I believe the aunt was putting things in the car including her niece phone and it accidentally fell to the ground. However they were so in a rush to get to the meeting by the time the niece realized she didn't have her phone they had pulled off and the aunt told her she had put it in the car. Since she doesn't need her phone for the meeting and they were going to come back to the car after the niece didn't mimd because her main concern was getting to the meeting.When they got back they discovered the phone on the passenger side outside right where she had put the other phones in the car therefore its obvious the phone just fell because she was rushing. The aunt allowed her to use her phone and tablet until her niece got a new phone however there were some miscommunication where the niece thought that she could keep it because of the wages she had to spend on a new phone because of her aunts mistake she considered them even.
Judge Faith dropped the ball on this one. I never heard the aunt say that she did NOT damage her niece's phone. So, I feel like the aunt should have paid her for her phone because she needed her phone to work. You have to have a phone to do Uber. Also, the niece broke her phone before giving it back so I guess they are even but you shouldn't do evil for evil. Judge was not fair in this case. The Judge should have just ASKED the aunt if she put her niece's phone in her car instead of drumming up an argument and accusing the niece of lying WITHOUT EVER asking the aunt. Judge faith was correct in her ruling that there was no evidence of what the items looked liked before the defendant received them. The burden of proof is on the plaintiff. Although we know that niece broke them.

I think the girl will do just fine. She's a hard-working level-headed girl and she has turned out alright despite the fact that both of her parents suffered from substance abuse. If she has more opportunities, she will do very well.
I know that people did not like the ruling but overall it was fair. We need proof to show what it looked like before and assess the value, ect. The Aunt could not have proved that. I don’t agree with this ruling on many levels. 1) I believe the niece when she said her aunt put the phone in the car, because at the beginning of the case, the aunt did say that the phone was on the ground in the rain. I don’t think it’s fair that she basically said she was lying, it was almost like Judge Faith forgot about the prior testimony. That however doesn’t mean she should’ve kept the tablet as “payment” for it. I agree that she kept the tablet because she was salty about the commission thing. 2) I get that Judge Faith gave the aunt the tablet and phone back but the phone was cracked. Nowhere in any of the testimony was there a mention of the phone being cracked when the niece borrowed it (which I’m sure the niece would have said something like “I don’t know why she wants this phone back so bad anyway because it was broken when she gave it to me”) So even though she had no proof of the condition of the phone, I would’ve given her some compensation for it. Clearly Judge Faith was over the whole case and she didn’t want to deal with it anymore but the ruling was extremely unfair.

Judge Faith this ruling was very unfair...although you may have been "agitated" you should have ordered her niece to pay for her damaged returned items...if she didn't want to return it common sense says it was in good/working condition when she took it...so in essence this ruling still wasn't in favor of the aunt.

Any normal person would have just returned the items... but her goal was to make her Aunt GROVEL😖😩 for her own things. She bases her questions on those statements. 2. The judge caught the defendant in a series of lies based on her previous testimony. Lies which she wasn't able to explain her way out of. 3. All judges get argumentative with liars. Judge Faith saw right through her web of deceit.4. The plaintiff did not call the defendants place of employment. The defendant had no proof that she did (no sworn affidavit from her employer). That too was a lie. 5. When individuals are sworn to tell the truth before testifying in court and then they blatantly lie, they get called on it. She's fortunate that she wasn't cited with co tempt of court. That comes with a big fine, at the very least. Imprisonment of they were in criminal court.

If the aunt damaged your 600 phone and she acting like she doesn't owe you for it then you should of made a counter claim against her and give the tablet back. I wouldn't sue family though, if i had a dime for everytime my family took something of mine I'd be able to pay for the defendant's phone myself.
Judge Faith this ruling was very unfair...although you may have been "agitated" you should have ordered her niece to pay for her damaged returned items...if she didn't want to return it common sense says it was in good/working condition when she took it...so in essence this ruling still wasn't in favor of the aunt.

Agreed. Of course that poor girl would be upset to lose her commissions and it was creepy of her aunt to take advantage even if it may have been a shady pyramid operation. And it was ridiculous of the aunt to call 911 and to get her family members to harass that girl. The poor girl had no parents and she's working her butt off. Give her a break.

The niece had to have broken the phone and tablet. If it was already broken when she got it from the Aunt, she would not have been able to use it for her job.

Yes the girl was the only one who had her phone in her posession she is lying🤔 . REMEMBER she said our phones are like a magnet to us. She set the stage to borrow her aunt's phone and tablet to use it a⬆️😡 leverage to hurt her for going directly to the manager to make 7 dollars for the phones instead of 5 dollars. She deliberately left her phone in the rain to get it repaired. It wasn't necessary for her to borrow the phone and the tablet at the same time. Remember.... when she said they are at my grandmother's house then the Aunt went there to retrieve them, they weren't there then she threatened 🤨her and said dont go to my grandmother's house any more this was staged to send her Aunt on a wild goose chase, Then she cursed her out😟then her daughter sent text messages asking for the things back and she said that a policeman told her not to respond to the text message this was a lie. It was done to maintain control.... Then Notice when she got sued SHE bought the broken items to court.... Because she had no choice because she would have had to pay for the value of the items had she come empty handed. She should have given her back her things after 3 days. After her phone got repaired. Any normal person would have just returned the items... but her goal was to make her Aunt GROVEL😖😩 for her own things. Her GOAL was about REVENGE, 😡 CONTROL😠, EMOTIONALLY ABUSIVE😔, and TRYING to SHAMING her Aunt.she wanted to make her Aunt PAY.... for going to the MANAGER to see if she can make 2 more measly dollars than her. This young woman wants to feel as if her Aunt should go through HER in order to make money. This is all in an effort to DOMINATE and Exert her POWER😤 over her Aunt... Then she tried to throw a Psychological guilt trip on her Aunt by saying I lost my UBER job.😥 THIS behavior is Brazen REMINDER.... there was only a 2 dollar difference in pay. IF SOMEONE acts this psychotic over a 2 dollars difference in pay this speaks volumes as to their character...know that I wrote a book but that's how I view it. Correct me if my conclusion is flawed. That wasn't fare... Judge Faith gave an UNFAIR judgement. I also think she should have given the plaintiff an option to choose the devices or the cash value, I've seen that done before. I'm a little disappointed for the Auntie she didn't deserve the mistreatment all around, plus I truly believe the judge was in a hurry she seemed unusually touchy and impatient the whole time, I think she was rushing to meet a deadline.
AbrahamsHeiress that is not how the law works, if she has the items, the judge is required to return them. That would be another case, she would have to have proof of how it was before she loaned it. Then the items worth and proof of replacement

Judge Faith is argumenative & need to calm down and listen. Judge Faith scoll the person whom she disbelieve before she hear their testimony & thats inappropriate(creates-unfairness). The plantiff (violated federal guidelines which prohibits contacting anyone place of employment for the sole purpose to loose their job & collections). The plantiff should never cause the defendant to loose her job. I believe the aunt caused the displacement of the phone & made her loose her job therefore, it defaults her getting anything. The plantiff case should hv bn dismissed and the defendant should hv won. The defendant was not allowed due process equally. The judge refused to look at her evidence(text msgs) and would not acknowledge the aunt caused her to loose her job. Also, many police officer's will tell u not to reply & keep evidence if you complain yr being harrassed or feel threatened(defendant did what the officers told her kp evdc). The Judge put herself in a personal emotion & said, you ignored her text msg, you ignored her (the aunt/plantiff)text msg. then got even more upset. Therefore, her judgement is foul and blatant openly bias. This should hv been in Judge Judy or Judge Mathis Court room. Number one NEVER EVER contact a person job or cause them to loose their job over nonsense foolery. Your case is over (meaning plantiff)and its a Federal violation "PERIOD!" WRONG MOVE............

alovekellz You need to review the video once again. 1. The judge has written testimony from both parties that she's reviewed before the case comes to arbitration. She bases her questions on those statements. 2. The judge caught the defendant in a series of lies based on her previous testimony. Lies which she wasn't able to explain her way out of. 3. All judges get argumentative with liars. Judge Faith saw right through her web of deceit.4. The plaintiff did not call the defendants place of employment. The defendant had no proof that she did (no sworn affidavit from her employer). That too was a lie. 5. When individuals are sworn to tell the truth before testifying in court and then they blatantly lie, they get called on it. She's fortunate that she wasn't cited with co tempt of court. That comes with a big fine, at the very least. Imprisonment of they were in criminal court.
