I want you to know that when I first was looking for help, your TH-cam videos helped me beat a debt collector who tried to sue. I answered the petition denying the debt and requested for them to show me a signed agreement and terms. When I went to court, the attorney called my name and said, "Your case will be dismissed." Thank you. I am letting others know about you
Im doing the same thing right now I just filed my answer yesterday asking for validation original terms along with a couple other forms of proof of ownership. Hoping that I have the same turn out you did, and congratulations on winning your case!
Once a suit is filed, it's too late to ask for validation. You now have to play by the rules of civil procedure and litigation more generally. If the amount of the suit justifies it, you should consider our membership and materials. We help people defend themselves.
Hello your video appear on my Feedback... good tips... I recently found out about a collectors on my credit report portfolio recovery so I contact the three credit bureau‘s to dispute the first attempt it didn’t clear on the second attempt to dispute One credit bureau delete it but the other two did not... cuz Portfolio R said they have proof of the debt .... I request proof contract n I was told on the phone that they don’t have proof contract I request to send it to me in writing and they never send it. I’m on my fourth dispute case with the other two credit bureaus. The best part is that another Agency claims they on the same account. Now is 2 different agencies saying that they both on the account.
Good luck with all that! Does go to show that people should check their credit reports and dispute - there is, in fact, a lot of false information out there.
I got a letter from a lawyer/debt collector that I owe realestate taxes for the year 2015, what do I do if I can not recall that I owe that amount? Can a debt collector play two roles and be a lawyer as well?
Well, a lawyer who represents companies collecting debts is usually a "debt collector" under the FDCPA. But real estate taxes are a different thing than most of what we deal with. I'd need to know more whether your situation is within our area of strength. If it's for much money, you might want to get a lawyer.
The answer is NO under FDCPA q debt collector can not state they are or even insinuate with wording they are an attorney or law enforcement. That is deceptive which actually I believe falls under UDAAP. Whichever law it falls under the answer is no, it's illegal for a debt collector to say that. You can check your CBR and see what all is reported and contact the creditor through that. Lawyers dont collect debts and collectors dont work for law offices.
@@Ty2xxxx The answer is YES if it is true. And lawyers do sometimes collect debts as debt collectors as that term is traditionally understood, and sometimes debt collectors do indeed work for law firms. Moreover, the FDCPA specifically states that a lawyer, functioning as a lawyer, can be considered a "debt collector" within the meaning of the FDCPA. Sometimes law firms themselves buy debts and collect them. We used to say that made them debt collectors, but the Supreme Court has muddied those waters. Now the question is whether collection is their "principle business," which is probably rare for a law firm. The bigger question here is what to do if you don't remember whether you paid or not. The short answer there is, "find out." Check the real estate taxing entity and see what they say.
How the debt collector authenticate the records? This collection agency sent 2 statements showing last payment and charge off, 2 bills of sale and a page showing my name, address, account number, and last 4 of my ssn. No contract though.
See my comment in response to your question about affidavits. Someone with actual knowledge must do it. Chances of a debt collector having that? Very slim.
Probably not enough to get it into evidence at court, but I didn't ask what kind of authentication you were looking for. If part of the verification process, well, it doesn't take much.
This is for an ongoing ligitation. They say that they are suing on account stated and shows that the payments made but no purchases with I assume they will say that is how they know I got the statements.

Is there anyone on the debt collector side that has firsthand knowledge of the alleged matter? what evidence is there that i received a statement?
Usually not. This is one thing debt collectors often seem to forget. Find case law, though, on the elements of their claim.
Hi, does this apply with banks and sold auto loans?
The state law principles apply to everybody. But banks and auto loans often do have the contracts. Not always, though.
Good tips.
Thanks for the feedback.

Please say more exactly what is happening here. I don't understand your question.

The affidavit says she is a media representative for the bank??
