  • Who has the authority to interpret statutes like Title IX? Ilya Shapiro, senior fellow in constitutional studies at the Cato Institute, outlines a debate over the inclusion of gender identity when applying Title IX. Shapiro considers the recent case of Gloucester County v. G.G., which questions whether courts should give deference to a Department of Education guidance letter that stipulates publically-funded schools must provide facilities to accommodate transgender students.

    boys/men shouldn't be able to walk into girls/women's bathroom and visa-versa...there's nothing wrong with using the one bathroom unisex when there is gender "confusion". The many should not have to suffer for the few....even tho I do feel for those that have this predicament

    I think that the difference is when you infringe on the comfort of the rest. How about we have separate rooms with doors and each has its own sink and toilet so no one sees anything and anyone can use it. just boys, lift the seat and wipe up after yourselves.

    When/if this passes, I'm gonna make it a point to go in the women's bathroom all the time and see how this works in the real world.

    I actually somewhat approve of this. Congress doesn't have any business dictating how the state should be handling this issue.

    I believe the words "sex" and "gender" deal solely with the biological sex of the person. That is my "natural reading" of the words. The "guidance" the Obama administration gave was their belief that "gender identity" was a natural subgroup under "gender." That seems like a stretch for me.
    California has "gender identity" as a protected category under gender discrimination laws since 2004, and was due to the fact the legislature passed a law explicitly stating that "gender identity" is a subpart of "gender", versus a CA Supreme Court decision that ruled "gender identity" to be a natural part of "gender." I'm sure the same is true in other states.
