EDIT: Apparently, according to Miranda law, only things Nogla had said cannot be used against him as evidence in court due to him not being read his rights or provided an attorney. So what I said above was wrong. However, not being provided/allowed a real attorney CAN be used as a way to appeal to a higher court to have the sentencing revoked and/or the trial re-done.

If you aren't read your Miranda rights they can not try you for a crime
Just like if you don't acknowledge that you understand your rights they also have no case against you as you can say you didn't understand your rights at the time and then they can not try you for that crime against
Actually in some cases if you have a really good lawyer they can get the case thrown out for them bot reading your miranda rights. Most lawyers dont try this, due to it being difficult and hard to prove. But it has happened before.
