Creating Muslim personal law board was the biggest blunder of independent Indian history after Kashmir, making mockery of the constitution. With that one stroke of liberal, secular Congress, it made half of the Muslim population just slave objects, taking away the equality and protection from Indian constitution. Shah Bano case put final nail in the coffin for muslim women. Story about camel in the tent must be imbibed on all of us, so that we never forget the lesson. UCC is the only way to fix this mess.
It was strongly apposed by Ambedkar as he wanted uniform civil code embedded in constitution from the very first day. But Congress leadership didn't agreed.

My own sister has been coerced severely into wearing the hijab. Most girls are emotionally or physically forced into the hijab but they will never admit it to outsiders because of some sense of loyalty to their religion.

When I was in school, I was once denied entry to classes because I was wearing pants that did not confirm to school uniform standards. It did not seem like I am being denied my right to education. No one in our class used to be in hijab or ghungat. Is this changed lately in our "secular" India? Does Quran now overrides school policies and code of conduct rules?
All this debate over sitting with Hijab inside the classrooms is uncalled for. Religious Fundamentalism as Mr. Gupta says will ensure that if this is allowed for one side now, just a few days later something similar would be coming up from some other side. Educational institutions should be left alone for teaching and UNIFORMS should be the common thing for everyone. Nothing more nothing less. Teens wearing Hijab or jeans in public or at home is their fundamental right. Some temples and Churches have dress codeas well for understandable reasons. I will repeat my earlier comment all religions are fundamental in their political manifestation, which is a creation of humans. All religions are inclusive at its spiritual level, which is a creation of God. One needs to understand a woman's rights in Islam to understand the Shah Bano case. Islam gives women right on their property (earned by them or their inheritance). Husbands cannot force wives to use their money for their family, including their children's upbringing. All that is the husbands respinsibility. Mehar is an amount fixed at time of marriage which women get when they get married not when they are divorced. Today the Mehar goes in lakhs in well to do families. Alimony is not a rule in Islam to balance the above. Makes sense?
@Pierre In A marriage in Islam is not a social or spiritual bond like in other religions its a Contract that 2 people agree to with witnesses. It's such a modern/futuristic concept that even in today's world that it is hard to accept. Mehar is not dowry its an amount that the husband has to pay as part of the contract. It's written up as a contract. The conditions of talaq which is the annulment of the contract from either can also be agreed in the marriage contract. Problem is that very few Muslims know or can express this concept and those who know do not want to discuss in a still patriarchal society. You misunderstood and were probably looking for flaws. I did not say that kids don't belong to the husband only. It only says that the finances needed for their upbringing is the fathers responsibility. Possession of Kids is given based on their best interests as any modern court would do. Everything that is old is not out dated. This notion of yours probably comes out of a perception rather than study.

The Sad thing is the true Islamic nations are getting more and more progressive and here people are getting more and more regressive. Like is Hijab necessary for education? Why don't Muslim guys wear Hijab at school? What's the need of that ? Is your clothing your identity?

My brother if you think hijab is one of the problems that distract other student or violate any rules or some fundamentalists have inflicted it on muslim girls then what is the best way to dispose of hijab. And research on the marriages and attire of women during Gupta ages. The ghoonghat was a part of the saree attire worn by women, not necessarily an oppressive symbol. Furthermore it has been there in every abrahamic religion, islam, judaism and christianity - you will still see nuns in India wearing hijab type clothing. Although as Islam became more conservative and popular, the ghoonghat became a truly oppressive thing. So the ghoonghat started later than Gupta period. Till the Gupta period indian women wearing uttariya and mostly by rich women's. And others only hide their breast. The artist, narrators, tv serials, movies, novel writter made Sadi contemporary to rugvedic to Gupta period.

Uniform Civil Code is the only way out. Ban and repeal all personal religions i.e. Hindu, Muslim, Christian, Anand (Sikhs), Parsi acts. Goa has a Uniform Civil Code inherited from the Portuguese. I think it's worth the risk.

An example of authorized hijab and turban wear with the Army Service Uniform (Source: Army Direction 2017-13) - "The material will be free of designs or markings, except that a Soldier wearing the Army Combat Uniform may wear a hijab or turban in a camouflage pattern matching the uniform," according to the directive.

I know what Goa Civil Code is as I have read it in detail about it. I suggested the Goa Civil Code as an example. Goa Civil Code could be adopted at the national level with changes/fixations/alterations etc or create a completely new from the base. And Goa Civil Code do have some problems or ambiguities but it still works. People of Goa use it more than than the separate religious ones.

You cannot change uniform suddenly. It is like abstaining people to not get education. When you introduce it as part of new academic year, those who still want to wear hijab won't enrol because that ll be contentious issue for them and there the denial of right to education won't come into picture.
@Susan Joseph i don't think they care, because i don't see any counter protest from them. In fact i have seen some media reports where those protesting Muslim girls said that religion and hijab is first priority, they were openly saying these things to reporters on camera. I forgot the name of that media outlet.
It's quiet simple- Mullahs/ PFI want to naturalize burkha among Muslim women. They will argue in court that hijab is an essential part of Islam and that all muslim women are required to wear it. If they can convince the court then burkha (under the garb of hijab) will be worn to show that they are proud muslim. This will mean that every Muslim family will try to coax their girls wear the burkha or hijab and thus creating a perfect patriarchal society at the behest of the mullahs.

Yogi can wear attire of a particular religion by being in the office of Chief Minister of largest state of India representing 22 crore population. Sikh men can wear Turban in all institutions including Defense and Police department. Only Muslim women can not cover their head. What logic is this? This is just part of polarization on communal lines for garnering votes.

In my school days if we used to wear full pants instead of allowed half pants in summers, teachers used to cut the pant with scissor and make it half, that too in front of whole assembly or class. 😅 And now these kids are fighting to wear hijab or gamcha. One of the best CTC till date. I was having same thoughts on shouldn't education be given more importance then cloths and one other hand why hijab practice is defended and ghoonghat discouraged wherein both are religious fundamentalism. SG literally gave structure to all the random thoughts and now it all makes sense. We need to ensure rights are defended but also work on reducing fundamental ideas for long term societal development.

2 of my Muslim female colleagues fresh out of engineering colleges got jobs. In 6-7 months time, both of them were married off by paying 10-15 lakh dowry in cash. In 2 to 2.5 years both have 2 children each. We realize that their professional productivity will fall after pregnancy. This is their story and fate. Both of them were good team members. 1 them was very good professionally. 1 wore hijab. The other did not. Both of them quit job. End of Story for Muslim women.

Appreciate your views. I have seen some handles in Pakistan that are narrating this whole incident as hindutva people terrorising muslim girls in India. The reality is nothing like that. I have done my schooling from one of the biggest school and a decent college as well. Not once did I see women in ghoonghat Or hijab in these institutions. Therefore, hijab women are not getting their education properly. You don't see hijab women in IITs, IIMs, etc. Meaning they're not free enough.

Many muslims will agree with me that Quran only said these are good practices not compulsory. Also, hijab and burkha are meant for women safety in 7th century. Educational institutions are not legal bodies that can regulate a citizen's right to practise religion. In such cases a person's constitutional freedom is paramount. Even Army in India can not stop Sikhs from wearing Turbans.
It is incredible that there’s an issue here. I have personally known a lot of girls (about 25-30 years ago) in western Maharashtra who went to missionary-run convent schools, which go by name St. Helena or St. Joseph where they would be sent back if they wore bindis or bangles or mehendi to school. It was (probably still is) absolutely banned in those schools. I have never heard anybody or any liberals having any issue with it!

Why would a school authority impose an uniform on people from different cultural background ? If they want to do so they should do with after consultation with every community. Why should it exclude certain section ? A school is not a constitutional or legal authority. If they want students from all background they have to cater to their sensibilities. I asked my mom who is 62 years old whether she saw any muslim girl of her school and college days wearing hizab... She said no.. She didn't even knew hizab exists in India.. In Hijab case the woman is not asking for a relief from a religious custom. She is praying to be allowed to follow her custom. If denied, effectively it is asking her to choose between one of the two fundamental rights - Education and Religion. In the end it is a choice of a woman to follow her religion or not. If a Hindu woman choses to wear a Bindi, one can't deny that. One can't force her to do that either. Same goes for a Sikh Boy wearing a Turban. Going by SG logic, if someone wants to wear hijab in police / army, they should be allowed? If not, then why this choice in schools ? Many schools too have uniforms like police / army. You are comparing apples with oranges, firstly the rule book for the govt college clearly states that hijab can be a part of uniform as long as it matches the color of the uniform. It also comes under essential religious duty so who is the state govt to pass a GO and ban it? Secondly, the army/police comes under employment. When someone signs the offer letter they are over atleast 18 and abide by the rules and laws of that entity. This is a govt college for students who are in the teenage years. Open a new argument wherein you prove with stats and data that it's a fact that Muslim women wearing hijab are exposed to more conservativism, less freedom and are under male dominated patriarchy. Let women decide then.

When I was in school, I was once denied entry to classes because I was wearing pants that did not confirm to school uniform standards. It did not seem like I am being denied my right to education. No one in our class used to be in hijab or ghungat. Is this changed lately in our "secular" India? Does Quran now overrides school policies and code of conduct rules?

I will repeat my earlier comment all religions are fundamental in their political manifestation, which is a creation of humans. All religions are inclusive at its spiritual level, which is a creation of God.
One needs to understand a woman's rights in Islam to understand the Shah Bano case.
Islam gives women right on their property (earned by them or their inheritance). Husbands cannot force wives to use their money for their family, including their children's upbringing. All that is the husbands respinsibility.
Mehar is an amount fixed at time of marriage which women get when they get married not when they are divorced. Today the Mehar goes in lakhs in well to do families.
Alimony is not a rule in Islam to balance the above. Makes sense?
@Pierre In A marriage in Islam is not a social or spiritual bond like in other religions its a Contract that 2 people agree to with witnesses. It's such a modern/futuristic concept that even in today's world that it is hard to accept.
Mehar is not dowry its an amount that the husband has to pay as part of the contract. It's written up as a contract. The conditions of talaq which is the annulment of the contract from either can also be agreed in the marriage contract.
Problem is that very few Muslims know or can express this concept and those who know do not want to discuss in a still patriarchal society.
You misunderstood and were probably looking for flaws. I did not say that kids don't belong to the husband only. It only says that the finances needed for their upbringing is the fathers responsibility. Possession of Kids is given based on their best interests as any modern court would do.

Uniform Civil Code is the only way out. Ban and repeal all personal religions i.e. Hindu, Muslim, Christian, Anand (Sikhs), Parsi acts. Goa has a Uniform Civil Code inherited from the Portuguese. I think it's worth the risk.

It's quiet simple- Mullahs/ PFI want to naturalize burkha among Muslim women.
They will argue in court that hijab is an essential part of Islam and that all muslim women are required to wear it.

One of the best CTC till date. I was having same thoughts on shouldn't education be given more importance then cloths and one other hand why hijab practice is defended and ghoonghat discouraged wherein both are religious fundamentalism. SG literally gave structure to all the random thoughts and now it all makes sense. 2 of my Muslim female colleagues fresh out of engineering colleges got jobs. In 6-7 months time, both of them were married off by paying 10-15 lakh dowry in cash. In 2 to 2.5 years both have 2 children each. We realize that their professional productivity will fall after pregnancy. This is their story and fate. Both of them were good team members. 1 them was very good professionally. 1 wore hijab. The other did not. Both of them quit job. End of Story for Muslim women.

This is the first time I am speaking up on this row and I want to say that I absolutely agree with you SG. If you want to end regression in one community, you cannot support it in another one. Using Quran to justify hijab alienates modern Muslim women like me. Those woman should be allowed to schools but on the grounds of right to choose and not right to practice a religion.

Appreciate your views. I have seen some handles in Pakistan that are narrating this whole incident as hindutva people terrorising muslim girls in India. The reality is nothing like that. I have done my schooling from one of the biggest school and a decent college as well. Not once did I see women in ghoonghat Or hijab in these institutions.

For a long time, the custom has been that muslim girls can wear hijab between school and home, but they will keep it away during classes. Why do these muslim girls want to change it in the middle of school year? Hijab isn't a prescribed thing in Quran. Many muslims will agree with me that Quran only said these are good practices not compulsory.
Also, hijab and burkha are meant for women safety in 7th century. What harm will these 21st century women feel if they attend classes without it? They have equated hijab to their identity and that a uniform without it to an attack on their faith. One of the girls even said "I was made to realise I am a muslim"... But no, it is you who are insisting that you are a muslim first and a student later. Only time will tell if this is good or bad for their own interests.

Educational institutions are not legal bodies that can regulate a citizen's right to practise religion. In such cases a person's constitutional freedom is paramount. Even Army in India can not stop Sikhs from wearing Turbans.

I have personally known a lot of girls (about 25-30 years ago) in western Maharashtra who went to missionary-run convent schools, which go by name St. Helena or St. Joseph where they would be sent back if they wore bindis or bangles or mehendi to school. It was (probably still is) absolutely banned in those schools.

But the core principle behind School uniforms is that, once the students came to college, irrespective of their religion they should look similar. This mater will not end with Hijab. in the future muslim women may demand Naqab or the face cover also.

I am 33 years old in my educational years never seen any Muslim with hijab or a Hindu with Saffron scarf in school or college.

However I have one question to Mr Shekhar , if a private school wants to enforce a uniform , do people who not belive in that rule not enroll and go to a school where they can wear their own choice of clothes? Shabano was about court ruling to give a woman a progressive right to overcome a religious restriction.
In Hijab case the woman is not asking for a relief from a religious custom. She is praying to be allowed to follow her custom. If denied, effectively it is asking her to choose between one of the two fundamental rights - Education and Religion.
In the end it is a choice of a woman to follow her religion or not. If a Hindu woman choses to wear a Bindi, one can't deny that. One can't force her to do that either. Same goes for a Sikh Boy wearing a Turban. Denying those rights - just because Shekhar Gupta thinks it is regressive is not right.

Going by SG logic, if someone wants to wear hijab in police / army, they should be allowed? If not, then why this choice in schools ? Many schools too have uniforms like police / army.
Second - SG is mistaken about having a choice about what’s written in the book. Nothing is optional. Each and every word / diktat is to be compulsorily followed.
You are comparing apples with oranges, firstly the rule book for the govt college clearly states that hijab can be a part of uniform as long as it matches the color of the uniform. It also comes under essential religious duty so who is the state govt to pass a GO and ban it?
Secondly, the army/police comes under employment. When someone signs the offer letter they are over atleast 18 and abide by the rules and laws of that entity. This is a govt college for students who are in the teenage years. If they want to put on a hijab, why stop them? And especially why to pass a GO just before UP elections to polarise the issue? The state cannot enforce what a woman should wear

When you are walking into an institution, you go by its rules. All your 'choice' thing, gets ditched right there. Be it a hijab, a pair of jeans, a ghoonghat or whatever.... You need to drop it, if the institution asks you to. Most of us have grown studying in Convent schools,which didn't allow wearing the Kalawa, or even a Tilak. We didn't create a ruckus. You cannot be imposing your choice of wear, over an institution, that has clear-well written rules on this.
When you walk into a Mazaar, you wear your hijab;When you walk into a Gurudwara, you cover your head;When you walk into a temple, follow the rules, that they impose; All this choice BS ,is restricted to your personal space. No institution will respect your choice, incase, if it has a rule, defining the thing....
In this case, the college had a clear rule on the uniform;You don't like it, you are free to leave it. You can go to a place, where your 'choice' can be practised....
When you create public ruckus over it, people will react and resist.... You will cause public nuisance and drama.... Nothing else.
Convent schools are private, the discussion is about public collages that are state funded. The state funds come with the entrapment of following the constitutional law and we follow the American secularism model not the French. So I would assume you have updated ur reference on this issue
Right & Wrong.. Personal choice is a right. Its the other version of patriarchy that you must fit into the specific box. Why are our politicians, elected reps, bureaucrats even defense allows religious dresses (tilaks, caps, kadas, turbans). Lets start change in these public offices & posts. If those in public offices have the right, then every individual has to be given the same right.

The Constitution DOES NOT mention any rules on the clothing of politicians and bureaucrats. If it would have, I would have supported your claim, on why politicians are dressing themselves up, like Modern Day Raja Babu... But there are no rules set on them. Hence, Sadhvi Pragya wears saffron; Owaisi wears a skull cap.... And so on.... I would not have supported their clothing, had the Constitution restricted it. But it doesn't.

I appreciate putting so much effort into making this video. First of all, there were no one wearing hijabs before 8 weeks ago in the same school where the protest started. Please put in more efforts to look into what happened in 8 weeks. 6 girls coming in with hijab and starting to make an issue out of nothing is just an outcome of things that have conspired over the last several weeks.
