There's also the fact that a pirate who gets caught by the British army will be hung and executed in front of a public audience of British citizens, not to mention the torture they'll suffer at the hands of their captors. Most pirates careers are cut short due to that aspect. If they didn't die during career due to the british or spanish, they usually died from disease, or end their career early after claiming a few big scores if they're smart(and lucky).

I've read that privateers were allowed to keep a portion of their plunder as payment for a job completed. I'm not gonna say you're wrong, I wasn't there, but I have a hard time believing they'd willingly give up their whole lot to the crown when piracy paid extremely well and many who became pirates were naval veterans of the war of Spanish succession and had some pretty grueling combat experiences.
