Canada’s move to limit temporary foreign workers is “political”: immigration lawyer

- Ottawa will refuse applications from low-wage temporary foreign workers in cities with an unemployment rate of six per cent or more starting on Sept. 26.
The Temporary Foreign Worker (TFW) Program has grown dramatically in recent years and has come under fire for supressing domestic wages and leaving workers vulnerable to abuse. Since 2016, the number of temporary foreign worker positions has more than doubled.
In August, a damning United Nations report described Canada’s temporary foreign worker program as a “breeding ground” for modern slavery.
Global News spoke with Toronto immigration lawyer Lev Abramovich about the recent changes, which he said are “political.”

He said the limits on student visas came too late. He also said this policy will not be effective as the industries with the most foreign workers will be exempt. He also said that the move is political, i.e., just for show. So he’s criticizing the effectiveness and motivation for the law. It was an insightful interview and clearly he doesn’t think he’ll be hurting from these new changes, since they won’t be so big. But you wouldn’t understand that because you’re too invested in the idea that immigrants are making your country depressed.

It's not logical. As for the claim that industries with the most foreign workers will be exempt, it depends on the type of industry. If an industry can't get enough work force in Canadian people, it has to get its workers from abroad. But for industry like catering services, local Canadians can easily meet the staff need. So a lot of foreign workers in this industry will simply reduce the jobs of Canadians.

So, instead of paying Canadians better wages, or training the unemployed Canadians, the business lobby went to the gov't and cried for slave labour and the gov't heavily obliged.
it's important to note that although many Canadian businesses HAVE abused the program, many of the worst offenders are foreign nationals who are here fraudulently (fake refugee claims, etc.) who hire 'their own' and then abuse them. They bring their labour practices (the same practices that make their home countries horrible places) here and the government, of course, turns a blind eye. Just another step in the 3rd worldification of Canada.
And they did it under the guise of Canadians = evil colonists, which the DEI middle management cult happily played along with.

What's not being addressed is how temporary foreign workers were once relegated to to agricultural and fisheries work but are working for many exploitive employers who care about nothing more than having the lowest payroll, mainly fast-food and retail. These are entry-level jobs that many Canadians needed to survive but are being undercut by foreign cheap labor. These jobs used to pay the bills.
Global News only showing agricultural workers and not Subway and Tim Hortons franchises shows what side of the issue Global News is on. It makes you wonder who has voting control of Corus Entertainment, probably the same investors who own many Subway and Tim Hortons locations.
Chrystia Freeland saying they will tie the Temporary Foreign Workers eligibility to the unemployment rate of an area still does not address how those jobs do not cover basic living expenses of Canadian citizens. Minimum wage will never go up like this but every possible expense will skyrocket to gouge the public so every corporation will cover their finances except private citizens, unless its one of the citizens destroying the country to cover their willy-nilly investments.
The young and the poor (now the majority of Canadians) aren't asking for thriving wages, cause that ship has sailed, just to be respected enough to be paid a living wage. I can't believe Trudeau thinks he will get re-elected after selling out the country to investors.

I saw a CBC article about an international student and how shes going to struggle financially with less hours to work. First of all theyre supposed to have the money to support themselves. Secondly working a full time job while studying full time is weaking educational outcomes. No wonder IS are failing! If you cant afford too be here then you need to move back home.

It was the change in policy after Covid which allowed the students to work full time. Question still remains the same , why are students looking for job anyways ?

International students should come just to study not to work, if they can pay the universities fees, they should be able to pay for their bills. Foreign workers are need in some jobs, for example: agriculture, housekeeping, or skilled workers are ok too but we can see every store, fast food shops full of Filipinos and Indians, and they’re like mafias, once a Filipino is a manager, they mostly hire Filipinos and same with Indians. My daughter and her friends have been applying for a part time job in Tim’s, McDonalds, a&w, Walmart and other grocery stores and barely get a interview and never hired😢, ahh but my daughter’s Filipino friends are all working 😡, some of them where their parents work😡

TFW here, east Asian, a couple of things:
I am paid the provincial minimum wage, and work in the dairy industry, medium sized farm.
I started working straight out of high school
From what I can see and hear from across the province and largely in the western Canadian provinces, older generation farmers are at the retirement age, but the younger generation is generally very reluctant to take over.
Not all industries, but definitely in livestock, people sometimes don't realize that, there is literally no breaks, ever! You work every day, holidays, Christmas, and if you do chose to take a few days off, your co-workers, i.e. other family members or workers, have to take up the extra workload. You barely have time for your family, you are often tired around your kids. Farmers have some of the highest suicide rates among all occupations, as well as a difficulty to find partners due to the nature of their jobs.
The work is hard, days long, especially during harvests, and if the ever more expensive tractors, equipment fail...
There used to be a lot of family owned farms, over the last few decades most have sold their generational farm and left the industry, most because of the cost to operate and because the next generation's unwillingness to take over.
Yong people my age have not been seen applying for my position in a few years now, despite ongoing hiring effort at significantly higher than minimum wage, and I have repeatedly stated that I, although love my job, am ready to step aside at any point so a Canadian PR or citizen can take my position, as required by worker rules. There were a few inquiries from neighboring areas, mostly made by parents, but their children in the end all refused to work, even part time, or seasonal.
On the other hand, there is the issue of prices: equipment costs have largely more than doubled since the pandemic, grain prices rose... and all that on top of the constant uncertainty of the weather every planting and harvesting season. Most farms don't ever make a profit after the yearly operating cost is deducted from earnings, and the little profit that on occasion appear, goes right back into paying debt or reinvesting in renewing long overdue old equipment.
My position, and all those similar to mine in agriculture, are in all fairness, very low skilled, with minimum training, and therefore is only worth minimum wage, in my opinion. I was actually offered a higher amount but in the end turned it down because on the job, I discovered the only thing I bring to the table is manual labor (I know that's not really the right way to go about wages, but I do believe that wages should be based on the irreplaceableness of one's skills, and as it stands, although no replacements were ever found, I am very much easily replaceable, skill wise). That, compared to a slightly better paid Starbucks position, with benefits (most farm workers and owners don't have benefits or pension, yes owners too), air conditioning, regular work hours. I mean, if it wasn't for my particular interest for agriculture I'd pick Starbucks any day too!
I think a couple issues are at hand,
1. Most of agriculture's profit ends up in the corporate processing and supermarkets, that needs to change, workers could benefit, as well as consumers, from distributing that profit between farmers and shoppers.
2. Agriculture in today's context no longer fit the modern life, although I strongly think that A LOT of people can benefit from getting their hands dirty once in a while and sweating a bit, improve physical and mental health, have better discipline all that jazz. So foreign workers are the temporary solution, if well regulated so that Canadian PR and citizens are ALWAYS prioritized for hire and at a fair wage. This cannot happen unless farmers can turn a profit, stated in point 1.
3. A new generation of farmers are needed to take over, and they need to be somehow convinced that it is worth the toil, because as it stands, it is not, financially, life style wise. Automation is one solution, although therein lies the huge, foreseeable risk of corporate takeover.
4. On a specific note, TFW does mandate that workers are provided up to standard housing (not always followed), which puts local workers at a huge disadvantage if they are commuting to work and paying rent, although that rarely happens, and the majority of farms do offer housing to all.
I am aware that me being treated up to regulation is not the norm among my TFW peers, which is quite sad and unacceptable. But in my opinion, even if given a leveled playing field, wages , conditions, housing, etc. Canadian citizens and PRs largely will be unable to meet the demand for these jobs, from unwillingness to work really hard physically, unwillingness to live the lifestyle, wanting a career with better prospects... these are harsh words, but I believe to be true, and they also come from a lot of older generation farmers talking about their children and grandchildren.
This is just in the agri industry, and from what I hear from farmers from all over western Canada : )

I'm not sure if it's students or temp workers or immigration on general bit there has been a huge rise in the number of people from India working at our big bix stores, gas stations, fast food.... like 3 out of 4 new workers are recent imports ... its just kinda crazy and unsustainable really.

This guy makes his living helping foreign workers come to Canada. Of course he thinks limiting them is a bad idea, he stands to lose some clients which means he won't have as much money for next year's new BMW and whatever options he wants. I strongly support limiting the influx of cheap foreign labour into Canada. It's so bad that almost no Canadian can afford to work at a minimum wage (or less) job. We want jobs for Canadians, and the same goes for housing. This guy is working against Canadians.
I am reading the comments and it seems like most people commenting didn’t actually take the time to listen to the interview. He is calling out the government out for political and reactionary changes based on sliding poll numbers as opposed to a coherent immigration policy. He specifically says that this government allowed certain sectors to get addicted to temporary foreign workers. These changes are political as this government is more concerned with political survival than the needs of Canada and Canadians.
That is exactly why Liberals/NDP are finally saying they will do a little something (even though it won't do much good at this point) to try to make some points in the polls. We are not stupid, even though they act like we are.

I remember years ago when workers from PEI, Nfld, etc would come to Nova Scotia and help with the fall harvest - no longer happens as farms now all have temporary workers. I do believe though, that most Nova Scotians would not be able to work in the summer heat like the foreign workers do so that is understandable but all of the workers we now see in every Tim Hortons and every other entry level position is outrageous!
I know a college in Ontario that imported more than 30,000 Indian students last year. We are talking about one college in one year. Things are out of control.

This tactic won't work in the long term. Most immigration applicants would simply select a municipality with low levels of unemployment. Then move to other locations after their work permits are approved.

I work in construction and can confirm a lot of the big companies have been exploiting this system to cut costs because they get hand outs from the government to offset the wages of these foreign workers.
1. There are some good people who are foreign workers who do good work and want to integrate into our culture, but there are many who do not respect our customs/culture and do shoddy work.
2. Youths who would otherwise be interested in getting into construction are apathetic, lazy and have no ambition because it's so hard to make ends meet from the ground level.
3. Why would employers take a lazy apathetic youth over a hard working immigrant, even if they suck at their job and are hard to communicate with?

I understand the sentiment people seem to share that international students and other temp workers are taking jobs away from citizens and permanent residents. However, teenagers here are so self entitled now and are unwilling to do the jobs at McDonalds and Tim's. The laziness and lack of competitiveness is killing this economy.
I have an adult son who has been working since he was 15 so that is just not true. He is a very hard worker and actually worked at Tim Hortons so don't paint all young people with the same brush. Treating your employees with respect and fairness is the key, why do you think Tim Hortons, etc has such a large turnover in staff. I also worked in Management at a large hardware chain and hired many young students over the years. The majority were great workers and I treated them as they were valued and not just a timecard number. Makes a huge difference.

Okay... what about the foreign investors? We don't have a housing issue. There are condos popping up left and right. The issue is the affordability of these housing projects. That's what is going to stop 8 people from living in 2 bedrooms. Not limiting foreign workers who are doing jobs Canadians don't even want.
Severe housing shortages, and cost of everything driven way up as a result of this mass immigration that Canadians never voted for. That's political? That lawyer should be working to feed and house the growing numbers of homeless. Or provide financial support to struggling families about to lose their home.

This is ridiculous. The majority of the homeless are homeless because they don't want to work the jobs. As a greenhouse manager, the local people don't want to work the jobs that the foreign workers work which is why we are required to bring them in in the first place. I have had many local workers try working in the greenhouse only to quit within weeks because they couldn't handle the work or even the heat that is required. So how are we supposed to depend on local people to do the work? The would be a worker turnover every 3 - 6 weeks. With this program we can bring in people who WANT to do the work because its a better opportunity for them than what they have back home. This is NOT the way to fix the homeless problem. High rent, high taxes and high economic standards are the cause of eat. People cant AFFORD to buy food, pay for living costs and even survive in todays society. This foreign worker programs ALLOWS us to get the work done.
Foreign workers brought in on the SAWP program or even low skill program aren't stealing job, they are doing the work that Canadians don't WANT to do as they can't handle it or even believe it's beneath them. Todays youth will never do the work that these people do for us. I respect the work that they do. I would love ANYBODY in the comments below to come to my farm in the middle of summer and spend 8 - 10 hours under the sun for a week and then see what their opinion is.
What about Higher Wage LMIAs? Are they still being issued? Companies like IBM, CGI, PwC, Dell, Deloitte, Accenture, TCS, and others are bringing people in on Higher Wage LMIAs, taking Canadian jobs in the IT sector. Who will address this? Stopping Low Wage LMIAs is good, but they should also stop granting High Wage LMIAs so that Canadians can work in higher-wage positions, especially with growing inflation. Technically, it seems like you're saying Canadians should work for lower wages while people from other countries get higher wages. Is that fair?
This is an extremely important and valid point you’re making. I see it everyday when an entire IT department for municipalities or even provincial agencies is from ONE country (even one province in that country) 🇮🇳 we have a huge problem.

Even my kid as a masters degree holder with an engineering job is addicted to his computer games after work. I advised him to stop so he can take MBA on the side or pass the GMAT to become a doctor or finish a PhD while he is still young to beef up his credentials or job prospects. I’m now getting stricter with him
Yes, it is political, the Canadian gov't forgot who they worked for and who was paying the tab. Canadians have now decided to take back control from that gov't. I am a 10th generation Canadian (many here longer) and I have never seen Canadians this pissed off and tired of having our money spent where we do not want it to go, policies we do not want and we have decided to change things, this is only the beginning, keep watching.
