Okay to clear it out... Spider-man is from the Marvel Comics, however, Marvel Studios do not own the rights to this character (technically), but they are owned by Sony.
Spider Man is from DC Comics, not Marvel. He wouldn't be in Avengers: Age of Ultron unless Marvel is collaborating with DC. And I've heard nothing of the sorts.
