@peachesrambo4037 america is a free nation. of course it has flaws like every nation, but you can sue a cop that is detaining you without a reason. (and i dont even live in the us so this is not just me being patriotic)
Yeah you "can sue" and yeah America is a "free nation" but a majority of the time a judge will side with the cop and it'll just be you paying a lawyer money for nothing.
There have been plenty of payouts from these lawsuits. The thing that most often will occur (in the situation you guys are describing) is the police agency you're in a suit with will eventually (sometimes very quickly) make an offer to settle. The majority of people will take that offer, or if the initial offer is too low, will take a subsequent offer for a higher dollar amount, depending on the specifics of the case. Yes, you do have to pay an attorney (they don't usually work for free), but oftentimes you'll find one who is willing to take the case with an agreement of being paid a percentage of your settlement. That will usually be about ⅓ of whatever you get. So, in the end, you'll keep about ⅔ of the settlement. Now, depending on the actual lawsuit, the specifics of what actually occurred, and the evidence you have to show what happened, we can be talking about a very large sum of money in a short period of time. Law enforcement agencies have insurance policies for civil litigation. So, that is where this money comes from. I know it's a common belief that the police just take money from taxpayers to pay out these settlements and then continue abusing people, but that isn't really what happens. This not only will make their premiums increase, but people in their jurisdiction will often know the name(s) of the offending officer(s) and demand they be let go. If the agency is generally good, they'll fire the officer(s) regardless of any protests. So, if something like this happens to you, don't not act because you assume nothing will ever come of it. Try to make sure there is evidence, such as a recording you made during the incident. Don't just count on obtaining the body worn camera recording during discovery, as they sometimes have a way of deleting the footage 'totally by accident'. Then, contact some attorneys. Many have free consultations. Hopefully, that's helpful. If Mike (or any other attorney) sees this and wants to jump in here, he can certainly add more to this. Especially if they want to get into the weeds of section 1983. This isn't legal advice, and I'm not your attorney.
Don’t cops usually say “yes I’m detaining you” and don’t give a reason as to why by dodging the question or make up some random crime. What can we do then?
if they say you’re being detained, you just record at that point and stop speaking. if there’s no legitimate reason the cop is already fucking up, at that point you let them continue and you deal with things in court.
If only cops were this easy to work with most the time they’re still going to hold you back not answer you when asking”am I being detained” until you ask about 5 times
No matter what, just say "I'm heading home from the grocery store and I've got ice cream melting in my bags". This is cooperating, and establishes a benign common activity that can't be associated with drinking, plus it gives you a reason to be impatient and anxious to get on your way without seeming suspicious. It's brilliant!
I've seen enough videos from real interactions with cops to know this will have you slammed on to the ground with two cops debating how to best frame you for drug possession
I had a headlight out and was driving home from work at night (headlight was being shipped so nothing i can do) saw a cop pull out behind me so i decided to pull over to get it over with. The cop thought i was trying to avoid him which is understandable. He asked where i was going i said home and he said why did you pull over, told him because i wanted to get the headlight issue dealt with because i knew you would pull me over. He searched my whole car and me, kept me for about 20 minutes and after he found nothing still didn’t admit that I could be telling the truth, that i was hiding something. I wish i knew mikes tips then😊
they can legally use a k9 on your car, but they need to have reasonable suspicion to do so. they can’t just say ‘i feel like searching your car but you won’t let me so i’m gonna make the k9 false alert and do it anyway (they actually do this most k9s will literally alert on command) ‘ they’d need to have some form of legitimate suspicion
I once got pulled over and I told them I am going to the movies with friends and he said ok and made me wait 45 minutes for a k9 that never showed up and then sent me in my way and I was late for my movies so I didn’t go because was half way through
“Heres some fun tips and tricks to prevent you from being shot by the people who’s motto is “protect and serve”” Its apocalyptic that this is needed. But thank you for sharing and actually helping protect people from harm.
Yeah, except where Im from doing this is when they rip you out of the car, pepper spray you, charge you will resisting, and leave you in the ER. Yeah sure, the charges against you eventually get dropped, but the cop goes on like nothing happened, meanwhile you lose your job because you cant work for 2 months while your ribs and face are broken. The damage is done and the bully cop gets to go about his day. But being completely compliant to minimal shit, even to technically unlawful orders, increases the chances of making it home alive.
@@CrocsDinerAjA problem is still a problem, and it exists. We can't figure out if a cop is good or corrupt until we get screwed up over nothing. The best decision is not taking any chances.

Depends on what state you’re in. In many smelling weed or alcohol is specifically labeled as not probable cause because there’s no way to verify if there actually is a smell
My bad
@@JBlandfordIf a police officer can distinctively smell weed, in ALL 50 states, a officer can legally call in a K-9 to sniff the vehicle, and it’s legal, and if the dog senses that there could be drugs or etc, then the police can drag you out of your vehicle to search it.
@@alexx960 you are wrong. This is directly from a criminal law firm. “More importantly, in Massachusetts, the mere presence of “an odor of burnt marijuana”, without more, cannot reasonably provide police with suspicion of criminal activity to justify an exit order or search of the car after this change in the law. So held the Massachusetts Supreme Judicial Court in Commonwealth v. Cruz, 459 Mass 459 (2011).”
Aw the K-9 could be a support dog too!
But they are always aware of their surroundings
K-9 dogs are abused to become police dogs. That's the truth. Dont support legalized animal abuse.
I tried this once and the cop didn’t answer if I was detained or free to go. He just walked back to his car and didn’t come back until a K9 was there. This works in theory, but if they want to they will search your car
Instructions unclear officer is *lubing* a baton.
I have literally watched a cop say "the k9 in 25 min away, that seems reasonable" after pulling over dude doing 10kph UNDER speed limit. Dog didnt alert and they let guy go after like 45 min
Can't you legally get ticketed for going 10 under unless it's like inclement weather or you're pulled to the side with your hazards on
@znerd3664 no, not here in canada atleast. Your 100% allowed to go 40 in a 50. I think if ur doing like 20 or something you can be ticketed for impending the flow of traffic
See this is a perfect scenario and a reasonable cop. In real life they won’t cooperate

True, the cops have never violated innocent people's rights. @@jeremyporter897
@@jeremyporter897 I understand you've never been confronted by a cop when you've done nothing wrong, but believe it or not it does happen.
There is a reason one of the fundamental principles of the American justice system is supposed to be "innocent until proven guilty." Authority finding excuses to fuck with people just because they can is obviously not a problem just criminals have, because 300 years ago the dudes who literally founded your government knew this was how innocent people become the victims of those in power.
But if you wanna lick boots just cuz you like the taste, then by all means keep attacking everyone except the person standing on your face.
@@jeremyporter897no, more like because cops are all on power trips and shit bricks whenever you exercise your constitutional rights instead of allowing them to violate your privacy and completely destroy and ransack your car for no reason. any time people refuse a search the cops all of the sudden ‘smell weed’ and then search the car anyway (which is a violation of the fourth amendment, and it is also a crime to make up probable cause that doesn’t exist.) go take your bootlicking elsewhere

That's pretty stupid of you, American laws only apply in America. Also Take note Americans, your laws and rights don't apply in a foreign country
The thing is… the officer is never gonna say “ you free to go “ they’re always gonna say you’re being detained
if they do without a valid reason you can sue them, and they propably know that.
@@FRBFStudioslol yeah right, maybe in a free nation.
Unless the cop gets a power trip and detains you illegally and searches anyways. Seen a lot of this crap

Don’t cops usually say “yes I’m detaining you” and don’t give a reason as to why by dodging the question or make up some random crime. What can we do then?
You can't do shit.
if they say you’re being detained, you just record at that point and stop speaking. if there’s no legitimate reason the cop is already fucking up, at that point you let them continue and you deal with things in court.
If only cops were this easy to work with most the time they’re still going to hold you back not answer you when asking”am I being detained” until you ask about 5 times

I wish i knew mikes tips then😊
yeah you should’ve immediately refused that search. i hate cops
And never forget, that canine is a part of a search, and if they detain you for the dog, take them to court
they can legally use a k9 on your car, but they need to have reasonable suspicion to do so. they can’t just say ‘i feel like searching your car but you won’t let me so i’m gonna make the k9 false alert and do it anyway (they actually do this most k9s will literally alert on command) ‘ they’d need to have some form of legitimate suspicion
I wish it was like that in real life.🤷🏻♂️

Yeah, except where Im from doing this is when they rip you out of the car, pepper spray you, charge you will resisting, and leave you in the ER. Yeah sure, the charges against you eventually get dropped, but the cop goes on like nothing happened, meanwhile you lose your job because you cant work for 2 months while your ribs and face are broken. The damage is done and the bully cop gets to go about his day. But being completely compliant to minimal shit, even to technically unlawful orders, increases the chances of making it home alive.
