan ay with concurrence of simple majority of the BODs during their regular or special meeting. Yan po ang normal process Regarding naman sa HOA election by position like Pres, Vice Pres etc yan po ay dapat nakasaad sa inyong By-laws na inyong naisumite sa DHSUD para meron po kayo legal na batayan. Sa practice ng mga HOA ngayon ay election muna ng BODs at pagkatapos ay association officers naman. Thank you and God bless.

      @@marlonfranco5725 Hi Sir. Nagiging valid lang ang Board reso kapag ito ay sinang-ayunan ng majority of the bods present during the regular/special meeting. Regarding 2 bods na lang ang natira as in your case, kapag iyan ay less than the majority wala na pong bisa ang mga gagawen nilang mga bod reso for lack of quorum. Regarding reso ng elecom ok yan kapag related lang sa elecom action or decision sa isang usapin halimbawa lang. Thank you and God bless.

Para sa akin po ang pwede ninyo gawen kung kulang ang association committees sa inyong Bylaws ay mag amyenda po kayo sa inyong Bylaws upang maidagdag ang anumang kulang na committee/s na kailangan ninyo. Ang mga association committees ay given po yan sa mga HOA bylaws. Sa inyong case dahil kulang, yun po ang gawen ninyo. Pls refer to your Bylaws kung anu ang nakasaad sa pagbuo ng association committees at yun ang sundin ninyo. Thank you and God bless.

      Hi Timothea Kimura. Thank you for your question. Ang ELECOM po ay isang association committee elected by the HOA members in gen. Assembly meeting called for that purpose. Ang iba namang HOA ay appointed ang ELECOM depende po sa inyong By-laws. Ang Gampanin ng ELECOM is provided under your By-laws. Ganito po ang nakasaad: The committee on election shall be composed of three (3) members, to be elected by the members in the annual meeting who shall serve for a term of one year/2 yrs. (depende po sa inyong By-laws) until their successors have been elected and duly qualified. "The Committee shall supervise all election activities of the association". Yan po ang buod na gampanin ng ELECOM. Sa iba pang detalye panoorin po ang aking vlog about "HOA Election Committee". Thank you and God bless.

Ayon sa new IRR RA 9904 ito ay hindi lang mismong may-ari ng lote/unit sa isang subd kundi kahit yung mga purchaser ng unit through financing (Pag-ibig & In-house financing etc.) Homeownership begins by purchasing a lot and/or unit in a subdivision/village and other similar real
      estate development project for residential purposes; (sec. 5 (b) new IRR RA 9904) yung hinuhulugan lang na ang hawak ay contract to sell or deed of absolute sale na di pa nalilipat ang titulo sa mga bumili. Kaya maari po silang ikonsidera as hoa member. Kaya maari silang maging kandidato bilang BOD bastat qualified as per HOA Bylaws. Thank you and God bless.

      Hi Adrian Estal. Sorry for the late reply. Ayon sa sec. 4 (v) Rule 1 IRR RA 9904 Homeowner refers to any of the following:
      [1] An owner or purchaser of a lot in a subdivision/village;
      [2] An awardee, usufructuary, or legal occupant of a unit, house
      and/or lot in a government socialized or economic housing or relocation project and other urban estates;
      [3] An informal settler in the process of being accredited as
      beneficiary or awardee of ownership rights under the CMP, LTAP, and other similar programs. So yan po ang maituturing na Homeowners. Hindi lang po may-ari ng unit/lot. Ikalawa kung bagong tatag pa lang ang HOA usually wala pang elected BODs yan interim BODs pa lang yan. Until such time na magkaroon na ng first election ang inyong HOA as per your By-laws. Pero kung matagal na ang inyong HOA at wala pa rin election na naganap iba na yan. Idulog niyo po sa DHSUD yan. Hindi po advisable na mag election kayo without the knowledge ng DHSUD.       Hi Gerry Tusi. Thank you for your question. Sa mga bagong nagparehistro pa lang na HOA ang election po ay ginaganap within six (6) months from the approval of the By-laws. Holding of Elections. An association shall hold regular elections
      on the date or schedule set forth in its Bylaws. The first election under the Bylaws
      shall be called by the Interim Board within six (6) months from the approval of
      the bylaws, and the elected trustees or directors shall only serve until the regular election as provided in the bylaws. (sec. 38, Revised IRR RA 9904). Interim BODs po muna ang siyang namamahala. Thank you and God bless.

So hindi po maari mag facilitate ang non-members of the association on HOA election as in your case the Brgy. Yan po ay internal activities ng HOA. Nakasaad din po yan under sec. 44 Resolution no. 770
      Series of 2004 Framework for Governance of Homeowners Association. The members of the above committees shall be drawn from the membership of the Association. Thank you. Naway nakapagbigay linaw po ito sa inyong katanungan. God bless.

    Hello po sir.. Meron po ako tanung kasi kami ay bagong homeowners association at nitong lately lng dapat mag election pero dineclare na postponed nila ang election without telling the reasons of the postponement.. What shall we do? Is this legal?

      Hi Sir Niceguy, siguro po ay alamin niyo muna sa inyong HOA kung ang postponement ay to a later date lang dahil baka naghahanda pa lang sila sa election. Pero kung totally no election ang naideklara nila they have to submit an affidavit of non-holding of election sa DHSUD stating the reasons therewith. Pls. refer po to sec. 59 Rule 10 ng IRR RA 9904- Magnacarta of Homeowners and Homeowners Association o kaya mag email po kayo sa region office na nakakasakop sa inyo. Sila po ang makapagsasabi kung legal o hindi ang ginawa ng inyong HOA. Kung calabarzon ang email: region4a@dhsud.gov.ph. Maraming Salamat po sa inyong pagsubaybay and God bless.

Dapat po yan ay reasonable lamang ang budget na nilalaan para sa HOA election. Meaning kung anu ang paggagastusan yun lamang ang maaring ilabas na budget sa ELECOM. Thank you and God bless.

Sa pagkaalam ko ang geodetic survey ay isa sa requirements sa HOA registration under a Community Mortgage Program (CMP) and other land tenurial program in relation to Location and Vicinity Map, containing the technical description and boundaries of the lot, signed and certified by a geodetic engineer or surveyor. Siguro isa po yan sa dapat maunang magawa for prior registration ng HOA. Pero sa ngayon meron na po revised checklist of requirements for non-regular HOA like CMP or govt housing program.     new subscriber po aq sir,pinapanuod ko po ung vlog nyo...ask ko lng po sir halimbawa po nagresign ung mga bods at...iba pang officer pwede po ba mag karoon agad ng special election at dalhin agad sa hlurb or dhsud?

      Hi maribeth bartido. Sorry for the late reply. Kapag nagresign yung mga BODs at iba pang mga officer the proper way is to inform DHSUD of such unsual situation. Nang sa ganun ma advise po muna ang inyong HOA kung paano ang gagawen sa ganyang sitwasyon before conducting an special election. Because it maybe considered as a dissolution of the Board under sec. 66 (c) par. 2 of Rule 11 RA 9904. Ikalawa ang BODs ang may authority to call an election as per HOA Bylaws. Since wala nang BODs dahil sa kanilang resignation dapat lang na iparating agad sa DHSUD ang ganyang concern. Thanks and God bless.

    Good day sa inyo...tanong lng po , totoo po b na pwd dw po mag elect ng admin sa Bod...at dadaan muna sa admin ang treasurer at auditor...para ayusin ang mga report? Yan dw po ang sabi sa DHsud ,salamat o sa sagot

      Hi Mam. Tingnan po ninyo ang inyong Bylaws kung allowed na mag create ng admin otherwise lalabag po yan sa inyong Bylaws. Ikalawa alamin niyo rin sa dhsud kung totoo nga na pinayagan. Thank you and God bless.

    Hi po, pwede po bang magfile ng candidacy kahit wala pang patawag ng election ang elecom?

      Hi Ramon Guevarra. Salamat po sa inyong katanungan. Sa pagkakaalam ko po ang filing po ng candidacy ay dapat umaayon sa date of filing ng candidacy as per election guidelines/activities ng Elecom. Kaya po may election activities disseminated sa mga members. Thanks and God bless.
