    Hawley's theory was if a person has a religious objection to something, everyone must be prevented from engaging in it. Does that apply to the 2nd Amendment too?

      Under Jewish law, abortion is required if the mother's life is in danger. Muslims also don't have any objection to it. But of course "religious freedom" is one of those conservative marketing terms to disguise a policy of "i'm forcing you not to do anything i don't like."

      The 2nd doesn't even protect the right to own a gun unless part of a well regulated militia. The founding fathers didn't believe in standing armies and so didn't think we would ever have one, and so passed it to allowed a competent fighting force to be armed should the nation come under threat.
      It's outdated and does nothing.

    So someone shows up to the hospital with life threatening injuries. A doctor refuses to treat the patient because it's a gun shot wound and they have a moral objection to guns. How is that different to refusing to save a woman's life no matter how the injury happened?

    The standing issue really highlights how egregiously ridiculous this case is, to even make it anywhere near this far.
    Some Dr's FEELINGS might get hurt!
    They might have to take care of patients whose activity they are morally against!
    So how about denying treatment for STDs?
    For a drunk driver?
    For somebody having an overdose?
    By this standard, every patient coming into an ER, would have to be screened for the REASONS they are asking for treatment. Talk about death panels!

      As a veteran who was a medic, I'd like to point out that it is *very* regular for medical staff to treat the wounded from the other side. And we are *literally at war with them* but we treat them anyway. This is one way you know that those "patriots" on the Court never served America and only ever served themselves (and the billionaires who bribe them, but that is just more self-dealing because they're getting paid in the millions for subverting justice on the behalf of those billionaires).

      Indeed. If they don't want to treat patients, perhaps they shouldn't be doctors. I think it's shameful that a doctor in the US can refuse to participate in an abortion. I didn't know that were the case. A midwife tried to get that crap into Swedish medical practices, but she failed in court after court. She sued for wrongful termination after having refused to participate in an abortion and was fired for not performing her duties. I'm so happy that it's not legal for medical personnel in Sweden to refuse care.

      They should have allowed the Fifth Circuit's decision to stand? That decision upheld almost all of the district court's ruling that the FDA's approval of the abortion pill was illegal.

      The case was filed in Abilene, TX, where there was only one judge who would possibly hear the case. The judge has an extreme Christian nationalist agenda (which he partly lied about to Congress in his hearing), and applied his ruling (which was filled with junk science and lies) over the entire US. The 5th Circuit Court of Appeals upheld his ruling, so the Supreme Court had to hear it to decide if it's too extreme for even the Republican justices.

    The wife of Josh Hawley presented such a weak argument in this case, so much it was amusing. Her presentation was so flimsy. Full of hypothetical situations. Not fact or science based.     The problem with challenging this drug regardless of position on abortion is that this drug is also used in miscarriage care. It can not and should not be challenged. It’s been around for over 30 years and has proven it’s safe. This decision should not be left to the courts, it should be left to the fDA and the medical community and Drug manufacturers

    I have to wonder how much of the reason this law suit was brought has to do with these doctors losing patients because of their refusal to provide this medication. If they can just make it so their competition can't prescribe it either, then their patients wouldn't have a better option available to them.

    I find the argument about judges not being medical researchers interesting. Here in the UK, judges would ask 3 simple questions (1) has the FDA failed to take into account factors which it should have when reaching its decision (2) has the FDA taking into account factors in reaching its decision which the legislature has said it should not take into account and then finally (3) did the FDA reach a decision which was so unreasonable that no competent FDA could have reached.
    Of course in this case the medical research goes back decades and is very clear, mifepristone is safe, far safer than continuing the pregnancy. If SCOTUS followed the UK approach the case would be much simpler as only the first question would be in issue

      And even if that were the case, why should "life" trump every other right of any other person? If that were the case, the state would be able to force people to get vaccinated, to donate organs, to run into burning buildings, to do all sorts of stuff. Guns would be illegal and capital punishment, too. If the preservation of life is the most important value, anything that works against it should be banned. Alcohol, driving cars, eating fatty and salty foods, people should be forced to exercise. I don't want to live in such a society where the state sees and hears everything, and controls everything. It's sad that conservatives do.

    For fifty years American conservatives asserted that overturning Roe v. Wade would take the abortion issue away from the courts, thereby allowing the American people to decide. It appears they were slightly mistaken.

    Over 45 years ago my pharmacology professor in nursing school advised us that any medication that has the potential for a positive effect might also have the potential for a negative effect. That's called a side effect, and it's up to the doctor AND the patient to determine the balance of risk vs benefit. This argument by doctors is totally disingenuous if they have ever prescribed ANY medication for any reason.

    I’m sure this court will stay on the lookout for cases with more “legal standing” to erode abortion rights even if they rule against the plaintiffs this time. They can view this case as one of the first drafts toward honing their anti-abortion stance.

    There is a persistent belief today that anyone who is "smart enough", like a judge, can read some research papers and reach a scientific conclusion. That is absolutely not the case. You need PhD-level education in quantitative methods and statistics to tell good from bad papers.

      It's very rare for 'abortions' to occur in the third trimester of pregnancy. At that juncture a woman would go into labor and/or carry the child to term even if the child is deceased utero.

      93% of all abortions are performed before 12 weeks. Sentience begins around 18-20 weeks. The remaining 7% are unviable, done for the health of the mother or because the fetus is stillbirth.

    All this conversation is purely academic, since with the present composition of the supreme court what counts is not arguments but if the check deposited to the offshore account of certain so called " judges " cleared.
