Usually, if the BIA (Board of Immigration Appeals) sends a case back to immigration court ("remands" the case), the case goes back to the same judge. Sometimes it may go to a different judge if the first judge has retired or for other scheduling reasons. But usually it goes to the same judge because that judge is already familiar with the facts of the case. My asylum was rejected and I was giving 30days to appeal the 30days expires on the 26 and my lawyer says she will send the apeal in court on the 26
