      USA military has had classified information leak through members of there organisation countless times.
      One of the most prominent examples in recent history was the global interest story of Manning being arrested for leaking classified documents to Wikileaks. This particular issue is still ongoing and is linked to the Julian Assange situation.
      But to the point of whether the leaking of classified information in this instance, or many other similar instances that this public example belies, deterred other western partners from sharing intelligence with the USA. There is no basis to that claim, and on the contrary, we have seen western military alliances bolstered in the wake of this public instance of leaking, best exemplified by the AUKUS deal.
      The motivations for state power cooperation is a confluence of many strategic and ideological circumstances; if credence to competence of argument is given, then to use potential diplomatic struggle as a defense in the prosecution of a whistle-blower is not only baseless, but disingenuous.
      David, I can only imagine how harrowing this experience is for you, but I assume it must be galling to see the courts of Australia, which you have fought to protect, and are still fighting to protect, operate in this fashion.

      If you want a funny example, search up the various War Thunder leaks. War Thunder is an online military simulation game that has a legendary reputation for players leaking classified military intelligence on the games public forums to win online arguments about whose military equipment is better. So far (as I’m aware) there has been leaks on that forum from China, Russia, USA, Britain, and France. Definitely worth the reading.

    As a German: The Nuremberg defense isn't considered acceptable and it's mocked as a fake argument. Every soldier has a duty to his country and its people and his own conscience. This includes refusing to carry out orders that would amount to crimes against humanity. In fact, in Germany, the law is that a soldier MUST NOT follow orders that would lead to human rights violations. A soldier also MUST NOT follow orders that would definitely lead to serious injury or death. Unlawful orders are to be refused.
    The fact that an Australian judge thinks the Nuremberg defense is valid is absolutely atrocious. It's a fascist argument.
    In international law (particularly for war crimes), there is limited culpability: If a soldier KNOWS that his orders are unlawful, he must not carry them out.
    There also is full culpability for crimes against humanity: Crimes against humanity are deemed "obviously unlawful" and any soldier carrying out crimes against humanity (e.g. massacres, genocide, apartheid, etc.) is culpable for those crimes.
    The Nuremberg defense isn't a real thing. It's not considered a valid argument. A soldier must not carry out unlawful orders, no matter what their superior officers say.
    Something is seriously wrong in Australia if a soldier is expected to carry out war crimes if ordered to do so.

      I wonder if this and how it's spin in the mainstream murderous Murdoch press gets reported.
      Must follow orders, what a sham. What about the episode friendly jordies did on the SAS member, what was the difference between him and a mid last century SS criminal.
      If David McBride goes to jail I think he will need to be seperate from other inmates for fear of educating them about our political and legal system

      ​@@NathanCroucher The key word is "definitely" (i.e. suicide missions or missions that are guaranteed to injure them). Storming a mountain might lead to casualties, but also might not in case it succeeds, so ordering it (in good faith) is a lawful order.

    The Duty of a solider is to hold his fellow soldiers to a high standard. This includes reporting their misconduct. This includes stopping their misconduct. This includes arresting their ranking Officers for their misconduct. This has always been the Duty of a solider and will remain so no matter what this judge thinks.

    It’s very telling that successive governments prioritise protecting corruption by punishing morality. The irony is if the war crimes has been diligently investigated from day one, many of us would be more supportive and trust these institutions more, not less!!

    It's absurd. It is in the national interest. The government interest is embedded in corporate interest. Corporate interest is global shareholders. Research politicians share folios, former corporate jobs, upcoming corporate jobs etc.. Where does their interest lay, with the majority of Australians, or with their pockets?

    Watching from Portugal, but like someone once said, "Injustice anywhere is a threat to justice everywhere." You did the right thing, and although platitudes can't make it easier for you to bear the consequences of standing up to corrupt institutions, I hope you'll take some measure of comfort in knowing that you serve as an inspiration for others anywhere in the world to do the right thing. Even, especially, when it is so difficult to do so. Best of luck mate, we'll be watching.✊

    David, take solace that whatever way this goes people are seeing bit by bit how weak the moral compass at the top of this country is and one day, hopefully before long, it'll reach a critical mass that starts to see the rug pulled out from under those who aren't fit to stand on it.
    Something concerning that I've noticed though in bringing this up with people more proactively over the last few days, is that quite a few people have the Ben Roberts Smith story in their heads alongside the justification, "who are we to judge what our military *have* to do?" (Paraphrasing, but its a consistent variation on those lines - anyone else noticing this?). I'd say to anyone else also trying to bring this to people's attention beyond their regular social sphere: steer people gently around. I'm finding that a mention of how the government has harped on about 'whistleblower protections' in recent past paired with something like 'just imagine seeing something illegal in your workplace and using your available whistleblowing channels only to be dragged before a court for it would feel" gives people pause, along with 'hypotheticalising' that the actual criminal elements see no such scrutiny. It gives some people pause, and thats when to pivot to not having to use any imagination about it at all if your names David McBride.

    Surely preventing future war crimes would constitute preservation of life, or at the very least harm prevention. Wether it is a matter of saving Afghani lives, or preventing the suicides that occur once the fog of war clears and veterans have to come to terms with their actions. I think it would be far worse to keep quiet and effectively become complicit in these crimes.

    A couole of years ago in the UK, a senior official working in the MoD named Lapsley left top-secret documents at a bus stop. They were found by a member of the public and handed in to the BBC.
    They apparently covered UK navy vessel locations and stuff about Afghanistan.
    Most people suspect it was a dead drop that went wrong when a well-meaning member of the public found the documents rather than their intended recipient.
    Lapsley claimed it was an accident and was promoted to a position in Brussels...
    Shortly afterwards, a UK navy vessel was almost hit by a Russian missile 'test' or something like that. I can't remember all the details but you can probably goggle the details.
    But UK still in 5 eyes... so didn't affect their standing

    Dear Prime Minister.
    Today I’m driving from Sydney into the southern highlands.
    I used to drive Remembrance Driveway very regularly to take school children to Canberra as a coach driver to give them a tour to show them the fundamentals of what it means to be an Australian.
    As I see the rest areas named after deserving servicemen and women; recipients of the Victoria Cross medal. Todays drive feels different.
    What does a VC mean? Does it mean anything?
    I used to be confident that BC recipients were the most honourable people that deserved my reflection and Australian pride.
    Is a person still honourable if their dishonourable acts are private? Are they still honourable and deserving of recognition for valiant conduct of their crimes are secret?
    The prosecution of David McBride diminishes my confidence that each recipient of any accolade may not actually be deserving of that award, recognition, reflection or my patriotism.
    My Australianism feels wounded with this gross misuse of justice. I don’t even feel like watching Australia play in the cricket because of the hurt caused by your government in this instance.
    At the entrance of every defence facility there are large signs which state the values of Australian troops. One of those signs reads “integrity”
    Integrity is meaningless of you are punished for displaying acts of integrity.
    Mr McBride’s actions were not necessarily whistleblowing; they were a careful act of utmost integrity.
    All Australians have this deep sense of righteous inside their souls and sometimes that sense of righteous and commitment to integrity.
    The prosecution of Mr McBride is the prosecution of being Australian. If found guilty; he has committed the crime of being Australian; committed the crime of displaying and executing utmost integrity.
    If the conviction of Mr McBride is so important for you to appear as a strong leader then that is a legacy that you need to embrace Mr Albanese.

    Judge David Mossop believes the Nerumberg defense holds merit and that duty to the military above the people of this country is paramount...seems impartial -_-
    "Justice Mossop said he would be directing the jury, which had been expected to be empanelled on Thursday, that McBride had no duty to act in the Australian public interest in circumstances where it conflicted with orders".

    Leak risk is a valid argument though. This is the reason why they don't leave it up to individuals to make decisions whether they release sensitive info publicly. This is the entire reason you're in this position. And you still don't get it.
