Jab married life me husband failed to pay maintenance to wife then it is not enforceable by law. But after divorce how it becomes mandatory to pay maintenance to wife
Where as the case you are talking about was just a domestic agreement between the two and was not registered in court also there was no intention to create legal relation/agreement on that matter.

As marriage they are one soul. After divorce they are individual
Cause they have entered into a contract of marriage,it mentions all the conditions about divorce and alimony.
