Atty when you does immediate vindication does this apply even if the vindication was done a day later or does it need to be in the exact moment so to say that it is immediate?

* Lapse of time is allowed between the vindication and the one doing the offense(proximatetime, not just immediately after)Example: Juan caught his wife and his friend in a compromising situation. Juan kills his friend thenext day - still considered proximate.
