He could have had the marriage annulled, if Ellia could no longer bear him children, and he only had one son and heir and no spare, then there's arguably grounds for an annulment to fullfill his duties and produce more heirs should something happen to the firstborn. Also, Jon wouldn't have been the first questionable targ bastard that was legitimized before his father's death, there was that guy who legitimized ALL his bastards after all.
