    He assaulted an elderly person two years earlier. As part of a plea deal, he was allowed to stay in a rehab facility. He chose to leave two weeks into the program.
    He wasn't "homeless," he was given a "home" and treatment, AFTER he assaulted an old woman, and would've had his felony charged reduced if he completed it.
    He did not, and had a warrant for his arrest because of it.

      He died 2 hours later after his K2 overdose caused cardiac arrest. The coroner tried to hide this by skipping the required tox screen. She had two different versions of the autopsy report. She gave contradictory testimony. She admitted she would have found Penny responsible no matter how much drugs Neely took. The defense also proved that he didn't have the severe bruising and amount of broken capillaries that happen with a chokehold death.
      There was never a case. They knew he was innocent all along.

      It will be difficult. He has a bunch of legal bills that he shouldn't have, and the so-called father of the mentally ill man is going to sue. BLM has all but put a hit out on white people in NYC and if I were Penny I'd get out of there ASAP. Heck, white people should all get out of there.     It wasn’t a “chokehold death.” Had Mr. Neely not been in the state he was with massive amounts of drugs and underlying medical issues not been present, this wouldn’t have resulted in death. According to the police body cam footage Mr. Neely had a pulse and was breathing when they arrived. The police refused to administer first aid because they were worried about contagious diseases. The city and state are responsible for the young man’s death for not taking care of this mentally ill, drug addicted man.

    Daniel Penny will never get back the life he had before his arrest and trial . No money in the world can undue what he went through. Hopefully the lawsuit brought against him by Neely’s father gets tossed . I don’t get it how these lawsuits for financial gain are allowed once a person is exonerated.

    why did he age out of the foster care system and onto the streets? Where was his aunt then and his father who's now suing Daniel? Why did he not have custody of his child and get him the help he needed? He had been arrested over 40 times and now his dad is trying to get a pay day.

      The people who helped Penny hold Neeley down testified that he was not putting pressure on his neck.
      Yes, it wasn’t just Penny that held Neeley down. Only Penny was prosecuted.

      Neely didn't die from that. He was still alive at the scene when Police arrived and the hold released. Neely died later due to complications and was a combination of four factors: restraint and struggle, sickle cell crisis, a synthetic drug in his system called K-2 and schizophrenia. He is clearly alive in the Police body cam footage.
