as a Warehouse worker myself--- we are actually really important people. Without the warehouse workers, your shit doesn't get received, picked, or shipped. Just because we don't work in the office doesn't mean we aren't important.
Warehouse work is odd, just showing up on time and not being high or drunk got me on my boss's good side. Once he realized I had a brain I got floating duties, sometimes doing returns sometimes inventory etc which was fun and made me like it. Then I tried Amazon after moving and leaving that job, yeah never worked a warehouse since.
the company framed it in a way to not explicitly fire her because if they fire her, she can get unemployment pay, but if she leaves "on her own" she can't.
This is so fucking manipulative on the company’s part too. It’s in the verbiage of unemployment that even if your employer says you quit, you can fight that if the conditions of work or your separation could reasonably be deemed hostile. Which in this case they definitely can show that. But obviously if you just got fired and have to go through EXTRA steps on top of how hard it is to already qualify for unemployment, even if you’d win the company knows no one has the time and energy to fight with the unemployment office. So absolutely fucked.
I don't think this makes sense. Unemployment is paid by the government, not the employer, so why would they want her not to receive it? We pay for our future unemployment through taxes...

Like: if you decide to take this leave regardless of us telling you that you aren't allowed, you will not only lose your job but you wont even be entitled to unemployment because of the way we've worded this. Not sure if that makes sense but just where my brain went. Also some businesses are so fucking petty, regardless of the fact they aren't the ones paying unemployment, they want to screw you out of it just to punish you for going against what they've said. I've had this happen as well, on a much smaller scale though. Some people are just nasty and petty and want to screw you in any way they can for not doing what they've told you to do.

I didn't need to have my ass whipped or faced repercussions or backlash from the public. These are grown women not children. They can only, at that age, understand and express what directly affects them and nothing else. The way she said "...adopted... baby..." in the second video AFTER she already received backlash from the first video with people telling her they didn't believe her claim that they treat adoptive and biological parents the same is absolutely WILD to me. I’m a Leave of Absence specialist. She wouldn’t be eligible for FMLA because she doesn’t have a year of service with the company and unfortunately there is no federal paid leave benefit. There may be a statutory paid family leave benefit she is eligible for depending on what state she works in. However, I’m shocked a company that sells products for babies doesn’t have a BONDING leave policy. Aside from having a disability leave to recover from delivering, there should be a bonding leave to care for a newborn or newly adopted child. Shame on this company.

In this case, they told her she would passively be forfeiting her job if she didn't return after 2 weeks, instead of saying she would be fired. Business don't want to fire people bc they're legally liable for certain things then (lawsuit for wrongful termination, unemployment, etc). A lot of employees feel like they're being forced to quit and just go with it bc they don't understand their rights. Human Resources people are the dirtiest sheisters in the business world.
As someone in their 30's who was went into foster care and was adopted at 5 yrs old I cannot tell you the hurt my mom feels (I feel annoyed and mad because my mom gets upset) when someone asks "Oh what about you real mom?" I always say the same thing everytime.. I look at them like they are a few fries short of a happy meal and say "She is my real mom. Blood doesn't make you a family." Once you are adopted your birth certificate and everything gets changed to state that your adoptive parent are your parents. Looking at my birth certificate you wouldn't know I was adopted cuz it looks the same as everyone elses. Your birth parents are essentially erased from all your legal paperwork EXCEPT the adoption papers at the court.
It's insane because I have always thought it was understood that when someone is adopted, thats thr legal and final say that says they are the same as as birth parents. I never knew this backwards attitude existed!

One of them was kind of just left with us by his mother since he was a baby but even though he wasn’t ever formally adopted we still call him our brother and he calls us his sisters but people still ask him about his parents ect.. The foster and adoption system itself is crazy but that’s for another day 😅
That's kinda weird to look at people that way. Being as tho so many adopted and step children usually long to find their biological parents. That's most likely why they ask that. Because it's kind of a norm truthfully.

I can see your point of view if you are talking about the ones who were given up as babies to the hospital or orphanage and never new their biological parents but there’s a lot of us who went into foster care later in childhood/teen years who came from really abusive/neglectful homes who KNOW our biological parents are no good so we choose to not contact them. Of course I can only speak for myself and what I’ve seen. Also I’m sure there are abused adoptees who want to see if their biological parents are better now but from what I’ve seen from others that’s not really the case for most.

I got fired on maternity leave via an email not even addressed to me, 4 days before Christmas, with a 3 month old hospitalized multiple times for failure to thrive.
That throwaway comment about the “baby she adopted” was very telling. Yes, it’s technically true, but she wouldn’t say “the baby she birthed from her womb” about another baby. Super gross, I’m just happy the family were able to get enough traction about this online. I’m sure similar things happen all the time and we never hear about it.

I’m a little surprised that this blew up the way it did. Most US companies have absolutely trash maternal leave policies and no paternal leave. Maybe because it was a baby focused company and Marissa’s story of infertility was particularly tragic, but lots of people have stories similar to hers.
I am REALLY hoping this leads to a lot more of these stories being shared, and something drastically changing because you are exactly right - this situation is deplorable, and it's not uncommon. Maternity leave for adoption is a precedented and legally protected right. Also they didn’t phrase “you’ll be giving up your job” to make her feel bad, it was so she wouldn’t qualify for unemployment and they wouldn’t have to give severance

Is it in your state? I was always under the impression that only the person who birthed the child gets the maternity leave. Even fathers have to fight for paternity leave. Obviously some people get these sort of protections through their job, or the unions they’re a part of. But it is far and few between from what my understanding is. I know a lot of laws like this differ depending on the state.
Not according to federal US law. Some states do protect beyond FMLA. But FMLA only provides for the protection of employment for a certain period of time and doesn't not require your company to pay you while on family leave. We rely on the "goodness" of corporations to do the right moral thing. If you work part time or hourly? You get nothing. Many politicians who claim they believe in "family first" mean they think women should fill traditional roles and be full time moms. The irony is that these are the same people who don't believe that the law should require employers pay a living wage. AND they don't support social safety nets like welfare and medicaid. So, unless you have family money, or are fortunate enough to work for a company with strong ethics and morals...our system is set up to drive you into poverty and out on the streets.

I came across this story on TikTok today. It’s absolutely disgusting. My little girl was super sick at birth and spent her early life in hospital (she’s 8 now and thriving) My employers gave me all the time I needed and gave me extra financial support from their charity fund. The support they gave me was above and beyond what I needed. I hope the little one recovers quickly and mum and dad can move past this extra trauma this has caused.
It's probably NOT IN THE USA LOL we in Europe have many human rights as you were brainwashed to call them benefits. We have annual maternity paid, we have mandatory annual holiday pay around a month (24/28/32) , we have free health care , free education up to age 19/24/26 (depending of a country ) if you sick you sick unlimited sick pay, your country is the only one that doesn't have mandatory maternity pay. Ying had every chance to be compassionate and to actually follow through on being family oriented, but they didn’t, and they showed that their companies supposed morals don’t go past the branding.

my dad passed away in July, i had just started my first "Big Girl" job in January, technically I didn't qualify for FMLA but they still made it work for me by giving me extra sick days while he was in ICU and until he was buried ( he was Muslim so this process was a lot shorter than the average funeral). So yeah they didn't have to give her anything, but they still could have; if my billion-dollar manufacturing company can cut me some slack and show humanity then its not farfetched to expect the same of a company that caters to mothers and babies.

As an American NICU mom, I know that family needs a lot more than they asked for on their charity site. I hope they receive more donations. Lmao 28 yrs ago I adopted my sons, completely unexpected . I mentioned it at my job, that I now have children. Got called into HR, was nervous, and told to go home for my maternity leave. 😳 I never even considered it, they weren’t even talking about it. It’s the law.

Dude. This is just a PRIME example of how mothers in America are treated like trash. I had a c section- major abdominal surgery AND a new baby and was still required to be back at work after 8 weeks. My short term disability claim for my second child was DENIED because I was pregnant before I started my job and they considered it a pre-existing condition. I am a nurse, my job is to take care of patients and that’s how I was treated. Really great.
I agree but this is a Baby Company. CEO Ying Liu should have at least respected that this employee had her baby in NCIU and was just asking for remote work until her baby was out of danger. I honestly wouldn't want to come back to a company that treated me this way when i was dealing with whether my child would live or not. The first kyte video was saying they would "find her a job" when she returned. Basically they would find her a bottom of the barrel, low paying, menial job to force her to leave, so they won't have to fire her, she will eventually be forced to quit due to low wages not being worth the time it would take from her baby.
"We will find her a position when she decides to come back." This means she will not get HER JOB back. She will get A job, probably NOTHING to do with her current position she got a promotion to (probably less pay and lesser of a position that the woman worked hard for) That is a MASSIVE punch to the gut. This is also illegal (in the US) as maternity leave is a legally protected right. You cannot fire a woman for being pregnant. You are required to give the mother her job back at the same pay rate and with substantially similar duties. IANAL, but Marissa would potentially have legal claims for all of this.
This is a widespread problem in America. Companies and their bottom lines are always more important than individuals, their families, and their needs and concerns (especially medical needs) and it’s reflected in the laws. I’m glad Marissa’s story is getting some attention, but there is literally an unimaginable number of people that have been in the same situation without media coverage, financial support, and business owners apologizing for what is considered “normal” and legal actions. I hope this makes people aware of actual issues, like parental leave and job security, that need to be addressed in this country. Meanwhile, in Norway, every new parent is entiteled to paid parental leave for 49 weeks for each family - with 3 weeks reserved for mum before birth (because a heavily pregnant mum needs rest) and 15 for after, 15 weeks are reserved for dad and 16 weeks for the parents to divide however they see fit. Biological or adoptee, you have the same rights BY LAW. Because that's what's best for the babys developement and health.
What's the pay like for maternity/parental leave in Norway? UK gets 52 weeks but it's at £172 or 90% of their normal salary (which ever is lower) per week
@@savage_optimist Indeed I did. 49 weeks with 100% pay. Or you could go for 59 weeks with 80% pay. In addittion, each parent is entitled to 12 months of unpaid leave if they want it. Oh, and if your child is ill and needs to stay home from kindergarden/school, each parent has 10 days of paid sickleave pr year. Oh, and if a child is severely ill (preemie, cancer, hospitalization ill for more than a few days) you get paid leave for that too, which is called 'pleiepenger' which rougly translate to 'nursing leave' and is separate from the 10 days of sick leave and parental leave. Oh, and still our taxes aren't higher than in the USA.

I lost our baby at 22 weeks and she passed and I worked at a childcare center and I had to take my pto and was out 5 days and had to take pto for the follow up appointment. I quit a few months after. my heart hurts for her

It happened in October of 2019 and it wasn’t until the pandemic happened I really started to heal. Our rainbow baby came in June of 21 . It helps to talk about her and we take time in Oct to breath and love each other
Dude, I just resigned from Amazon because my mom is in ill health and I have to move back to where she is. You know what my OPs manager told me? “I totally understand, family first. I hope everything goes well.” I had to take a 3 week LOA after 2 weeks of work because my mom was hospitalized. Amazon approved it within 30 minutes. If a billion dollar business can treat me like a human, WTF Kyte Baby??

Amazon was actually really good about taking leave. I actually miss Amazon's flexibility and kind of want to go back as an AM. 🤣 I just got 3 weeks of PTO this year after being at my current corporate job for 3 years. The 3 weeks includes personal pay, sick pay, & vacation. Previously I was only at 2 weeks of PTO and I did this for 2 years. 80 hours of PTO for EVERYTHING. It was absolutely brutal and we didn't even get all of our Holidays off either. (And salary of course, can't get paid for OT or Holidays) These last 2 years made my mind keep rushing back to my sister who works at Amazon and casually able to take off 2 months just because she was "tired" while only working 3 shifts / 12 hours each a week. I am 1000% bitter.

Here in Spain you have the same leave and rights for an adopted baby than for a biological baby. You are a parent in front of the law. Period. I was adopted as a baby. My adopted mom is my mom. She is just as legitimate of a parent as any other, and i’d even say she is a better parent than most. I still visit my biological family but my adopted family is, to me, my real family. My whole life, however, people outside of the family have challenged this reality and questioned our familial bonds… it’s tiring, especially when my family is healthier and stronger than any other family I know.

It doesn"t matter whether he was adopted or Marissa gave birth to him: this is her son and he is in a very delicate condition. The response of Kyte Baby to the entire situation is disgusting, especially the implication that somehow things are different because, gasp, Marissa didn't give birth to him herself. They should be ashamed of themselves. I will be telling everyone I know not to purchase any products from such a horrid company.
Adopted child here. Pretty annoyed by the whole thing. An interesting fact. On Yings page in her Q +A section it says one of her first jobs was as an interpreter for Chinese adoption companies. I have no idea if this was added after the controversy but it feels as if she of all people should understand the adoption process and respect adoptive parents.
This means she probably saw EXACTLY what happens when families with no money for it adopt a baby cause they 'really wana' (it's a whole vile trend to adopt Asian, especially Chinese babies).
Sadly this is the state of the US system. There’s no mandatory maternity leave or paternity leave. Get sick, get fired. This is why so much is going on in the employment sector now. I have a goddaughter who was born via surrogate and her bio parents aren’t the same people who are her parents but the parents are still her parents period. No matter how the child is born.
Sadly, this is the same for nearly every corporation in the States. It doesn't matter if it's maternity/paternity leave, surgery, medical needs, corporations literally don't care at all. I really hope people keep boycotting this brand and people start boycotting other brands that do this until things change. For Marissa, her husband, and her baby boy, I hope the baby grows, heals, and becomes well and they get the family they hope for.
And that's if they get paternity leave at all. In so many companies in the US paternity leave isn't even a thing. "Why do you have to stay home with the baby? You weren't the one who gave birth!" It's truly awful.

My aast job I had before I became a stay at home wife and mom I had a medical emergency and missed work then after I recovered I showed them my paper work about it and excuse for missing work and I got told how inconvenient it was of me to have my emergency on a Friday as they were very busy then and needed me. And I was wrote up for that and told to try not to have a life threatening medical crisis during peak business time. 😂

About 7 years ago I worked for an international company who's so large they sponsor major sports teams abroad. They sponsored a few small teams where their different companies headquarters were located, but I say this to show just how big they were. They had started to change a lot of their policies to mimic those in Western and Northern Europe, so people regardless of marital status or orientation got both paternity and maternity leave for 12 weeks at full pay and if there were complications after that time, FMLA kicked in and short term disability at 100% for an additional 12 weeks. Our part of the business. as we were a company under their umbrella, then got taken over by business headquartered in Bermuda for tax purposes, but was run on the policies in the States, which means all sorts of progressive policies were rolled back to the barest of bones.
@@kateri35 unfortunately, I completely understand. I was let go because of my disability. And many people would say, but they can't do that if your disability is covered by the ADA. Wrong. In an at-will state, they can "let you go" aka fire you without cause if they "eliminate" your position. It's how my company got away with A LOT of things and fired a lot of people. The thing that pissed me off about it was, just because I was physically disabled and occasionally needed time off for surgeries (like once every other year or so) and a day here or there for different procedures, my mind was fine. So my body had issues beyond my control, but I could still do my job. But companies just don't care. And I feel like, at least within the next decade, it will only get worse the legal system rolling back all sorts of protection laws for people.
Came here to say this. I wish I was shocked by the situation, but I'd honestly be way more surprised if it had gone any better than it did. The socioeconomic incentivisation of "hustle culture" in the US is nothing new, and I hate it so much. I understand rewarding people for working hard, but things like health, safety, dignity, and the ability to prioritize family over work should NOT be luxuries reserved for the upper class.
Absolute massive blunder for HR to not have adopted babies in the company policy for maternity leave. Also massive blunder on the CEO for trying to get out of paying maternity leave just because your HR staff failed to have that in the policy paper work.

The specific verbiage around Marissa being "fired" without actually being fired isn't to make her guilty- it's because you can get unemployment benefits and severance if you're fired and you can't if you just quit. They want to deprive her of support after firing her.
Just when you think humans couldn’t be anymore garbage, life says “wait hold my beer”. It’s absolutely heart breaking. I feel the mother’s pain. My nephew was born at 22 weeks as well. He was so tiny and had to live in the intensive nicu for a year and a couple of weeks. The doctors were set he was not going to make it but my lil dude was a warrior and fought with everything he had. He is now 11 years old.
They didn't say, "you're relinqishing your job," because they wanted to guilt her; they said that because they didn't want to pay a higher unemployment tax to the government.
While the company is legally correct they are morally wrong. Like of all companies you'd expect to support mothers it'd be baby companies but nah. They also don't care and are stingy with giving maternity leave.
If she wasn’t too far from reaching one year someone could have had her back and told her if you work x amount of days you’ll qualify for leave. Obviously if it was reasonable amount of days. If I worked HR I would try to get whatever I could for mom.

@@brandicrane6614 She didn’t qualify for FMLA. She was given a two week maternity/parental leave per the company’s policy. She doesn’t have a legal case. Unfortunately, this happens to people all the time. Parents often have to stop working to take care of their kids.
I gave birth when I was younger, wasn’t ready to be a mother, and was so lucky that the amazing woman that adopted my son was able to take maternity leave on short notice and for a few months. So grateful for her employer. Ugh screw kite baby!!!
You would think that a company built around babies would be more than happy to help a new mother out in a tough time. The fact that they didn't just proves that they're in it for the money, not the babies.
Large companies do NOT care about you or their employees. They care about money and that is literally it. They can put out brand statements and promise sustainability and promise to treat their employees well, that doesn’t mean anything. They don’t care. If it’s not making them money, they aren’t going to do it.
There’s not much use getting rid of a product you’ve already bought since it just creates more waste (unless you plan on donating it, which would be ideal of course!). Use it as intended, if it’s a good product- it’s a good product. As long as there’s the awareness around the brand and you don’t promote it, it shouldn’t be an issue

Its really stupid that employees need to work at a company for such a long period of time before they qualify for Family Medical Leave A...accommodations?...(FMLA) protection. I have had to fight for FMLA because I was part time most of my time at a company. Im glad there is a conversation around family leave, hopefully this topic will go somewhere. Lots of disabled employees end up having to go on social security insurance because corporations refuse to make accommodations unless forced by the government, which is on the side of companies in most cases.
It really sucks, BUT I can see why they do this. Since you cannot ask or know about a person's pregnancy as part of a job interview (by law) there is a problem where a job seeker could get employment with you, immediately go on mat leave, and then leave you. And companies don't want to incentivize this, so they make you "earn" such leaves. There should be a legal overhaul here to both protect pregnant women from being discriminated against at jobs, but also keep employees from just getting a job for the mat leave and never actually working
If you arent the birth mother people don't respect you. My sis is the main mother role to her husband's kids. The school for so long kept calling the birth mother even though they don't have any rights to the kids. Instead of calling her or her husband. The woman even said they shouldn't be calling her.
So interestingly my sister in law in the Uk had a similar situation, however she’d been working at this company for years. Because she was adopting she was put entitled to maternity leave, which is a huge problem as if you’re adopting there are certain time frames they say you MUST be with the child, especially as is the case with most adoptions the child isn’t a new born baby. She fought it, threatened to take them to court over equality rights & before it even got that far they backed down and changed the companies policy. A huge win. However it seems mental this can be a thing in the first place.
I was adopted from Seoul, Korea to an Irish American family of 5. I don’t think i was ever told how much it was to adopt me. The crazy thing is why is it so friggin expensive to adopt a child when there are so many children that need to be adopted.
Yeah im 25wks preg and will be actively avoiding this brand. One of my best friends has gone through this same struggle and is now looking into adoption and its taken everything out of her. This is infuriating and disgusting.
My first child was in the nicu for 11 days. My husband went back to work after a week because his company wasn’t required to give paternity leave and he didn’t have enough vacation. The United States is beyond behind the rest of the developed world when it comes to having children. It is so sad how often this happens to parents with infants in the nicu.

My mom went through the same shit. Only difference is I wasn’t born premature. Even still, my mom tried to work from home but her company said, no your maternity leave is over. Come in and work or be fired. So she quit :( Americans get max 8 weeks to our babies. It’s disgusting and horrible. Thankfully we could afford a stay at home mom but not everyone can!

What’s even more heartbreaking is imagining how Marissa feels having tried for years to give birth and then feeling like she failed as a mother to then get treated as an illegitimate parent or that she’s less than because she adopted. Especially by this specific company. And with a sick baby at that 😢 I can’t imagine the strain this has all had on her mental health, she’s been through so much. I truly hope and pray her son makes a full recovery and lives a long healthy and happy life.
Why doesn’t she have maternity leave? Here in Canada, mothers get 12-months of paid leave and job protection. This seems like a HUGE human rights issue
American politicians have been saying they'll make paid maternity leave a thing since the 80s. Not happening cuz none of them give a fuck. And even what we have, up to 12 weeks unpaid, is new. Only became law in 1993.
In the US you're only guaranteed maternity leave by law if you've worked for your company full-time (40 hours per week) for at least one full year. Depending on the state and whether you had a vaginal birth or c-section you get between 6 and 12 weeks. In most states it's not required to be paid leave, just that you're allowed to take the time off without getting fired from your job.
I'm just surprised at how shocked people are by the company. As companies go, most would just fire you as fast as possible (US anyway). You show up to work or you don't work there anymore. Quite terrible, but normal here.
and from a business point of view, having an employee off until around april with pay is costly especially when you consider someone else will need to be paid to be on site to do the jobs that she can’t do remotely. definitely a difficult situation that was handled badly though.

The fact that this is a baby clothing company, but yet the CEO cares less about adoptive parents, parents who are grieving the loss of a pregnancy, etc is sick and twisted. People act like work is the most important thing in the world and the only thing they should matter in life. Now while it’s definitely important, family is more important. My mom’s old job before she retired wouldn’t let her take time off to care for my dad who was in poor health. But they would let other people take a few weeks off. And it wasn’t like she didn’t have hours to take off. She a few weeks worth.
She's doing fine, no thanks given to Ying Liu the CEO. It's been the outpouring of care from strangers that is holding her together. Ying tried to destroy her and her spirit but she survived, thank God.

Warehouse work is odd, just showing up on time and not being high or drunk got me on my boss's good side. Once he realized I had a brain I got floating duties, sometimes doing returns sometimes inventory etc which was fun and made me like it. Then I tried Amazon after moving and leaving that job, yeah never worked a warehouse since.

This is so fucking manipulative on the company’s part too. It’s in the verbiage of unemployment that even if your employer says you quit, you can fight that if the conditions of work or your separation could reasonably be deemed hostile. Which in this case they definitely can show that. But obviously if you just got fired and have to go through EXTRA steps on top of how hard it is to already qualify for unemployment, even if you’d win the company knows no one has the time and energy to fight with the unemployment office. So absolutely fucked.

Like: if you decide to take this leave regardless of us telling you that you aren't allowed, you will not only lose your job but you wont even be entitled to unemployment because of the way we've worded this. Not sure if that makes sense but just where my brain went. Also some businesses are so fucking petty, regardless of the fact they aren't the ones paying unemployment, they want to screw you out of it just to punish you for going against what they've said. I've had this happen as well, on a much smaller scale though. Some people are just nasty and petty and want to screw you in any way they can for not doing what they've told you to do.

I'm sure you know that children are very selfish or very self-centered little people. It's not because they're mean, it's because they mentally and emotionally do not have the capacity to understand anyone outside of themselves. They can only, at that age, understand and express what directly affects them and nothing else. The way she said "...adopted... baby..." in the second video AFTER she already received backlash from the first video with people telling her they didn't believe her claim that they treat adoptive and biological parents the same is absolutely WILD to me.

I’ve heard this remark said to others who adopted. It shows that society has a skewed opinion of what it means to be a parent.
I’m a Leave of Absence specialist. She wouldn’t be eligible for FMLA because she doesn’t have a year of service with the company and unfortunately there is no federal paid leave benefit. There may be a statutory paid family leave benefit she is eligible for depending on what state she works in.
However, I’m shocked a company that sells products for babies doesn’t have a BONDING leave policy. Aside from having a disability leave to recover from delivering, there should be a bonding leave to care for a newborn or newly adopted child. Shame on this company.

In this case, they told her she would passively be forfeiting her job if she didn't return after 2 weeks, instead of saying she would be fired. Business don't want to fire people bc they're legally liable for certain things then (lawsuit for wrongful termination, unemployment, etc). A lot of employees feel like they're being forced to quit and just go with it bc they don't understand their rights. Human Resources people are the dirtiest sheisters in the business world.
As someone in their 30's who was went into foster care and was adopted at 5 yrs old I cannot tell you the hurt my mom feels (I feel annoyed and mad because my mom gets upset) when someone asks "Oh what about you real mom?" I always say the same thing everytime.. I look at them like they are a few fries short of a happy meal and say "She is my real mom. Blood doesn't make you a family." Once you are adopted your birth certificate and everything gets changed to state that your adoptive parent are your parents. Looking at my birth certificate you wouldn't know I was adopted cuz it looks the same as everyone elses. Your birth parents are essentially erased from all your legal paperwork EXCEPT the adoption papers at the court.
It's insane because I have always thought it was understood that when someone is adopted, thats thr legal and final say that says they are the same as as birth parents. I never knew this backwards attitude existed!

One of them was kind of just left with us by his mother since he was a baby but even though he wasn’t ever formally adopted we still call him our brother and he calls us his sisters but people still ask him about his parents ect.. The foster and adoption system itself is crazy but that’s for another day 😅
That's kinda weird to look at people that way. Being as tho so many adopted and step children usually long to find their biological parents. That's most likely why they ask that. Because it's kind of a norm truthfully.

I can see your point of view if you are talking about the ones who were given up as babies to the hospital or orphanage and never new their biological parents but there’s a lot of us who went into foster care later in childhood/teen years who came from really abusive/neglectful homes who KNOW our biological parents are no good so we choose to not contact them. Of course I can only speak for myself and what I’ve seen. Also I’m sure there are abused adoptees who want to see if their biological parents are better now but from what I’ve seen from others that’s not really the case for most.

If you can't provide you shouldn't even be allowed to adopt. MOTHERS rights should be protected for you know ACTUAL mother's. We need time to heal and get into a routine. They're literally irrelevant till that kid gets discharged from hospital. So they're just milking the system. Look at their begging pages. Both before and after the kid. My parents fostered and adopted for 50 YEARS. They didn't take bs time off and they had to pay for EVERYTHING the kids needed. They weren't exploiting the kids to guilt donations out of strangers cheese kids usually go to a special foster carer who cares for terminal kids till they die, because that's what's likely to happen. Or at BEST it'll be a lifelong cabbage who can't see hear speak eat or drink. And when it inevitably DOES die they'll be straight back online with their hands out begging for MORE money. They're scum. And NO company owes you month's off because you took on more than you were capable of. That's a YOU problem. And you SHOULD have thought about that BEFORE agreeing. I hope they get everything they deserve. They're not doing it because they care about kids. They're only doing it because they failed at having their own kids, she likely waited till she was too old and washed up to start trying. That's called consequences.

@@Naturegurl124 a lot of people do that. I’ve had personal experience with it, and they refused to give me a raise. I felt like I couldn’t do any better at the time, and I needed to pay my bills, so I stayed. I did eventually leave once I realized my worth.

I got fired on maternity leave via an email not even addressed to me, 4 days before Christmas, with a 3 month old hospitalized multiple times for failure to thrive.
I think if I would have gotten the second video from the company I would have healed way sooner. Being terminated is truly traumatizing.

That throwaway comment about the “baby she adopted” was very telling. Yes, it’s technically true, but she wouldn’t say “the baby she birthed from her womb” about another baby. Super gross, I’m just happy the family were able to get enough traction about this online. I’m sure similar things happen all the time and we never hear about it.
This company REEKS of terrible workplace mental health. A lot of the CEO’s comments sound to me like she’s use to thinking about the company over basic personal understanding. Methinks that the floodgates have now been open.

Are you serious right now? I mean really serious? At what company does the CEO put "personal understanding" over the bottom line aka "what's best for the company"? I'm genuinely curious and kind of shocked that you think this is how the world operates. I'm not trying to be mean, I'm trying to tell you what reality is. No company cares about your personal business. It is up to you to handle you business and while some may be more accommodating, many are not. I'm not sure how old you are or how many places you've worked but you've either had none or been very lucky so far because that is absolutely not the norm. It sucks and it's difficult but a company can't just stop doing things because you have an issue. Not everything can be accommodated for. And while I feel very much for this woman and her quest for a child, it was something she maybe should have looked into with her company before just jumping into this situation because she was so baby crazy.

@@LexFerraroyes! and as a developmental psychologist i cannot tell you how important that bonding is for social developments in children! there’s tons of wonderful videos on this site that show how much of an impact interacting with your child makes. it happens almost instantly when they notice we’ve diverted our attention. it’s so so so so so crucial for brain development and more.
Seriously!! The bonding that happens in those first months are irreplaceable and soooo important! And the fact that this baby was having such a rough start means the time is needed even more
I’m a little surprised that this blew up the way it did. Most US companies have absolutely trash maternal leave policies and no paternal leave. Maybe because it was a baby focused company and Marissa’s story of infertility was particularly tragic, but lots of people have stories similar to hers.
I am REALLY hoping this leads to a lot more of these stories being shared, and something drastically changing because you are exactly right - this situation is deplorable, and it's not uncommon. I'm glad they got exposed for this, ESPECIALLY as a baby company and ESPECIALLY as having taken advantage of her before (the 'promotion' and the other bullshit after having nearly died following hemorrhaging)

Your comment is gross and dismissive simply because so many families have the same story. It shouldn't happen at all. And companies do not value their employees the way everyone deserves to be valued! America is supposed to be some amazing powerhouse of a country and it can't even take proper care of its people. Maternity leave for adoption is a precedented and legally protected right. Also they didn’t phrase “you’ll be giving up your job” to make her feel bad, it was so she wouldn’t qualify for unemployment and they wouldn’t have to give severance

Is it in your state? I was always under the impression that only the person who birthed the child gets the maternity leave. Even fathers have to fight for paternity leave. Obviously some people get these sort of protections through their job, or the unions they’re a part of. But it is far and few between from what my understanding is. I know a lot of laws like this differ depending on the state.
Not according to federal US law. Some states do protect beyond FMLA. But FMLA only provides for the protection of employment for a certain period of time and doesn't not require your company to pay you while on family leave. We rely on the "goodness" of corporations to do the right moral thing. If you work part time or hourly? You get nothing.
Many politicians who claim they believe in "family first" mean they think women should fill traditional roles and be full time moms. The irony is that these are the same people who don't believe that the law should require employers pay a living wage. AND they don't support social safety nets like welfare and medicaid. So, unless you have family money, or are fortunate enough to work for a company with strong ethics and morals...our system is set up to drive you into poverty and out on the streets.

I came across this story on TikTok today. It’s absolutely disgusting. My little girl was super sick at birth and spent her early life in hospital (she’s 8 now and thriving) My employers gave me all the time I needed and gave me extra financial support from their charity fund. The support they gave me was above and beyond what I needed. I hope the little one recovers quickly and mum and dad can move past this extra trauma this has caused.

It's probably NOT IN THE USA LOL we in Europe have many human rights as you were brainwashed to call them benefits. We have annual maternity paid, we have mandatory annual holiday pay around a month (24/28/32) , we have free health care , free education up to age 19/24/26 (depending of a country ) if you sick you sick unlimited sick pay, your country is the only one that doesn't have mandatory maternity pay. One of the biggest appeals of running a small business is being able to make sure you run it ethically and that your employees are treated correctly. Ying had every chance to be compassionate and to actually follow through on being family oriented, but they didn’t, and they showed that their companies supposed morals don’t go past the branding.
Unfortunately the small companies many times are the most toxic, especially the one that say "we are like family"
Ying is cruel with no concern for her employees. Ying Liu only cares about money and herself. Employees are meaningless to her, she will fire anyone even if their baby is dying in NICU.

my dad passed away in July, i had just started my first "Big Girl" job in January, technically I didn't qualify for FMLA but they still made it work for me by giving me extra sick days while he was in ICU and until he was buried ( he was Muslim so this process was a lot shorter than the average funeral). So yeah they didn't have to give her anything, but they still could have; if my billion-dollar manufacturing company can cut me some slack and show humanity then its not farfetched to expect the same of a company that caters to mothers and babies.

Lmao 28 yrs ago I adopted my sons, completely unexpected . I mentioned it at my job, that I now have children. Got called into HR, was nervous, and told to go home for my maternity leave. 😳 I never even considered it, they weren’t even talking about it. It’s the law.

Dude. This is just a PRIME example of how mothers in America are treated like trash. I had a c section- major abdominal surgery AND a new baby and was still required to be back at work after 8 weeks. My short term disability claim for my second child was DENIED because I was pregnant before I started my job and they considered it a pre-existing condition. I am a nurse, my job is to take care of patients and that’s how I was treated. Really great.
I agree but this is a Baby Company. CEO Ying Liu should have at least respected that this employee had her baby in NCIU and was just asking for remote work until her baby was out of danger. I honestly wouldn't want to come back to a company that treated me this way when i was dealing with whether my child would live or not. When someone shows you the first time how they are, believe that that is who they really are and how they feel. It's mind boggling that a company that produces baby clothes doesn't actually care about babies and their parents.

The first kyte video was saying they would "find her a job" when she returned. Basically they would find her a bottom of the barrel, low paying, menial job to force her to leave, so they won't have to fire her, she will eventually be forced to quit due to low wages not being worth the time it would take from her baby.
"We will find her a position when she decides to come back."
This means she will not get HER JOB back. She will get A job, probably NOTHING to do with her current position she got a promotion to (probably less pay and lesser of a position that the woman worked hard for)

This is also illegal (in the US) as maternity leave is a legally protected right. You cannot fire a woman for being pregnant. You are required to give the mother her job back at the same pay rate and with substantially similar duties. IANAL, but Marissa would potentially have legal claims for all of this.
This is a widespread problem in America. Companies and their bottom lines are always more important than individuals, their families, and their needs and concerns (especially medical needs) and it’s reflected in the laws. I’m glad Marissa’s story is getting some attention, but there is literally an unimaginable number of people that have been in the same situation without media coverage, financial support, and business owners apologizing for what is considered “normal” and legal actions. I hope this makes people aware of actual issues, like parental leave and job security, that need to be addressed in this country. Especially in a place that claims to value children and babies so much
Meanwhile, in Norway, every new parent is entiteled to paid parental leave for 49 weeks for each family - with 3 weeks reserved for mum before birth (because a heavily pregnant mum needs rest) and 15 for after, 15 weeks are reserved for dad and 16 weeks for the parents to divide however they see fit. Biological or adoptee, you have the same rights BY LAW. Because that's what's best for the babys developement and health.
What's the pay like for maternity/parental leave in Norway?
UK gets 52 weeks but it's at £172 or 90% of their normal salary (which ever is lower) per week
@@savage_optimist Indeed I did. 49 weeks with 100% pay. Or you could go for 59 weeks with 80% pay. In addittion, each parent is entitled to 12 months of unpaid leave if they want it. Oh, and if your child is ill and needs to stay home from kindergarden/school, each parent has 10 days of paid sickleave pr year. Oh, and if a child is severely ill (preemie, cancer, hospitalization ill for more than a few days) you get paid leave for that too, which is called 'pleiepenger' which rougly translate to 'nursing leave' and is separate from the 10 days of sick leave and parental leave.
Oh, and still our taxes aren't higher than in the USA.

I lost our baby at 22 weeks and she passed and I worked at a childcare center and I had to take my pto and was out 5 days and had to take pto for the follow up appointment. I quit a few months after. my heart hurts for her

It happened in October of 2019 and it wasn’t until the pandemic happened I really started to heal. Our rainbow baby came in June of 21 . It helps to talk about her and we take time in Oct to breath and love each other

I just got 3 weeks of PTO this year after being at my current corporate job for 3 years. The 3 weeks includes personal pay, sick pay, & vacation.
Previously I was only at 2 weeks of PTO and I did this for 2 years. 80 hours of PTO for EVERYTHING. It was absolutely brutal and we didn't even get all of our Holidays off either. (And salary of course, can't get paid for OT or Holidays)
These last 2 years made my mind keep rushing back to my sister who works at Amazon and casually able to take off 2 months just because she was "tired" while only working 3 shifts / 12 hours each a week.
I am 1000% bitter.
The "find a position for you when you get back." Had me raising my brow...I'm sure that's why she specified in the second video that her original job will be waiting for her.
But the FMLA does specify that it doesn't have to be your specific job waiting for you... Just a job waiting for you
Here in Spain you have the same leave and rights for an adopted baby than for a biological baby. You are a parent in front of the law. Period.

I was adopted as a baby. My adopted mom is my mom. She is just as legitimate of a parent as any other, and i’d even say she is a better parent than most. I still visit my biological family but my adopted family is, to me, my real family. My whole life, however, people outside of the family have challenged this reality and questioned our familial bonds… it’s tiring, especially when my family is healthier and stronger than any other family I know.

Adopted child here. Pretty annoyed by the whole thing. An interesting fact. On Yings page in her Q +A section it says one of her first jobs was as an interpreter for Chinese adoption companies. I have no idea if this was added after the controversy but it feels as if she of all people should understand the adoption process and respect adoptive parents.

Sadly this is the state of the US system. There’s no mandatory maternity leave or paternity leave. Get sick, get fired. This is why so much is going on in the employment sector now.
I have a goddaughter who was born via surrogate and her bio parents aren’t the same people who are her parents but the parents are still her parents period. No matter how the child is born.

And that's if they get paternity leave at all. In so many companies in the US paternity leave isn't even a thing. "Why do you have to stay home with the baby? You weren't the one who gave birth!" It's truly awful.
Yeah companies in the US are awful as f*ck to their employees. My aast job I had before I became a stay at home wife and mom I had a medical emergency and missed work then after I recovered I showed them my paper work about it and excuse for missing work and I got told how inconvenient it was of me to have my emergency on a Friday as they were very busy then and needed me. And I was wrote up for that and told to try not to have a life threatening medical crisis during peak business time. 😂
@@jenniferhof9448 maternity leave is definitely hard to come by and paternity leave is even worse. About 7 years ago I worked for an international company who's so large they sponsor major sports teams abroad. They sponsored a few small teams where their different companies headquarters were located, but I say this to show just how big they were. They had started to change a lot of their policies to mimic those in Western and Northern Europe, so people regardless of marital status or orientation got both paternity and maternity leave for 12 weeks at full pay and if there were complications after that time, FMLA kicked in and short term disability at 100% for an additional 12 weeks. Our part of the business. as we were a company under their umbrella, then got taken over by business headquartered in Bermuda for tax purposes, but was run on the policies in the States, which means all sorts of progressive policies were rolled back to the barest of bones.
@@kateri35 unfortunately, I completely understand. I was let go because of my disability. And many people would say, but they can't do that if your disability is covered by the ADA. Wrong. In an at-will state, they can "let you go" aka fire you without cause if they "eliminate" your position. It's how my company got away with A LOT of things and fired a lot of people. The thing that pissed me off about it was, just because I was physically disabled and occasionally needed time off for surgeries (like once every other year or so) and a day here or there for different procedures, my mind was fine. So my body had issues beyond my control, but I could still do my job. But companies just don't care. And I feel like, at least within the next decade, it will only get worse the legal system rolling back all sorts of protection laws for people.

The socioeconomic incentivisation of "hustle culture" in the US is nothing new, and I hate it so much. I understand rewarding people for working hard, but things like health, safety, dignity, and the ability to prioritize family over work should NOT be luxuries reserved for the upper class.

The specific verbiage around Marissa being "fired" without actually being fired isn't to make her guilty- it's because you can get unemployment benefits and severance if you're fired and you can't if you just quit. They want to deprive her of support after firing her.
Just when you think humans couldn’t be anymore garbage, life says “wait hold my beer”. It’s absolutely heart breaking. I feel the mother’s pain. My nephew was born at 22 weeks as well. He was so tiny and had to live in the intensive nicu for a year and a couple of weeks. The doctors were set he was not going to make it but my lil dude was a warrior and fought with everything he had. He is now 11 years old.
They didn't say, "you're relinqishing your job," because they wanted to guilt her; they said that because they didn't want to pay a higher unemployment tax to the government.
While the company is legally correct they are morally wrong. Like of all companies you'd expect to support mothers it'd be baby companies but nah. They also don't care and are stingy with giving maternity leave.

They were not legally correct. Thays why they worded it that way to skirt the law.
If she wasn’t too far from reaching one year someone could have had her back and told her if you work x amount of days you’ll qualify for leave. Obviously if it was reasonable amount of days. If I worked HR I would try to get whatever I could for mom.
They were trying to deny her maternity leave or leave for an adoption, that is illegal. And you don't have to work for a company for a year to have maternity and adoption leave covered. They are both legally and morally incorrect!
@@brandicrane6614 She didn’t qualify for FMLA. She was given a two week maternity/parental leave per the company’s policy. She doesn’t have a legal case. Unfortunately, this happens to people all the time. Parents often have to stop working to take care of their kids.
I gave birth when I was younger, wasn’t ready to be a mother, and was so lucky that the amazing woman that adopted my son was able to take maternity leave on short notice and for a few months. So grateful for her employer. Ugh screw kite baby!!!
You would think that a company built around babies would be more than happy to help a new mother out in a tough time. The fact that they didn't just proves that they're in it for the money, not the babies.
Large companies do NOT care about you or their employees. They care about money and that is literally it. They can put out brand statements and promise sustainability and promise to treat their employees well, that doesn’t mean anything. They don’t care. If it’s not making them money, they aren’t going to do it.

There’s not much use getting rid of a product you’ve already bought since it just creates more waste (unless you plan on donating it, which would be ideal of course!). Use it as intended, if it’s a good product- it’s a good product. As long as there’s the awareness around the brand and you don’t promote it, it shouldn’t be an issue

This is USA where workers are not protected, there is no proper maternity leave, sick leave and that poor girl is PAYING for adoption. That would never happen in my country.
It’s because they care more about corporations. Even, the party that is more interested in social justice, they are even beholden to companies at this point. The corruption in our country is absolutely horrifying. I saw someone once in a comment section say, oh so it’s the US once again masquerading as a first world country. Which is so true.
i work for a corporation. I don’t get any sick/medical days off. Just the paid “personal” time off that I earn throughout the year. And the time off you earn throughout the year expires at the end of the year. It’s hell living in America.

I'm from England and on an apprenticeship (I'm getting a qualification while working instead of going to college or uni I also get paid 5.28 an hour) at a school, I get 28 paid full sick days and 20 days paid full personal time not including bank and national holidays, my school also offers full paid 2 year maternity leave.

Its really stupid that employees need to work at a company for such a long period of time before they qualify for Family Medical Leave A...accommodations?...(FMLA) protection. I have had to fight for FMLA because I was part time most of my time at a company. Im glad there is a conversation around family leave, hopefully this topic will go somewhere. Lots of disabled employees end up having to go on social security insurance because corporations refuse to make accommodations unless forced by the government, which is on the side of companies in most cases.
It really sucks, BUT I can see why they do this. Since you cannot ask or know about a person's pregnancy as part of a job interview (by law) there is a problem where a job seeker could get employment with you, immediately go on mat leave, and then leave you. And companies don't want to incentivize this, so they make you "earn" such leaves. There should be a legal overhaul here to both protect pregnant women from being discriminated against at jobs, but also keep employees from just getting a job for the mat leave and never actually working

As someone who has to deal with FMLA leave for employees, it is absolutely ridiculous how long an employee has to work to qualify for it.
If you arent the birth mother people don't respect you. My sis is the main mother role to her husband's kids. The school for so long kept calling the birth mother even though they don't have any rights to the kids. Instead of calling her or her husband. The woman even said they shouldn't be calling her.
So interestingly my sister in law in the Uk had a similar situation, however she’d been working at this company for years. Because she was adopting she was put entitled to maternity leave, which is a huge problem as if you’re adopting there are certain time frames they say you MUST be with the child, especially as is the case with most adoptions the child isn’t a new born baby. She fought it, threatened to take them to court over equality rights & before it even got that far they backed down and changed the companies policy. A huge win. However it seems mental this can be a thing in the first place.

I was adopted from Seoul, Korea to an Irish American family of 5. I don’t think i was ever told how much it was to adopt me. The crazy thing is why is it so friggin expensive to adopt a child when there are so many children that need to be adopted.
Because of the process of it was cheap a lot more kids would be in abusive situations
Yeah im 25wks preg and will be actively avoiding this brand. One of my best friends has gone through this same struggle and is now looking into adoption and its taken everything out of her. This is infuriating and disgusting.

My first child was in the nicu for 11 days. My husband went back to work after a week because his company wasn’t required to give paternity leave and he didn’t have enough vacation. The United States is beyond behind the rest of the developed world when it comes to having children. It is so sad how often this happens to parents with infants in the nicu.

My mom went through the same shit. Only difference is I wasn’t born premature. Even still, my mom tried to work from home but her company said, no your maternity leave is over. Come in and work or be fired. So she quit :(

Why would you ask strangers for money to fund your adoption? If you can’t afford the adoption, that means you are not fit to be a parent. Baby needs a lot of money, what are they gonna do? Ask strangers for money everytime the baby gets sick?

What’s even more heartbreaking is imagining how Marissa feels having tried for years to give birth and then feeling like she failed as a mother to then get treated as an illegitimate parent or that she’s less than because she adopted. Especially by this specific company. And with a sick baby at that 😢 I can’t imagine the strain this has all had on her mental health, she’s been through so much. I truly hope and pray her son makes a full recovery and lives a long healthy and happy life.
Why doesn’t she have maternity leave? Here in Canada, mothers get 12-months of paid leave and job protection. This seems like a HUGE human rights issue

American politicians have been saying they'll make paid maternity leave a thing since the 80s. Not happening cuz none of them give a fuck. And even what we have, up to 12 weeks unpaid, is new. Only became law in 1993.

In the US you're only guaranteed maternity leave by law if you've worked for your company full-time (40 hours per week) for at least one full year. Depending on the state and whether you had a vaginal birth or c-section you get between 6 and 12 weeks. In most states it's not required to be paid leave, just that you're allowed to take the time off without getting fired from your job.

One issue for the employer is that once you give special privileges to one employee, you have to give it to all of them or risk being sued.
and from a business point of view, having an employee off until around april with pay is costly especially when you consider someone else will need to be paid to be on site to do the jobs that she can’t do remotely. definitely a difficult situation that was handled badly though.

Ying Liu is horrible. No compassion, empathy or kindness. You can see how phony she is when spits out her scripted apology and can barely get out the word adopted. Just terrible treatment from a baby company.
The fact that this is a baby clothing company, but yet the CEO cares less about adoptive parents, parents who are grieving the loss of a pregnancy, etc is sick and twisted. People act like work is the most important thing in the world and the only thing they should matter in life. Now while it’s definitely important, family is more important. My mom’s old job before she retired wouldn’t let her take time off to care for my dad who was in poor health. But they would let other people take a few weeks off. And it wasn’t like she didn’t have hours to take off. She a few weeks worth.
And they keep wondering why birth rates are dropping. Well here’s one reason. That poor woman, I hope she’s doing well.
