The 6 year rule also states that the property can be taken off the rent market and left vacant within the 6 years which is a glaring inconsistency with having to move back in and prove you live there again. I'm totally confused about this. Also how does one prove ones belongings are there? Do you have to provide date stamped photos of your belongings? The whole thing seems to be an intentionally confusing vague mess created by the ATO to cover all bases to make sure they get your money. If you do everything right they will just bring up the contradicting rules and say you didn't follow them. You cannot follow contradicting rules. They also do not state how long you must reside there after being away for the rule to reset. There seems to be no specific length of time.

Thank you for the video on the 6 year absence rule; CGT Concessions. If it is the same scenario of ownership, but instead of being absent from your home, you rent out a part of your residence while you still live in it (you don't need the space and the extra income is helpful), - what happens then, do you still qualify for the 6-year absence rule? Will CGT be applied if sold? Thank you.

I am living overseas renting, and have an investment property in Australia. If I move back to Australia and live in the investment property for a few months, can it be considered to be my primary residence?
