According to the U.S. Flag Code, §176(d), "The flag should never be used as wearing apparel, bedding, or drapery." It's _possible_ that the Trumpy Bear's flag was made _deliberately_ inaccurate so that it could be used as a blanket without violating the Flag Code. I don't think the "confusing similarity" standard of trademark law applies to products that are merely "highly suggestive of" a U.S. flag - but if it _did,_ this would still be a violation.
