I WAS ONCE PULLED OVER BY POLICE BECAUSE IT WAS "LATE" - GONE 11PM. In my rural area we had our weekly mid-week music night where we'd perform. I was in my early middle age and I was the designated driver that week. I'd dropped the others off and was just heading home and the police guy said he'd stopped me because it was coming up to midnight. I was polite and said I hadn't had a curfew in decades.

Being stopped by the police all the time is one of the many reasons I gave up delivery driving for Domino's. I've always played the high risk/high reward card of brutal, yet respectful honesty. I've admitted 80 in a 70, 50 in a 30 and 100 in a 60 over the years and was always let go with a warning. I was stopped the day after the nationwide 50mph blanket speed limit expired after the energy crisis in the 70s (3 day week and all that). The officer had not been told that the limit had been removed and had to radio for confirmation that I was telling the truth. I was doing 60 on a dual carriageway. I resisted a gloat and went on my way.

I've found most to be ok but some just don't like to admit when they are wrong. About 10 years ago, I was driving on the Hertfordshire section of the M25 at about 60mph in the left lane & approached a land rover towing a trailer in the outside lane at around 55. It was about 10pm so was not very busy. I sat there for a while to give him a chance to move across then decided he was not going to, so dropped down a gear & floored it just long enough to get past & not exceed the speed limit. I was then pulled over by an unmarked police vehicle. They were already being obnoxious but it got more amusing:
Them: "Do you know why we've stopped you?"
Me: "Probably for passing on the left a vehicle that should not have been in the right lane in the first place"
Them: "Who said he should not have been there"
Me: "The law does. Whenever safe, he should be on the left. As officers, you should know that"
Them: "There is no such law"
Me: "Yes there is. It was passed in the early 90s. I remember reading about it soon after I passed my test"
Them: "We were going to pull him over in another 10 seconds or so"
(why were they going to do this if it was inconsistent with their earlier statement?)
Them: "What car were you driving?"
Me: "If you look at the boot lid, it says Lotus Elan. That's because it's a Lotus Elan."
(we were in the police car sitting behind it. I could read it quite clearly from the back seat, so what a stupid question!).
Them: "What would have happened if he had decided to change lanes?"
(I had dropped down a gear & had floored it. A Lotus Elan turbo is not exactly slow & the turbo had kicked in. The car towing was a Land Rover. I would have been long gone by the time it got anywhere near my lane).
Them: "We are going to charge you with driving without due care & attention."
I was looking forward to making them look foolish in court. Funnily enough, I never heard anything more.

Was this some years ago? there was a chief constable who had a real down on motorists and the cops around the expressway were known as the traffic Taliban because they became with his blessing a law unto themselves.
This altered somewhat when a local man whose brother was a criminal was constantly being stopped for no good reason or logic other than as a "gotya" so he sued the chief constable and the police force for continued harassment, police went to court having asked for the judge to throw it out on the grounds they were checking up on the grounds they were keeping tabs on relatives of not a nice man, but the judge found against them issued a order for compensation and had the chief constable write an apology to the bloke plus said he would take a dim view if the police did not change its tactics. the chief constable disappeared and things along the North Welsh coast became smoother.

I carry a pair of scissors in the boot of my car to allow me or my partner to cut off the cable ties that retain the plastic wheel trims if we ever need to change a tyre. I bought some pair of Fiskars Child Scissors for this purpose as they are very short and have completely blunt ends. On the matter of the police caution, surely such caution is not normally provided prior to a stopped driver being asked, as per your example, to state the speed of his or her vehicle?
Secondly, doesn’t the police caution’s statement of permissible inferences drawn from a suspect’s silence when questioned, in fact refer to statements made with the benefit of counsel’s (a lawyer’s) advice? Surely it cannot be the case that the law de facto compels the excited utterances of nervous drivers pulled over by the police?

I'd recommend filming them, you can either make it obvious or film discreetly, but make sure the engine is switched off and the parking brake is on if holding the camera or phone in your hand.
The police will often lie and make things up to try and justify their actions, so having video or audio evidence is very helpful. It got me £4000 in compensation for a false arrest back in 2011, after two officers wrote in their police notebooks that I made a statement that I never made. Once they saw the video which I'd already posted to TH-cam back then, they had no choice but to accept my claim and pay me out.
Since then, I don't trust anyone who is wearing a police uniform, always film or record them whenever you can to protect yourself.

Don't behave like Ricardo Dos Santos and Bianca Williams and escalate the stop yourself and then give it the racial profiling line instead of actually admitting you didn't stop when asked to and drove home instead. Stop the car and be polite, even if it's the 20th time you've been stopped that week or you are disagreeing with what has been alleged you've done wrong. I've been stopped occasionally over 34 years of driving and riding motorbikes or scooters a few times for various things, and whether I'm in the right or wrong I've never kicked off, never escalated the stop with attitude, and never admitted anything, and I've been pulled for running red or amber lights, not turning my lights on quick enough after exiting a lit multi-storey car park in the early evening, speeding, having anti-flash number plates that made officers wonder why the digits disappeared in their headlights, filtering,(undertaking) on the motorway on a motorbike, and probably plenty of other things. I have never had any points or any trouble avoiding getting them. I even deliberately got my brother pulled over many years ago by staring at the officers in a patrol car as we passed just for a laugh, he wasn't amused when they went through the car and dissed his musical taste.

    Searching the vehicle. ...
This might form the basis for an interesting video. I do gardening and general handyman work. In my car I often have a small chainsaw [12 inch blade], hedge-hook [a heavy scythe on a four foot handle], a large axe, saws, screw drivers, a very sharp four pronged garden fork, and a small [but very sharp] spade and other potential weapons if so used. I do not carry a knife as such, but a chisel makes a good substitute for cutting rope or string, as well as tidying wooden joints as intended.
Would I need to remove all my work tools for a visit to the Co op, or other non-work purposes?

I'm no barrister but if you can show that you work consistently as a gardener then you have every right to have your tools with you that are clearly gardening tools, or plumbing or electrician etc... If there is a knife in the glove compartment in the front of the vehicle, that's a different situation and the police probably would arrest you for it

I don’t know what the procedure is the UK. In the US you can simply lock the doors as you exit and the cops aren’t allowed to break them to get into the car and you don’t have to unlock it for them.
And if they’re going to take your key from you to open the door then they’ve just performed a custodial arrest where they have to have more evidence then a simple traffic stop. The real cheat code is if you drive a ford vehicle with the keyless entry pad, you can throw the key on the floor board and hit the 7-9 buttons when you get out and the vehicle is locked with no key on your person and they can’t beat the code out of you. At this point the cops have to tow the vehicle and get a warrant to search it.
Usually at this point they’ll have to call their supervisors or watch commander to explain the situation and the command staff officers are more likely to be concerned with legal liability

They once made me go to court because i had misplaced my licence and was waiting for it to come from the dvla even though i gave them my driver number. I had to go into court and plead not guilty to driving without a licence. Eventually i was able to show my new delivered licence at the fines office whilst the case was adjourned - how crazy is that?

    • @deang5622
      @deang5622 ปีที่แล้ว +5

It is laziness by the coppers.
I am amazed that they are this stupid.
Because they have access to the DVLA database, they can check by making a radio call that you do have a valid driving license.
The fact you can't present one at the road side, and there is no legal obligation for drivers to carry it on their person, doesn't mean to say you are not the holder of a valid licence.
I don't know why they are so stupid.

I was pulled over by police in my company van for not displaying a tax disc. ( remember those?) A group of trainee coppers surrounded my vehicle and listened to the traffic officer talking to me. The reason there was no tax disc was because new windscreen was fitted 6 days earlier and the guy forgot about swapping the tax disc over. The vehicle was in fact taxed but the disc was not showing. The officer lectured me about if it wasn't taxed you could not drive the vehicle on the road. At some point, another motorist who was pulled at this checkpoint pointed out to the officer that HIS POLICE traffic car had an out of date tax disc showing. Huge amounts of humble pie and red faces all around by police.
